DESCRIPTION OF VIOLATION
Fail Code
Discussion PIC and inspector calibrated their food thermometers during
the inspection using the ice point method. Both thermometers read 32°F.
OBSERVATION: Observed ice machine with accumulation of what appears to be
mold in the interior. PIC to fully empty ice machine and clean and
sanitize at a frequency specified by the manufacturer or as frequently
needed to preclude accumulation of soil or mold.
4-602 .11 REGULATION: Item 16 Food contact surface; cleaned and sanitized -- Ice
Machine Cleaning Frequency
Correct On Site OBSERVATION: Observed tomatoes and cut lettuce marked with stickers
indicating they will be discarded at 1:30 pm. Per discussion with PIC,
they state lettuce and tomatoes were removed from temperature control at
8:30 am. Discard time appears to exceed 4 hour maximum. Reviewed Time as
a Public Health Control (TPHC) compliance responsibilities with PIC. PIC
placed correct time sticker on containers during the inspection. PIC to
ensure TPHC procedure is followed in compliance.

OBSERVATION: Observed what appeared to be a few droppings that looked
consistent with mice on the floor adjacent to the door leading to the
outdoor refuse area. PIC provided most recent pest control report from
"EccLab" dating 11/26/24. Report states replacing traps and bait as
needed and treating interior and exterior stations. PIC to clean and
sanitize affected areas and continue to work with pest control company to
prevent and eliminate evidence of pest activity.

OBSERVATION: Observed employee bagging hash browns while not wearing a
hair restraint. PIC to ensure all employees wear a compliant hair
restraint such as a hat or hair net while handling exposed food, clean
equipment, utensils, linens and un-wrapped single-use articles.
2-402 .11 REGULATION: Item 40 Personal cleanliness -- Hair Restraints
OBSERVATION: Observed overall poor state of cleanliness throughout
establishment including but not limited to sides of fryers, exterior of
hot holding equipment, exterior of freezers, metal prep tables, and
single-use cardboard boxes. Observed plastic bucket containing grease and
hamburgers in poor state of cleanliness . PIC to ensure all
nonfood-contact surfaces of equipment are cleaned at a frequency
necessary to preclude accumulation of soil residues.

OBSERVATION: Observed cover of recycling receptacle in outdoor refuse area
in poor repair with exposed refuse. Reviewed with PIC that exposed refuse
could be potential attractant for pests . PIC to ensure receptacles are
maintained in good repair using approved methods and materials.

OBSERVATION: Observed ice cream machine, plastic buckets, and wooden
pallets stored adjacent to receptacles in outdoor refuse area. PIC
identified all items as not in use. PIC to ensure the outdoor refuse area
is maintained in clean condition and the area is maintained free of
unnecessary items.

OBSERVATION: Observed physical facilities in overall poor state of
cleanliness throughout establishment. PIC to ensure all physical
facilities are cleaned as often es necessary to keep them clean.
6-501 .12 REGULATION: Item 55 Physical facilities installed, maintained, and clean
-- Cleaning Frequency, Restrictions
OBSERVATION: Allergen statement posted adjacent to menu board does not
match wording in the Food Code. PIC to include statement, "Before placing
your order, please inform your server if a person in your party has a
food allergy" . PIC to include statement on all menus. In lieu of posting
the notice directly on the indoor or outdoor menu board itself, the food
establishment may post the notice adjacent to the menu board or at each
point of service where food is ordered.
590.011.2 REGULATION: Item 58 Allergen Awareness (509.011) -- Statement
Discussion Hood sticker dates 12/6/2024, in compliance.

In Compliance Observed wiping cloths stored in labeled bucket of QAC
sanitizer measure 150-200 ppm via PIC' s test strips. Observed egg patties
in hot holding drawer at 157-169°F; cut tomatoes at 36°F and shredded
lettuce at 370F both in walk in refrigerator.
