NORTH ANDOVER SELECT BOARD MINUTES DECEMBER 2, 2024
Executive Session: Chair Roache stated the Board will enter Executive Session pursuant to Massachusetts
General Law chapter 30A, Section 21(a)(3) - to discuss strategy with respect to collective bargaining as an
open meeting may have a detrimental effect on the bargaining and to approve Executive Session minutes of
August 12, 2024 and November 14, 2024.
MOTION: Janice Phillips motioned that the Select Board enter into Executive Session pursuant to
Massachusetts General Law chapter 30A, Section 21(a)(3) - to discuss strategy with respect to collective
bargaining as an open meeting may have a detrimental effect on the bargaining and to approve Executive
Session minutes of August 12, 2024 and November 14, 2024. Laura Bates seconded. Roll Call Vote:
Roache-yes, Phillips-yes, Bates-yes, Smedile-yes, Kres-yes.
Call To Order: Chair Brian Roache called the open meeting to order at 7:10PM in the Select Board Room
located at 120 Main Street North Andover.
Select Board in Attendance: Chair Brian Roache, Janice Phillips, Laura Bates, Clerk Rosemary Smedile
and David Kres were present
Non-Board Members in Attendance: Town Manager Melissa Murphy-Rodrigues, Deputy Town Manager
Denise Casey and Assistant Town Manager Laurie Burzlaff were present.
Public Comment
Stan Limpert of 43 Stonecleave Road expressed his opposition to the Town buying the three Chapter 61A
parcels on Stonecleave Road to build a recreation site as it would be detrimental to the residents who reside
on this street.
LICENSING
MOTION: Ms. Phillips motioned to open a meeting of the North Andover Licensing Commission. Ms.
Smedile seconded. Motion approved 5-0.
Application for six special one day wine and malt liquor licenses from Julie Olivere of Stevens
Coolidge House and Gardens for December 5, 7, 8, 13, 14 and 15, 2024 from 4:30PM – 8:30PM at
153 Chickering Road.
The new property manager Pilar Garro was present. Ms. Garro stated the six one day wine and malt liquor
licenses are to coincide with their Winter Lights event. Ms. Garro stated they are partnering with Marble
Ridge Winery. Ms. Garro stated both sets of dates listed should be weekend dates. Mr. Roache stated that
December 5 was a Thursday. Ms. Garro stated it should be Friday, Saturday, and Sunday for both
weekends. Ms. Bates asked so it should be December 6, 7, 8, and December 13, 14, 15. Ms. Garro stated
yes. Mr. Roache asked how ticket sales were going. Ms. Garro stated they are going well; they have sold
10,000 tickets. Mr. Kres asked if they change the design every year. Ms. Garro stated yes, but this year is
the most drastic change they have had in a while. Ms. Murphy-Rodrigues recommended a police detail for
the six nights due to the serving of alcohol and number of people.
MOTION: Ms. Phillips motioned to approve the application for six special one day wine and malt liquor
licenses from Julie Olivere of Stevens Coolidge House and Gardens for December 6, 7, 8, 13, 14 and 15,
2024 from 4:30PM – 8:30PM at 153 Chickering Road, contingent on Fire Department approval and police
detail required. Mr. Roache seconded. Motion approved 5-0.

MOTION: Ms. Smedile motioned to close the meeting of the North Andover Licensing Commission. Mr. Kres
seconded. Motion approved 5-0.
NEW BUSINESS
Notice of intent to sell three Chapter 61A parcels on Stonecleave Road
Ms. Murphy-Rodrigues explained what occurs when there is a 61A agricultural restriction on a property. Ms.
Murphy-Rodrigues stated the Conservation Commission has reviewed this and has voted not to pursue the
property for acquisition. Ms. Murphy-Rodrigues stated the Assessor has also looked at this. Ms. Murphy-
Rodrigues stated what happens is that they have to pay back 5 years of property tax. Ms. Murphy-Rodrigues
stated the Assessor determined the town would receive $100,000 on these three parcels. Both the
Conservation Commission and the Planning Board have voted to waive the right of first refusal. Ms. Murphy-
Rodrigues stated their recommendation to the Select Board is to waive the right of first refusal. Ms. Bates
asked if we were to purchase, there really is no plan for the property. Ms. Murphy-Rodrigues stated they
would ask to have them wait until Town Meeting to allow the town to appropriate the funds or to call a special
Town Meeting. Ms. Murphy-Rodrigues stated towns are negatively impacted by this process. Mr. Roache
asked how long does the law give us to respond. Ms. Murphy-Rodrigues stated about 60 days. Ms. Bates
asked if these were three buildable lots. Ms. Murphy-Rodrigues stated yes.
MOTION: Ms. Bates motioned to waive their right of first refusal for three lots on Stonecleave Road listed as
parcels 104B-139-0000, 104B-140-0000, and 104B-141-0000. Ms. Phillips seconded. Motion approved 5-0.
Vote to approve 2025 election calendar
Ms. Murphy-Rodrigues explained that this calendar lays out what the town election will look like this March.
MOTION: Ms. Phillips motioned to approve the 2025 election calendar. Mr. Kres seconded. Motion
approved 5-0.
Letter of support for Mass Saves Energy Manager grant
Ms. Burzlaff stated they are asking for support for an Energy Manager that would be funded by the Mass
Saves program. Mr. Roache asked if it was fully funded through the Mass Saves grant. Ms. Burzlaff stated
yes for three years. Ms. Burzlaff stated they did ask the town to indicate that, if they had the ability to, to
bring this person on after the three years is over. Ms. Burzlaff stated the town was going to use ARPA
funding in 2023 to fill this position. Ms. Burzlaff explained what an Energy Manager would do and who they
would work with to make buildings more energy efficient, and how they would help with achieving the Town’s
green community goals. Ms. Smedile asked what brings forth an advantage. Ms. Burzlaff stated it helps
being a green community. Ms. Bates asked what the salary range was. Ms. Burzlaff stated for part-time it is
$60,000; for full-time it is $120,000. Ms. Bates asked what type of qualifications and degrees do you look for.
Ms. Murphy-Rodrigues stated it is usually someone with experience in project management.
MOTION: Mr. Kres motioned that the Select Board sign the letter of support for the Mass Saves Energy
Manager grant. Ms. Smedile seconded. Motion approved 5-0.
Consent Items
A. Accept donations to sponsor tickets to Santa Breakfast

MOTION: Mr. Kres motioned to accept the donation of $500 to be used for tickets to the Festival
Committee’s annual Santa breakfast. Ms. Smedile seconded. Motion approved 5-0.
Approval of Open Session Minutes of November 18, 2024 & November 20, 2024
MOTION: Mr. Kres motioned to approve the Open Session minutes of November 18, 2024 and November
20, 2024 as presented. Ms. Phillips seconded. Motion approved 5-0.
Select Board Updates
Ms. Smedile mentioned the Parade.
Ms. Phillips thanked the Festival Committee for the tree lighting.
Ms. Phillips mentioned Wreaths Across America coming up on December 14.
Ms. Phillips mentioned the Santa Breakfast on December 15.
Ms. Phillips mentioned the North Andover Merchants Association Gingerbread Walk at the Stevens Estate.
Ms. Bates mentioned the Kittridge Meeting on Wednesday.
Mr. Kres mentioned the Historical Society’s new solar exhibit launch reception.
Town Manager’s Report
Ms. Murphy-Rodrigues mentioned Cram-A-Cruiser. Ms. Murphy-Rodrigues mentioned the Fire Department
Toys for Tots drive. Ms. Murphy-Rodrigues mentioned the Cyr Center is closing on December 21 for the
season. Ms. Murphy-Rodrigues congratulated Roger Clapp and Tom Geary for their promotions in the Water
Treatment Department. Ms. Murphy-Rodrigues mentioned that this week was the last week for leaf pickup.
ADJOURNMENT
MOTION: Mr. Kres made a MOTION, seconded by Ms. Smedile to adjourn the Select Board meeting at
7:36PM. Motion approved 5-0.
