Chair read Governor's Orders into the record. 7 8 CONTINUED PUBLIC HEARINGS 9 335 Salem Street,JCE Property Development,LLC: Application for a Watershed Special Permit under Article 4 Part 5 10 and Article 10 Section 195-10.7 of the Zoning Bylaw to authorize construction of a new single-fancily house,infrastructure, 11 and site grading on an undeveloped lot within the Non-Discharge Zone and subsurface drainage within the Non-Disturbance 12 Zone of the Watershed Protection District.The property is located in tine Residential 3 zoning district. 13 J. Enright: This public hearing was heard 7/16/24,8/13/24,and 11/26/24.Carried all previous submissions to this meeting 14 packet. Proposed house is located outside the 150-foot Non-Disturbance Zone. A portion of the project area including a 15 change in topography is located within the 150-font Non-Disturbance Zone.Applicant proposes to construct a subsurface 16 chamber system to infiltrate runoff from the roof;the system overflows through downspout openings. Site is discharging 17 greater than 100 feet from the Bordering Vegetated Wetland and per tine consultant;should not cause erosion in the waters. 18 The Site Plan and Operations&Maintenance Plan were previously revised to address all stormwater peer review comments; 19 review is complete. Department review comments were received from Conservation, Health, and NAFD;no concerns raised. 20 Board requested a condition be included in the decision regarding a post check on the performance of the underground sub- 21 structure system. A draft decision is in the packet. 22 Jack Sullivan,PE,Sullivan Engineer Group:House footprint 28' x 46'. Site involves conventional stormwater management, 23 collecting roof runoff into an underground infiltration system,pervious pavers for the walkway and driveway and open turf 24 stone within driveway. Preserved existing trees on site,proposed soil stockyard located in front yard,no work proposed 25 within 100' of any wetland;all physical structures are outside the 150'Non-Disturbance zone.All requirements for a WSP 26 met with peer review. 27 E.Goldberg: We heard from abutters regarding stormwater issues in the general area and concerns of adding a home here. 28 Project was peer reviewed leading to satisfactory changes."After the fact"compliance testing is being included in our 29 decision.No public comment has been received. 30 MOTION: S.Kcvlahan made a motion to close the public hearing for 335 Salem Street.J. Simons 33 seconded the motion.The vote was 5-0,unanimous in favor. 34 35 1250 Osgood Street, 1250 Osgood St LLC:Application for a Limited Site Plan Review Special Permit, and Site Plan 36 Review and Parking Special Permit under Article 8 Supplementary Regulations,Part 3 Site Plan Review[Site Plan Review], 37 Article 8 §195-8.17.1 [Limited Site Plan Review],Article 8,Part 1, §195-8.8 [Parking Special Permit],and Article 10 38 Administration §195-10.7 of tice North Andover Zoning Bylaw.The applicant proposes razing of existing building and related 39 improvements,and the redevelopment of the property into a 2/3 story building of approximately 21,145 40 SF in size.New building to be used for a child care facility and associated play areas, along with medical office uses and other 41 uses as may be allowed under the Zoning Bylaw.Property is located in the Industrial 2 zoning district. 42 J.Enright: Stormwater review is complete. Revised Site Plans addressing sidewalk and radius concerns and a revised Lighting 43 Plan are included in the meeting packet.Lighting Plan confirms no light spillover across property boundaries. A draft decision 44 has been prepared for your consideration. 45 John Smolak,Atty.for Applicant: Had no further comment. 46 Board: Suggested a pick up/drop off plan should be included as part of the O&M plan. 47 MOTION: S. J. Simons seconded the motion. The vote was 5-0,unanimous in favor. 51 52 NEW PUBLIC HEARINGS 53 318_Salem Street,Jaime Lyn-Pickles:Application for a Watershed Special Permit under Article 4 Part 5 and Article t0 54 Section 195-10.7 of the Zoning Bylaw to authorize construction of an inground pool and concrete apron within the 325'Non- 55 Discharge Zone of the Watershed Protection District. The property is located in the Residential 3 zoning district. 56 J.Enriuht: The lot was created in 1980;on town water and sewer.The proposed pool location is within the 325'Non- 57 Discharge buffer to a wetland resource area;approximately 161 feet from the edge of a bordering vegetated wetland. The 58 project involves construction of a 15' x 32' inground pool with a 4-foot concrete apron, located in the rear of the existing 59 house. Stormwater management for the site is proposed by the conveyance of all runoff from the pool area into a 2' wide 60 stone infiltration trench,at a depth of 2',During construction,the perimeter of work will be protected with staked erosion 61 control barrier to prevent migration of sediment from the site until final stabilization. Stormwater peer review was conducted 62 by Horsley Witten;all concerns have been addressed. Specifically,the erosion control barrier has been extended,a 63 construction entrance and stockpile area were added to the plan; a maintenance log has been added to the Operations and 64 Maintenance Plan, 65 Jaime-Lyn Pickles,homeowner &David Beati: Provided brief history of the home built in 1957 by her great uncle;third 66 generation to own the home. Tied into town sewer in 2023. Lots were recreated based on an ANR lot change when 314 and 67 318 were split.The lot was altered again in 2008 to allow for construction of a garage. 68 David Beati,PPS Land Surveying,Inc:Confirmed no water builduplponding on the property and that the pool mechanicals 69 are proposed to be located to the reap of the house where the patio is located.The location of the brook sits 10-12' below 70 grade of proposed pool. It would take a tremendous storm to allow water to rise over the banks up the slope.No evidence of 71 water while surveying the property. Stormwater management has been overdesigned. 72 E.Goldberg: Stressed importance of deed restriction relating to use of fertilizers in the watershed proximate to the lake. 73 MOTION: S. Simons seconded 76 the motion.The vote was 5-0,unanimous in favor. 77 78 DISCUSSION ITEMS: 79 314 Salem Street,David Pickles: Request for Waiver of a Watershed Special Permit to allow for the construction of a 6' xx 80 30' farmer's porch primarily within the Non-Discharge Zone;however,a small portion is located within the Non-Disturbance 81 .Zone. 82 J. Enright: This lot was also created in 1980; lot served by town water and sewer. Land disturbance consists of the installation 83 of 5 concrete footings.There is a wetland resource area at the west corner of the parcel,northwest of the proposed work.The 84 Conservation Administrator has confirmed the accuracy of the wetland flagging and the work requires a Small Project 85 application with the Conservation Commission. Proposed disturbance is located approximately 91' from the edge of the 86 bordering vegetated wetland.Stormmwater management consists of the conveyance of all runoff fi-om the proposed rooftop into 87 a 2-foot diameter leaching catch basin,as a depth of 2-feet.The basin will be encased in a 12-inch width of clean,crushed 88 stone,wrapped in filter fabric.During construction,the perimeter of work will be protected with a staked erosion control 89 barrier. J.Borgesi,Town Engineer,peer reviewed the stormwater management design finding it acceptable. 90 MOTION: S.Kevlahan made a motion to approve the Waiver of Watershed Special Permit for 314 Salem Street.J. Simons 91 seconded the motion.The vote was 5-0,unanimous in favor. 92 93 Stonecleaye Road Lots, Barbara J Adams: First Right of Refusal-Chapter 61;Map 104.E Lots 139, 140, 141. 94 J. Enright: This agenda item was carried forward from the last meeting.J. Simons: Reached out to all parties that may be interested in these lots and no interest was expressed. Property is wet, 97 sloped,and remote to any trails network.Feels it is within bounds to waive the right of first refusal. Suggests creating a 98 summary outlining the reasons the Planning Board trade this decision. 99 MOTION: J. Sin-ions made a motion on behalf of the Planning Board making a recommendation to the Select Board to waive 100 our right of first refusal for the Stonecleave Lots. S. Kevlahan seconded the motion.The vote was 5-0,unaninnous in favor. 101 102 Affordable Hones Act: Accessory Dwelling Units draft bylaw. 103 J.Enright:Minor redline edits were made to the draft based on discussion at the last meeting. 104 E.Goldberg: Summarized results fi-onn recent meeting with the BOS where Family Suites were addressed. BOS is of the 105 opinion that based on metrics,keeping the bylaw may not be useful,providing there is a plan in place to protect residents who 106 have them and once they run out to help residents transfer them over to ADUs.Open areas in the draft currently depend on 107 state guidance. It is not known when the regulations/guidelines will be received. 108 J.Enright:Anticipates reviewing potential bylaw amendments in addition to ADUs at the I2/17/24 meeting. 109 110 MEETING ADJOURNMENT: 111 MOTION: P.
