Box 50 Tewksbury, MA 01876 RE: DEP File 4242-1689 1995 Salem Street(Lot 1) 676 lompliance with Order of Conditions Re-Planting Requirements Dear Mr. Hodgson, As you are aware, at its February 19, 2020 meeting the Conservation Commission reviewed and discussed the above referenced matter and voted to require replanting of the Riverfront Area. The Commission ordered that all three lots in the subdivision be reviewed for compliance with limits of clearing and that replanting specifications be prescribed by Conservation Department staff. The Commission ordered that the replanting plan become part of the record and a requirement of the project approval. The Commission indicated that failure to abide by the replanting plan and any associated conditions would result in withholding issuance of a Certificate of Compliance and release of the bond. I Red Oak @>/= 1.5" caliper 4 Shrubby Trees: •2 Chokecherry @>/ 1.5" caliper(or if multiple stemmed, at least 3 stems per plant) •2 Eastern Red Cedar @ 1.5" caliper Seed Mix Choices: (as specified at New England Wetland Plants, Inc., and to be sown as they recommend) •New England Conservation/Wildlife Mix •New England Wildflower Mix The side slopes at the driveway for 1985 and 1975 are currently stabilized with shredded bark mulch from the original trees that were there (mix of hardwood and pines). A seeding specification for these areas will be required. I requested that you to consult with wetland scientist or landscape professional that may have a better understanding of how to treat these slopes and conditions and provide a proposal to revegetate these areas as the existing mulch is prohibiting growth. In speaking with Steven Erikson of Norse Environmental today,he suggested ground creeping Juniper, which should do well in these areas and eventually form a dense mat. I recommend that Norse Environmental provide a specification for the Juniper(size and# of plantings for these side slopes. The following pre-planting conditions shall apply: • All plant material shall be conservation grade and copies of P id invoices for all materials specified above shall be forwarded to the Conservation Department immediately upon availability. • Once the plant material is delivered on site but before installation, a site inspection shall be scheduled with the Conservation Department, the developer,project engineer and landscape contractor to inspect plant specimens for health and vigor and review and stake out their placement in the field. • planting means and methods shall be reviewed to ensure proper plant site preparation and soil amendments, Thomas Hodgson RE:DEP File 1#242-1689 1995 Salem Street(Lot 1) Non-Compliance with Order of Conditions Re-.Planting.Requirements February 25, 2020 Page 2 of 3 i l The following post-planting conditions shall apply: • Upon completion of planting, a site inspection shall be scheduled with the Conservation Department, the developer and landscape contractor to verify installation. • Plantings shall be deeply watered once a week during the first growing season and not less than once every other week during the second growing season, • The trees shall exhibit 100% survivorship after two full growing seasons post installation. • The shrubs and seed mix areas shall each exhibit 75% survivorship after two full growing seasons post installation. We also discussed the need for the sediment build up at the inlet of the culvert under the shared driveway to be cleaned out and re-dressed with additional rip-rap. Areas along the edge of driveway will also need re-dressing as plowing has displaced some stone and exposed soils. Upon compliance with the above directives, and if all other work is completed and site conditions are fully stabilized, a Certificate of Compliance may be requested. The designated open space parcel shall be donated/transferred to the Town of North Andover through its Conservation Commission pursuant to MGL Ch. 40 Section 8C. The Conservation Commission shall manage and control said property for conservation, natural resource protection and passive recreation. (If not donated to the 'Town) A perpetual restriction shall be placed on the land pursuant to the procedures set forth in MGL Chapter 184 Section 31, running enforceable by the Town and shall be recorded. Such restriction shall provide that the usable open space shall be retained in perpetuity for one or more of the following uses(as applicable).conservation, natural resource protection, agriculture, or recreation. Hopefully this is a start? It would take me some time to track actual language from conditions in Orders of Conditions. can do that research, but if the two blurbs suffice, let me know.
