Update on 0 Methuen Street project. At the time of submittal,,the engineer was advised that the application was without the following information. Name of current owners of the private way. Written documentation stating that the petitioner has the right to do the proposed improvements. Written documentation that Town can go onto property to do any maintenance. Written maintenance agreement who will maintain the road and keep it a private way. Written documentation of how lot 21 dt 22 became lot 30. Submit a stamped letter of certification from Bob Daley, Engineer for the project. Applicant should go to ZBA and request to do a duplex. I did contact the applicant and advised that a legal notice needed to be published in the newspaper, he asked me to fax the legal notice to his attention and he would make sure it reached the newspaper in time for the deadline. As such a public hearing was scheduled for January 4,2005. At that meeting the comments were raised in regards to the project along with requests for additional information. A review by the Board's consulting engineer also needs to be addressed. Since that time continuances have been requested to allow your engineer time to revise the plans and address issues raised at that meeting. As of today February 4,2005 no new information has been submitted. The board's consulting engineer needs to receive revised plans a minimum of two weeks prior to a meeting date because of this time line no new information will be able to be discussed at the February 15,2005 Planning Board meeting. A continuance request needs to be submitted, To be heard at the next available meeting on March 1,2005 new plans and information must be submitted a minimum of two weeks prior to the meeting date. Upon these reviews, I observed that the noted"centerline of swale" was not flagged as a resource area. It is in my opinion that this"swale" is a resource area (specifically intermittent stream and associated bank)jurisdictional under both the Wetlands Protection Act and the Local Wetlands Bylaw. It appears that there is no Bordering Vegetated Wetland (BVW) associated with this resource area. Therefore, the edge of bank needs to be delineated in the field and surveyed on the plan. In addition, all associated buffer zones (100-foot, 50- foot No-Build Zone, and 25-foot No-Disturbance Zone) need to be added to the plan. A Notice of Intent(NOI) filing with the Conservation Commission will be required, as work is now proposed within the 100-foot buffer zone to this additional resource area. Mr. Daley has been notified and will be submitting a NOI filing with the Conservation Department in the next few weeks. Once the NOI is submitted, I will re-conduct a site review to verify resource area boundaries and conduct further plan review. The following responses to their review comments for the subject project are presented herein in the order as presented in their letter. Appendix V—Rules and Regulations Governing Stormwater Management 5.c--The detention basin P-1,located near Methuen Avenue,bas been redesigned in order to achieve a 2' separation. The revised pond,as designed without a sump,will no longcx require a fence as suggested. Pond P-2, as modeled,is really not a true detention basin as no detention is being achieved,but merely functions as an overflow device for the two contributing drainage$wales. Additional Comments and Issues 1, Based on the revised design of Pond P-1, there are now no increases in the flow rates at each design points for both the 10 and 100 year storm events. 2. From the proposed impervious Surface (roadway and driveway), the entire volume of stormwater runoff will be detained within Portd P-I prior to outletting to a grass-lined drainage swale as designed. As a private access, there will be minimal or no sanding bf the roadway and driveway. However, periodic street sweeping, most likely once in the spring and.fall, will serve to remove a substantial amount of any grit and sand accumulation. The rip rap swale will also remove these bypass settleable solids. ,A.significant amount of suspended particles will be removed within the Pond P-1 during low-flow rainfall events by adhesion and absorption. Remaining pollutant matter will be further retained within the vegetated drainage Swale, The stormwater i i pollutant removal efficiency should flush(80%)for the low flow first—flush runoff events. At outlet point,at the confluence with the two (2)proposed drainage swale, the maximum storage volume retained will be approximately 41 cubic feet. .At this location, where final stillation of runoffstormwater from the contributing watershed will occur prior to discharge from the site, any potential remaining water-borne pollutant matter can be settled. Substantially all flotable matter should have been filtered and uptaken by the pond and swales prior to discharge of stormwater. We received the Merrimack Engineering Services' responses to VHB's latest review. It appears that there are only a few minor items that need to be addressed (see attached). Chris will be providing an update to the Board. I anticipate presenting a decision at the April 19th.meeting. 0 Methuen Street- the objective for this evening is to address the waiver requests for the project. Town Staff met with the applicant's engineer, Bob Daley to review the overall design and the proposed waivers. We believe that the easement issue has been addressed. Jack Sullivan would agree to the easement waiver requests so long as the entire site is maintained by the applicant including all onsite drainage measures, road maintenance, snow removal, etc. The duplex will be sprinkled and allow adequate access for emergency vehicles. The applicant agreed to the recommendations and language is currently being drafted to address the issue of privatizing Methuen Street and the Site. I spoke with Chief Dolan who informed me that the fire department has been trained to deal with this situation but my concern is with other vehicles/companies not trained to operate in this situation or with only one person in the vehicle(no one to assist in backing tip). • Tree removal- the removal of trees without replanting others will affect the water table as well as the landscaping aesthetics of the area. • Water run-off- Water run-off from Sutton St is already an issue, opening the street and removing the brush will allow for greater water flow though the area Onto my property.
