Hi Jean,
Pursuant to the Definitive Subdivision decision for 101-115 Sutton Hill Road (Capstone),
condition 3)F) regarding development schedule:
There are no utility or other common site development work items involved in this project, there
are only residences and associated services. Our expectation is that all site and home
construction activity will take place between April 2016 and May 2017, of course pending market
conditions for the new homes. Any significant variations from this will be noticed to the Town
Planner,
2Q16: Site and erosion controls; demolition; clearing; utility services; first foundation.
3Q16: second foundation, construct first home, begin construct second home
4Q16. construct second home, third foundation, begin construct third home
1-2Q17: complete last home, stabilize and restore site

This Letter of Agreement is between the the above named Independent Monitor and the North Andover Planning
Board for monitoring services to be provided at the above mentioned Project Address and in accordance with
the conditions and restrictions stated by the Planning Board in it's Decision dated rti 1� a
copy of that Decision has been provided to the Independent Monitor. (Initials of independent
Monitor) By initialing,the Independent Monitor acknowledges receipt of the Decision and an understanding of
the conditions/restrictions set by the North Andover Planning Board.
The Independent Monitor also acknowledges and agrees that he/she Is providing monitoring services for the
benefit of the Town of North Andover and Is not the project owner or applicant, and does not have a financial or
personal Interest in the project. Further,the Independent Monitor understands that she/he may not act as the
project owner's agent,representative, partner,employee or joint-venturer on this project.
The Independent Monitor agrees to Immediately report to the North Andover Planning Board,via the Town
Planner, any violations of the terms of the Decision listed above,as soon as observed or otherwise become
known to the Independent Monitor.This report is in addition to regularly scheduled monitoring reports.
The Independent Monitor under ands that the failure to perform under this Letter of Agreement,to the
reasonable satisfaction of the N4h Andover Planning Board,will be grounds for said Independent Monitor to be
excluded in this role for any furo projects which are within the jurisdiction of the North Andover Planning Board.

Hi J ean,
As I recently mentioned, we have a planned financing/closing obligation regarding this project on March 11, and would like to get a few administrative
items taken care of in order for that to occur. Hopefully these can be authorized or coordinated with brief attention at next weeks" meeting.
Primarily, this is driven by the need to separate the Piotte residence (115 Sutton Hill Road)from the balance of the project paLcw on the date of
transfer, in order that they can retain their current mortgage in place and retain the associated legitimate residence and lot. Holy, 2�L� A0
In order for this to occur 1 believe we need to satisfy the conditions precedent to the release of lots. This includes Condition 3 (Prior to Enement of
the Plan) and Condition 7 (Prior to any Lots Being Released from the Statutory Covenants).
Regarding Condition 3:
A)the Form I is being endorsed today by the mortgage holder and will be in hand by Tuesday_
B)The note regarding private drive has been added.
C)There are no facilities being installed pursuant to DPW, roadway construction waived.
D) Draft plans were submitted, the mylars will be in hand by Tuesday as well.
E)The decision appears on page one of the mylars.
F) A development schedule has been prepared and will be submitted by Monday.
G) Documents have been prepared at applicants expense.
H)There are no Conservation conditions or orders applicable.
1)The monitoring agreement has been completed and will be submitted by Monday.
We understand that the plans cannot be endorsed until the appeal period expires, but are hoping that the endorsement can be authorized pursuant to
these conditions being satisfied as noted.
Regarding Condition 7:
A)The Form J has been completed and will be submitted on Monday along with other documents.
B)Tim Willett, DPW, indicated that he would provide the Performance Bond recommendation either today or by Monday.
Similarly, we understand that the Form J cannot precede the expiration of the appeal period, but are hoping that the endorsement can be authorized
pursuant to these conditions being satisfied as well.
Potentially the endorsement of the plans and Form J could take place, with those documents then held in the planning office until the expiration of the
appeal period, which is two days prior to our planned closing.

Tim has recommended $1,900 for the sidewalk fund and $2,500 for the roadway bond. I will add you to the March 2 agenda (we meet on Wednesday
because of the election).

Thanks as always for your time earlier today.
This correspondence is to request that the Site Opening and Street Bonds for the Capstone subdivision be released at the next available meeting (October 3).
As discussed today, Jack Sullivan will forward the 97 Sutton Hill Road certification letter tonight or tomorrow, to supplement the site as-built plan which you already
have on file (and which also contains the certification language, FYI).
