6 Master Plan Implementation Committee: Bi-annual progress report.
7 S.Kevlahan:Presented biannual progress report on behalf of the Master Plan implementation Committee. Online website has
8 been updated tracking Master Plan Implementation initiatives.Reviewed all topics included in the bi-annual update memo.

10 Potential May 13,2025 Annual Town Meeting Zoning Bylaw Amendments:
11 Historic Barn Overlay District draft bylaw amendment
12 J. Enright,This is mainly a housekeeping article based on the AGO's approval letter for the Historic Barn Overlay District
13 bylaw approved at May 2024 Annual Town Meeting,The first concern expressed was that the snap referenced in the article
14 titled"North Andover Old Center Historic District 1978"was not allaclied to the Warrant Article as stated in §195-20.2
15 Establishment and Boundaries.This amendment proposes to cure that oversight. Second, in the"Information Required"
16 section of the bylaw,the language had the application being delivered to the Planning Dept. for review of completeness and
17 Planning would time stamp it in the Clerk's Office. This process is not consistent with M.G.L. -the Petitioner is required to
18 deliver it to the Clerk's Office,

20 Flood lain District draft bylaw amendment
21 J.Enright: Amy Maxner provided a cover memo,which details the reason for tine proposed amendment. The majority of the
22 strikethroughs are to delete certain zones that do not exist in North Andover.Expressed concerned that a map date is
23 referenced;however,we do not yet know for certain what that date will be.Amy is looking into it.

25 Accessor Dwellin Units draft bylaw
26 J.Enright: EOHLC has issued draft regulations. Public comment process will occur 12/20/24-1/10/25. After that process,
27 regulations will be finalized,expects they will be finalized prior to tine February 2,2024 effective date. Regulations consist of
28 several defined terms,prohibited regulations,unreasonable regulations{which are consistent with Dover case law},and
29 information on annual reporting requirements.The draft bylaw has been updated to reflect these regulations;the redline and
30 clean version are in your packet.
31 E.Goldberg: We now have answers to certain questions;we cannot limit ADUs to single-family dwellings,they can pertain to
32 a 1,2 or multi-family dwellings. The draft bylaw proposes to allow only one ADU per lot and not to allow for more than one
33 unit by special permit,and if you want to do an ADU on anything greater than a single-family dwelling lot it will be via
34 Limited Site Plan review.Attached or within a single-family dwelling is by right.
35 K. Kelly: Questions if these are draft Regulations that will be enforceable and have preemptive authority over anything at tine
36 local level.Also questioned whether there a possibility that they will be legally challenged and if the Board can expect
37 significant public comment on the Regulations.
38 E.Goldberg: Responded that regulations will become part of tine Code of Ma Regulations(CMR). There could be changes
39 made to the draft,but feels they would likely be minor. The Regulations could be challenged;however,feels that wouldn't
40 likely happen before Town Meeting.
41 S. Kevialian: Surprised the state broadened it beyond single-family dwellings.
42 E.Goldberg: Multi-families will have to meet setbacks;there will be various ownership models.
43 J.Enright: Reviewed the redline edits that were made in response to receiving the draft Regulations.

46 J.Enright: The proposed amendment adds ADUs to the protected uses included in the Limited Site Plan Review bylaw.

49 J.Enright: As suggested at the last ineeting,the draft warrant article proposes to sunset the family suite bylaw and the
50 associated definition. Board agreed on an expiration date of 7/1.2028 for both the definition and permitted use.Legal notice
51 to post twice in January for an opening date of 214125 public hearing. Board agreed to wait on addressing utilities in the bylaw
52 particularly for detached structures,Jean to speak with DPW regarding preferable options and procedures regarding town of
53 water and sewer connections;undergrounding of utilities preferred.

56 MOTION:P. Boynton made a motion to accept the minutes for November 26&December 3,2024. S.Kevlahan seconded
57 the motion.The vote was 4-0,unanimous in favor.
