The application was submitted by applicant Stephen Smolak, owner of the property Stephen Matthews, prepared by Engineering and Survey Services, dated September 22, 2010. Findings of Fact The Planning Board makes the following findings as required by Section 5B Review Standards for Preliminary Plans as set forth in the Rules and Regulations Governing the Subdivision of Land,North Andover, Massachusetts, Revised February 1989: A. The applicant had submitted a conceptual plan on March 23,2010, showing conformance with design criteria for the street plan and profile, as set out in section 5.2.5.4 and section 6.8 in the town of North Andover Subdivision Regulations. In this conceptual plan, the ROW met the requirement for 50, with a paved width of 26 feet. The Preliminary Plan shows a ROW of 40 feet with a paved width of 18 feet. The plan also shows a "t" turn- around at the end of the road in place of a full cul-de-sac. The Fire Department has provided comments stating that they do not think that the decreased pavement width and "t"turn-around will be a problem for safety purposes. B. The applicant had previously provided a plan showing improvements to Ellis St. and the creation of 4 lots. Based on feedback from homeowners and residents in the area, the applicant has changed the design to create a separate street ("Matthew's Way), as depicted on the Preliminary Subdivision Plan dated September 22, 2010. C. The Preliminary Plan adheres to the requirements of section 4.1, and in particular section 4.3,12, in that they have provided information regarding drainage systerns, sewer and water pipes and other utilities. The drainage system has been reviewed by our outside consultant, who has stated that the plan meets general requirements for drainage for Preliminary Subdivisions, but that the Definitive Subdivision will need to meet more specific requirements with regard to protection and maintenance of groundwater levels and treatment of stormwater runoff from paved surfaces. D. The Preliminary Plan does not comply with section 4.39, in that it has not provided a statement describing cut and fill operations, including a general assessment of the next import and export of fill. As the applicant has followed the procedures and provided the information required by the Rules and Regulations as demonstrated by the Findings of Fact the Planning Board herein APPROVES this application for a Preliminary Subdivision Plan. Any decisions made by the Planning Board regarding this Preliminary Subdivision Application are not binding upon the Planning Board and are not to be considered as an approval or denial of any future Definitive Subdivision filing. Any Definitive Plan Bled at a future date may contain more detailed information than that provided with this Preliminary Plan. This information will be presented and discussed at a formal Public Hearing, 1.
