(Condition #32): The NACC finds that the intensive use of the upland areas and buffer zone proposed on this site will cause further alteration of the wetland resource areas. In order to prevent any alteration of wetland resource areas a twenty-five foot (25) No Disturbance Zone and a fift £y oot (50') No-Construction Zone shall be established from the edge of the wetland resource area delineated by wetland flags WF-Al - WFA7. A fifty foot (50) No-Disturbance Zone and a seventy-five foot(75') No-Construction Zone shall be established from the edge of the wetland resource area delineated by wetland flags WF-B1 - WF B8. The Conservation Administrator and/or other agents of the NACC do not have the authority to waive these setbacks as established under the local bylaw. No disturbance of existing grade, soils or vegetation is permitted in the No-Disturbance zone. (See Section 3.4 &Appendix F of the local Regulations). 2. (Condition #33): The NACC has jurisdiction over all of the wetlands and associated 1.00- Foot buffer zones site and any work that involves ground disturbance or changing the current conditions in these areas will require separate permitting with the NACC. 'Phis includes,but are not limited to, house additions, pools, patios, decks, sheds,fences, garden beds, landscaping and bridge installation, tree or vegetation or tree cutting/pruning. These activities shall be held to the current standards under the Bylaw and WPA and must be reviewed under a separate application submitted to the Conservation Commission. 3. (Condition #48): All wetland markers shall remain in perpetuity and shall be reestablished in the field mounted on mature trees, 4x4 pressure treated, or cedar posts or other weather resistant material (whichever is most appropriate as coordinated with the Conservation Department staff). This included six (6) wetland markers along the tree line for the IVW at the front of the property, and five (5) markers along the No- Disturbance Zone (now 50' from the edge of wetland) for the BVW at the rear of the property, spaced evenly about 25' and shall incorporate the following text on their upland side: "Protected Wetland Resource Area". Said markers are available for purchase in the Conservation Department at Town Hall. The applicant shall instruct all agents to explain these markers to buyers/lessees/landscapers and all persons taking over the property from the applicant. These markers shall remain posted and be replaced as necessary in perpetuity. 4. (Condition #65): There shall be no discharge or spillage of fuel, or other pollutants into any wetland resource area. If there is a spill or discharge of any pollutant during any phase of construction the NACC shall be notified by the applicant within one (1) business day, No construction vehicles are to be stored within 100 feet of wetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance is to be done within 1.00 feet of a resource area. 5. (Condition #66): No underground storage of fuel oils shall be allowed on any lot within one-hundred (100) feet of any wetland resource area. 6. (Condition #67 & 68): Fertilizers utilized for landscaping and lawn care shall be slow release, low-nitrogen type (<5%), phosphorus free and shall not be used within 25 feet of a resource area. Pesticides and herbicides shall not be used within 100 feet of a wetland resource area. No sodium-based products shall be used for control of ice or snow within 100 feet of the wetland. 7. (Condition #69): There shall be no dumping of leaves, grass clippings, brush, or other debris into a wetland resource area or beyond the 25-foot No-Disturbance Zone demarcated by the constructed stone wall. 8. (Condition #71): The use of coal tar-based pavement sealants is prohibited oil the property, as they have been determined to contribute high levels of polycyclic aromatic hydrocarbons (PAHs) to stormwater runoff. This condition shall survive the Order of Conditions and shall run with the title of the property. 9. (Condition #72): Any/all pool water draw down shall be directed outside the 100-Foot Buffer Zone over lawn area, and not discharged directly into the bordering vegetated wetland.
