Exhibit A
This is a legal description appended to a Farrant Article filed by
the Marbleridge Development Corporation, Michael Kasabuski ,
President and Treasurer and is intended to further identify
Castlemere and Carriage Chase, so--called, the roadways shown on a
plan of land entitled "Definitive Subdivision Plan of Marble Ridge '
in North Andover , Mass. " said plan recorded in the North Essex
Registry of Deeds as Plan 09791 . The roadways petitioned for
acceptance as public ways are further bounded and described as
follows :
Beginning at a point in the easterly line ,of Great Pond Road,
at the corner of Lot 1A, 98.28 feet southwesterly of a drill
hole set as shown on said Plan; and thence running by an are
with a radius of 25 feet , a length of 31 .42 feet to a point ;
and thence continuing to run by the westerly frontage of Lots
1A, Lot 21 , 20 , 19, 18 and 17 as said lots abut Castlemere to a
point ; and thence continuing to run by an arc with a radius of
25 feet a length of 39 . 77 feet to a point ; and thence by the
southerly line of Lot 17 as it abuts Carriage Chase to a point
in the corner of the stone wall as shown on said Plan; thence
continuing to run westerly by the stone wall 27.63 feet to a
point ; thence turning and running south 14 56' 10" east 59. 14
feet to a point in the southerly line of Carriage Chase as it
abuts Lot 16 and thence running westerly by the frontage of
Lots 16, 15 , and 14 as said lots abut Carriage Chase to a
point ; thence turning and running .-by an arc with a radius 'of 25
feet for a length of 38. 76 feet ; thence turning and running in
a southerly and westerly direction by the frontages of Lots 14 ,
13, 12 , 11 and other land shown on said Plan now or formerly of
Marbleridge Development Corp, as said lots and land abut
Castlemere to a point ; thence turning and running by an arc
.with a radius of . 20 feet a length ,of 31 .42 feet to a point in
the easterly line of Marbleridge Road; thence turning and

point ; thence turning and running by an are with a radius of 20
feet a length of 31 :42 feet to a point in the northerly line of

land of the said Marbleridge Development Corp, as said lots and
lands abut Castlemere to a point ; thence turning and running by
an arc with a radius of 25 feet for a length of 31 .42 feet to a
point in the easterly line in Great Pond Road; thence turning
and running northerly by the Easterly line of Great Pond Road
90 feet to the point of beginning, meaning and intending to
descibe the ways shown as "Castelemere" and "Carriage Chase" on

The Planning Board will need the following documents prior to April
13 in order to make a favorable recommendation at Town Meeting:

Dear George and Kathleen :
Please accept this letter as my certification , pursuant to
the direction of the Marbleridge Development Corporation ,
Michael Kasabuski , President and Treasurer, that I examined the
records of the North Essex Registry of Deeds from 1980 to the
present inclusive of the acquisition by Marbleridge Development
Corporation of the subdivision located on the ways now known as
Castlemere and Carriage Chase . I identified all plans listed in
the Grantors Index under the Marbleridge Development
Corporation , which show any easements or other right intended
to establish or promote public utilities .
I prepared the easement enclosed herewith granting to the
Town of North Andover the right to utilize all of these
easements and public utilities and have recorde~r this easement
in the North Essex Regisitry of Deeds on � as

with the perpetual right and easement , together with the right
to pass and repass for the purposes thereof , to use in common
with others entitled thereto for all forms of utilities for all

The . ways are more specifically described by a
conveyance of the fee interest in such ways by the
Marbleridge Development Corp. to the Town of North Andover
dated March 31 , 1995 and recorded in the' North Essex
Registry of Deeds, which deed and description is herein
incorporated by reference.
Also conveyed herein is the perpetual right and
easement together with - the right to pass and repass for '
the purposes thereof to utilize the three areas located on
Lots 13, 14, 15, 16 and 17 of said plan and identified as
"Temporary Drainage Easement" lying to the southerly and
easterly side of Carriage Chase together with the right to

Know all men by these presents that whereas the under-
signed has submitted an application dated October 22, 19841,
to the North Andover' Planning Board for approval of a definitive
plan of a certain subdivision entitled "Marbleridge" and dated
October 19 , 1984 , Rev. December 1984 , and has requested the Board
F to approve such plan without requiring a performance bond,
NOW, THEREFORE, THIS AGREEMENT WITNESSETH that in con-
sideration of the North Andover Planning Board approving said
plan without requiring a performance bond , and in consideration
of One Dollar in hand paid, receipt whereof is hereby acknowledged ,
the undersigned covenants and agrees with--the Town of North Andover
as . follows:
1 . The undersigned will not sell any lot in the subdivision or
erect or place any permanent building on any such lot until
the construction of ways and municipal services necessary to
serve adequately such lot has been completed in the manner
specified in the aforesaid application, and in accordance
with the covenants, conditions, agreements, terms and provisions
thereof.
2. This agreement shall be binding ' upon the executors, admini-
strators, devisees, heirs, successors and assigns of the
undersigned. •
It is the intention of the undersigned and it is hereby under-
stood and agreed that this contract shall constitute a covenant
running with the land included in the aforesaid subdivision
and shall operate as restrictions upon said land.
It is understood and agreed that lots within the subdivision
shall , respectively, be released from the foregoing conditions
upon the recording of a certificate of performance executed
by a majority of said Planning Board and enumerating the
specific lots to be so released, all as provided by Section
81--U, G.L. c. 41.
3. The undersigned represents and covenants that the undersigned
is the owner* in fee simple of all the land included in the
a£o.resaid subdivision and that there are no mortgages of record
or otherwise on any of said land, except such as are described
below and subordinated to this contract, and the present holders
of said -mortgages have assented to this contract prior to its
exception by the undersigned.

4 . That the undersigned agrees to record this covenant with the
North Essex County Registry of Deeds, forthwith, or to pay
the necessary recording fees to ' the said Planning Board in
the event the Planning Board shall record this agreement
forthwith. Reference to this covenant shall be entered upon
the Definitive Subdivision Plan as approved .
5. A deed or any part of the subdivision in violation of the
covenant shall be voidable by the grantee prior to the
release of the covenant; but not later than three .(3) years
from the date of such deed , as provided in Section 81--U,
Chapter 41 , M.G. L. .
6. That this covenant shall be executed before endorsement of
approval of the definitive plan by the Planning Board and
shall take effect upon the endorsement of approval . Said
covenant shall exprire two (2) years from the date of
endorsement of the definitive plan. _
7 . Upon final completion of the construction of ways and install-
ation of municipal services as specified herein, on or before

covenant by an appropriate instrument, duly acknowledged.
Failure to complete construction and installation within the
time specified herein or such later date as may be specified
by vote of the Planning Board with a written concurrence of
the applicant, shall result in automatic rescission of the
approval of the plan. Upon performance of this covenant with
respect to any lot, the Planning Board may release such lot
from this covenant by an appropriate instrument duly recorded.
