ABBOTT VILLAGE (#242-443)
The North Andover Conservation Commission met to review and
discuss the information and revised plans that were presented at
the re-opened Public Hearing on Abbott Village held on February
14 1990 Although the site plans had changed the applicant
Ben Osgood stated on 2/14/90 that he did not want to discuss
anything but the two roadway crossings in an Amended Order of
Conditions The NACC went over the entire plan to discuss the
effects of wetland boundary changes on the house sites and
delineated the wetland line changes buffer zones and setbacks
It became apparent that several of the house sites had been
significantly changed One problem that was discussed at length
involved the CDurt ruling on Condition #24 which stated in part
of the Commission dispense with the need for such additional
submittals in the event the Plaintiff's final plans mirror those
filed herein " The original Order of Conditions had followed the
established format of the NACC in that it did not address in
detail every house presented in a large subdivision plan
Experience had shown that most houses were altered when
construction actually began so the Conditions would routinely
• address those sites by requiring a detailed filing at the time of
construction One issue before the NACC was that there were a
number of proposed houses within 5 and 15 feet of wetlands that
now were being allowed with no detailed plans for protecting the
wetlands
The NACC highlighted the sites that were within 15 feet of
wetlands Several of these sites were within 5 feet of wetlands
None of the Commissioners' experience indicated any cases of
successful construction this close to a wetland without some
damage having been done The plans as presented provided no
protection other than a row of haybales The NACC decided to
divide the problem house locations into 5 10 and 15 foot
categories and give some reasons why these areas were not
satisfactorily protected by the plans as presented Wording of
some revised Conditions was worked out to try and address this
problem area
There were also discussions on the use of the wetlands for a
detention area and on the direct introduction of roadway runoff
into these wetlands The NACC still had concerns regarding the
lack of a detention pond upgradient of wetlands
The NACC worked out the wording of modified Conditions to reflect
the concern that had been raised The revised roadway crossings
were found to be satisfactory
