HomeMy WebLinkAbout1990-10-24 Conservation Commission Minutes NACC Minutes of October 24 1990 Meeting • Present Paul Tariot Richard Doucette Admin Carl Schoene Alison Brewster (9 30 pm) George Reich LOT E BERRY STPEET (#242-443) DISCUSSION Update on sta-us of Superceding Order DEP has requested a flagging of the wetland line A subsequent site visit will be made LOTS 28 & 29 VEST WAY (#242-529) DECISION ON APPEAL The NACC denia. of the above project was upheld by the DEP The Applicant has since received a variance from the Board of Health to move the SSDS within 75 ' of the wetland Based on this variance the applicant refiled with the NACC The NACC expressed concern regarding variances from Board of Health 100 foot setback requirement MAZURENKO FARM PLAN, DRAFT 2 DISCUSSION The Administrator provided an overview of Draft 2 Discussion focused on Agricultural land use and rules/regulations • *** Alison Brewster arrived Quorum Now Present *** LOT 10 CHRISTIAN WAY (#242-391I CERTIFICATE OF COMPLIANCE George Reich motioned to grant a Partial Certificate of Compliance for Lot 10 Christian Way Alison Brewster seconded motion carried LOT 7 NORTH CRCSS (#242-488) _REQUEST FOR PARTIAL COMPLIANCE Mr Favorat (owner of Lot 8) and Attorney have concerns regarding flooding allegedly caused by Lot 7 No Compliance for Lot 7 will be granted until the flooding problem has been solved Owner of Lot 7 did not attend meeting LOT 29A LACONIA CIRCLE (#242-2571 REQUEST FOR PARTIAL COMPLIANCE Alison Brewster motioned to grant a Partial Certificate of Compliance on Lot 29A Laconia Circle George Reich seconded motion granted LOT 41 CANDLESTICK ROAD (#242-506) REQUEST FOR MODIFICATION George Reich motioned to accept a modification to allow a stump dump and soil stockpile area and move haybale line as • shown on the plans Alison Brewster seconded motion carried • LOT 8 MILL ROAD (#242-368) REQUEST FOR COMPLIANCE Tabled NACC to make a site visit CHESTNUT GREEN (#242-243) REQUEST FOR EXTENSION George Reich motioned an extension of one year (Nov 8, 1991) was granted as well as a partial bond release of $3, 000 leaving a balance of $2 000 A Brewster seconded, motion carried ABBOTT VILLAGE (#242-443) DISCUSSION Ben Osgood Jr and Sr appeared to discuss the recent modified Order to settle the above litigation The following conditions of the Order were discussed #23 Should apply to all level surfaces of the ROW #26 Applicant should be involved in any discussions with the the Planning Board #60 Bond amounts and bonding procedure Also Osgood to recommend bonding policy to NACC Osgoods will send letter RE procedure for disposition of adjudicatory proceedings and all litigation to Special Counsel RPD will call Special Counsel regarding settlement • procedure SPECIAL TOWN MEETING The NACC will submit an article to appropriate funds to pay special legal services for FY 90 in the above matter ENFORCEMENT ORDERS ISSUED George Reich motioned to issue an Enforcement Order to Mr Utano #407 Bear Hill Alison Brewster seconded, motion carried George Reich motioned to issue an Enforcement Order to Mr Butterfield, #224 French Farm Alison Brewster seconded, motion carried Paul Tariot motioned to issue an Enforcement Order to Mr Olenio, #292 Salem Street, Alison Brewster seconded, motion carried George Reich abstained MAZURENKO FARM CONSERVATION AREA - GUARDRAIL CONTRACT George Reich motioned to install a guardrail at the Mazurenko site Alison Brewster seconded, motion carried Vote three to one P Tariot opposed George Reich motioned to grant the contract to Methuen Fence Co and to pay for this contract with $2100 00 from Conservation Fund Alison Brewster seconded, motion carried O George Reich motioned to accept past Minutes of September 19th and October 3rd.
