HomeMy WebLinkAbout1990-11-07 Conservation Commission Minutes NACC Minutes of November 7, 1990 • Present George Reich Robert Mansour 7 30 Don Stanley Alison Brewster 8 00 Carl Schoene Richard Doucette, Admin Paul Tariot Chair George Reich motioned to accept the Minutes of October 24, 1990 and Don Stanley seconded motion carried LOT 7 NORTH CROSS (#242-488) REQUEST FOR PARTIAL COMPLIANCE Discussion of flooding on Lot 8 Owner of Lot 8 wishes the NACC to withhold Certificate of Compliance for Lot 7 until flooding problem is resolved A site visit will be made by the Administrator and homeowners which will be discussed at the next meeting of November 21, 1990 LOT 13 WINTERGREEN DRIVE (#242-438) EXTENSION The grading at the rear of the house needs time to see if slope stabilization is permanent George Reich motioned to grant an extension of six months to the Order of Conditions for Lot 13 Wintergreen Drive Carl Schoene seconded motion carried Robert Mansour abstained • LOT 20 SANDRA LANE (#242-83) CERTIFICATE OF COMPLIANCE Don Stanley motioned to grant a Partial Certificate of Compliance for the portion of former Lot 20 now included in Lot 1 as shown on Plan #9999 (Request for Determination) drawn by Robert G Goodwin 3/12/85 Carl Schoene seconded, motion carried George Reich abstained and Robert Mansour opposed LOT 3 & 5 SOUTH' BRADFORD STREET (#242-519) MODIFICATION Modification request for various changes The include a new retaining wall and relocation at compensatory flood storage House is improperly located Robert Mansour motioned to issue an Enforcement Orc.er to stop all work and determine the full extent of deviations from approved plans Carl Schoene seconded motion carried Alison Brewster abstained LOTS 6B, 9A, 10A AND 11A BOXFORD STREET PUBLIC HEARING - NOTICE OF INTENT Robert Higgins of Marchionda Associates and Dave Kindred the builder attended meeting Discussion regarding minimizing grading immediately adjacent to wetlands Discussion regarding 75- CBA Abutters Mr Tandy spoke on location of driveways and safety Applicant is to redraw Lots 9 and 10 grading to minimize work near wetlands George Reich motioned to continue the public hearing to November 21st Alison Brewster seconded motion • carried LOT 3A WILLOW STREET SOUTH (#242-538) PUBLIC HEARING - NOTICE OF INTENT Thomas Neve represented the applicant Bayfield Development Company They plan a 30 500 sq ft building in the North Andover Business Park Wetland delineation is in question Quadrats are being prepared by the wetland consultant Applicant needs a decision soon since winter weather will make it impossible to construct a masonry building Roadway to be built along with the building Permanent sedimentation basins needed at out flow of all storm drains Grading shown within five feet of current wetland line George Reich motioned to continue the public hearing to November 21st - Don Stanley seconded motion carried TEOMA ESTATES (#242-269) REQUEST FOR COMPLIANCE Flood storage information is needed before the compliance can be granted HILLSIDE ROAD (#242-249) EXTENSION AND MODIFICATION Les Godin spoke on behalf of the applicant and requested an extension and modification Erosion Controls are in need of repair The performance bond must be reposted in a form that is in accordance with the previous extension permit (passbook or check) Don motioned to accept the plans showing wells as a modification The modification will be granted once the appropriate bond is accepted The motion was seconded by George Motion carried - Robert Mansour abstained Alison motioned to grant a six month extension to June 7 1991 George Reich seconded motion carried, Robert Mansour abstained WILLOW TREE MALL, (#242-277) DISCUSSION OF FLOODING An overview was provided by Richard Doucette Mr Kaitz will shoot elevations by December 5th to determine the low point in the drainage system Flooding is taking place at McLay's Florist next door to Willow Tree Mall DEERFIELD LANE (#242-348) DISCUSSION OF FLOODING Flooding took place over Johnson Street Abutters Mr & Mrs Lincoln expressed concern of building in the flood zone Phil Christiansen and Dave Zaloga spoke regarding building in the flood plain Richard Doucette will review the file LOT 64A HAYMEADOW ROAD (#242-536) DECISION A denial was drafted Carl Schoene motioned to accept the decision and Alison Brewster seconded Five to One in favor Don Stanley opposed LOT E BERRY STREET (#2.42::534 UPDATE Richard informed Commission that he has flagged the wetlands to speed up the issuance of a supersceding order.
