HomeMy WebLinkAbout1990-12-05 Conservation Commission Minutes Minutes of Dec 5 1990 NACC Meeting Present Paul Tariot Chair Carl Schoene Alison Brewster, Vice-Chair Donald Stanley Robert Mansour Richard Doucette Admin LOT 3 SHARPNER'S POND ROAD (#242-340) REQUEST FOR CERTIFICATE OF COMPLIANCE Mr Barry Eisenberg, the owner attended the meeting The house and landscaping have been completed for many months Alison Brewster motioned to grant the Certificate of Compliance on Lot 3 Sharpner's Pord Road, Carl Schoene seconded motion carried Robert Mansour abstained LOT 7 NORTH CROSS ROAD (#242-488) REQUEST FOR CERTIFICATE OF COMPLIANCE Mark Catalagno the owner and Patrick Murphy the builder attended the meeting The house and grading have been complete for many months There seems to be a flooding problem on the ad3acent lot but this does not seem to be caused by work on Lot 7 Alison Brewster motioned to grant a Partial Certificate of Compliance on Lot 7 North Cross Road Carl Schoene seconded motion carried Robert Mansour abstained LOT 24 CANDLESTICK ROAD (#242-453) REQUEST FOR EXTENSION Ken DiRaphael the owner attended the meeting The house and • grading will be complete by Spring Alison Brewster motioned to extend the Order of Conditions for one year until February 10 1992 Motion carried BROOKS SCHOOL ATHLETIC FIELDS (#242-510 REQUEST FOR CERTIFICATE OF COMPLIANCE Ellen Hubschmidt of Carol Johnson Assoc attended the meeting The work is complete and stable Alison Brewster motioned to grant a Certificate of Compliance on Brooks School Athletic Fields Robert Mansour seconded motion carried _LOT 30 VEST WAI (#242-530) REQUEST FOR CERTIFICATE OF COMPLIANCE Al Shaboo of Design Engineering attended the meeting and said the Lot is not completely stabilized due to thin grass Robert Mansour motioned to send letter to Bank as opposed to issuing a Certificate of Compliance Alison Brewster seconded motion carried LOTS 6 & 11 CHRISTIAN WAY (#242-391) EXPIRED ORDER OF CONDITIONS Al Shaboo of Design Engineering updated the Commission as to what is going on with each lot Lot 6 has a foundation and SSDS installed Lot 11 has no work yet Alison Brewster motioned • to allow all work to continue on Lot 6 and all work outside the buffer zone on Lot 11 under an Enforcement Order A new Request for Determination will be filed for work on Lot it within the buffer zone Robert Mansour seconded motion carried LOT 4A BOXFORD STREET (#242-418 REQUEST FOR CERTIFICATE OF COMPLIANCE The house and grading are complete Don Stanley motion to grant a Certificate of Compliance on Lot 4A Boxford Street Alison Brewster seconded motion carried BUTTERFIELD AND UTANO LETTERS Discussion of Unanswered Enforcement Orders Letters were issue to both WILLOW TREE MALL (#242-277) MCLAY'S FLOODING PROBLEM Steve Stapinski Richard Kaitz, Frank Terranova, Joe Cushing and Jack McLay attended the meeting A discussion of flooding of the Mclay property from Willow Tree Mall The drainage system was not constructed as designed/approved Joe Cushing representing McLays will look over the plans The involved parties will continue to trI and work out a mutually agreeable solution LOT 4 TURNPIKE STREET (ROUTE 114) NOTICE OF INTENT - PUBLIC HEARING Mr Ed Plugis the owner attended the meeting explaining that he had not received a legal notice so no certified mailings had been sent to abuttors The rear of a dwelling was filled to create a backyard The fill is within the buffer zone and there was no fling until an Enforcement Order was issued The wetlands are within 30 feet of fill material Alison Brewster motioned to continue the public hearing to December 19 1990 Carl Schoene seconded, moticn carried BOAT RAMP NOTICE OF INTENT - PUBLIC HEARING Richard Doucette gave an overview and history of the Boat Ramp Three issues were 1 Emergency Access 2 Neighborhood concerns and 3 Recreational users Mark Gross of Kimball Chase gave a description of the project To be built mostly on existing grade The resource areas are floodplain bank and land under water No replication of bank is needed Rip rap size must withstand maxirrum flow Mrs Blanchett questioned fencing gates and picnic tables Tom Lane, Citizen reporter questioned wildlife habitat and Joe Cushing stated that the rip rap should withstand a certain storm event Don Stanley motioned to close the public hearing, Alison Brewster seconded motion carried LOT 3 JOHNNYCAKE STREET (#242-115) REQUESTED A PARTIAL COMPLIANCE Tom Neve of Neve Associates brought the Commission up-to-date on revegetation of the filled area Alison Brewster motioned that a Partial Certificate of Compliance be granted upon the receipt of . a Certified Check in the amount of $500 for the purpose of stabilizing vegetation Robert Mansour seconded motion carried Don Stanley opposed. LOT 6B. 9A, 10A AND 11A BOXFORD STREET 212_r 3"7 DECISION Alison Brewster motioned to accept the Decision as m dified can the above lots, Don Stanley seconded, motion carried. LOT 28 VEST WAS* ( 242- 39) DISCUSSION OF DECISION A discussion took place as to whether this should be a denial or approval with no/cut zone. Decision will be discuss d on Dec. 19 , 1990. ABBOTT VILLAGE DISCUSSION OF BONDING AGREEMENT Alison Brewster motioned to approve the use of a tri-party agreement like that in use by the Planning Board, Richard Doucette reported that such an agreement was acceptable to the Planning Department according to :wren Nelson, Director of Community Development. Carl Schoene seconded, motion carried, 4-1 Paul Tariot opposed.. Don Stanley motioned to adjourn 10: 55 p.m. Paul L. Tariot, Chairman
