Lot 39 (House 4349) Appleton Street (#242-2361
Request for Compliance
Leeann Cristalti the owner attended the meeting This property's
title is clouted by the Order of Conditions which covers the
Pines subdivis_on There are no wetlands within 100 feet of the
property Alison Brewster motioned to grant a Certificate of
Compliance for Lot 39 Appleton Street George Reich seconded
motion carried
Lots 1 & 2 Hillside Road (#242-249)
Discussion
Michael DiBitetto attended the meeting Previously the
Commission had requested this bond to be a passbook form and it
came in as an Insurance Bond The applicant prefers an insurance
bond The passbook will still be required
House #149 CotLit Street (#242-495)
Request for Certificate of Compliance
Mr Mabin the owner, wishes a Certificate without presenting a
topographic (as-built) plan since the project was minor of minor
consequence George Reich motioned to waive Condition #36
Alison Brewster seconded motion carried George Reich motioned
to grant the Ccmpliance, Don Stanley seconded motion carried
#224 French Farm Road
Violation
The owner Mr Bruce Butterfield, attended the meeting Fill
material was placed in the rear of this house within 100 foot of
a wetland in tre watershed Some fill is on Conservation land
Erosion is also evident Richard Doucette requested that Mr
Butterfield install erosion control at toe of slope and locate
boundry on right side to see if any fill remains on town land
No motion made
#407 Bear Hill Road - Violation
Large mounds of fill exist in the backyard at this address
There has been siltation of wetlands in the watershed
for many months There have been many letters and conversations
with the owner on this violation There has been no action to
install erosion controls Alison Brewster motioned to initiate
criminal proceedings against Mr Utano the owner of 407 Bear Hill
Road, George Reich seconded motion carried
• Lot 41 Jerad Place (#242-506)
Modification
Tom Neve of Neve Associates attended the meeting. The house was
placed 43 feet from wetland instead of the 50 feet as was
required by the Order of Conditions. The house was moved a
couple of feet from the lot line to ensure that zoning setback
was not violated. This pushed the house toward the wetland.
Alison Brewster motioned that this was an insignificant change,
Don Stanley seconded,motion carried. George Reich abstained.
George Reich motioned to increase the bond by $1, 000. This was
defeated 4-1.
Lot 4 Turnpike Street (#242-541)
Continued Public Hearing
Mr. Plugis the owner of Lot 4 Turnpike Street attended the
meeting. The -meeting had been continued because no notification
to the abutters had been sent out. Alison Brewster motioned to
close the public hearing and issue an Order of Conditions within
21 days after receipt of file number. Don Stanley seconded,
motion carried.
Lots 1, 2 & 3 Scotts Circle (#242-542)
Notice of Intent - Public Hearing
Tom Neve of Neve Associates attended the meeting. This is a 3
lot subdivision near an isolated wetland that may or may not be
jurisdictional. Richard to look further into this matter of
Isolated Lands Subject to Flooding. George Reich motioned to
continue the public hearing until January 9 , 1991, Alison
Brewster seconded, motion carried. 4-1 Carl abstained.
Salem Street
Discussion
Logging between Salem Street and Boston Brook may be altering
land in the buffer zone. The Administrator will investigate the
matter.
Lot 28 Vest way (#242-539)
Decision
Alison Brewster motioned to issue an Order of Conditions on Lot
28 Vest Way, George Reich seconded, motion carried.
North Andover Boat Ramp (#242-540)
Decision
The boat ramp decision was discussed. George Reich motioned to
install two trailer spaces, Paul Tariot seconded, vote 2-3
motion failed. George and Don voted in favor. Alison Brewster
motioned to accept the Order of Conditions for the North Andover
Boat Ramp and issue it upon receipt of a file number. Don
Stanley seconded, motion carried.
George Reich motioned to adjourn at 10: 30 P.M. Don Stanley
