Modification Joe Cushing represented the applicant seeking a modification to allow an add-tional 10, 000 s f of building area and the relocation of the detention basin The Commission expressed concerns regarding how much rainfall will cause the drywells to surcharge • Upon motion by P Tariot and second by R Milliard the Commission unanimously voted to adopt the 1/8/92 plans as a modification Lots 4 , 5, 7 Sharpeners Pond Rd /Salem St (242-281) - Discussion R Doucette gave an overview Mr Farr is pursuing a compliance NEW BUSINESS Great Pond Estates (NACC #3) - Modification Motion by P Tariot and second by R Milliard to accept the modification for change in condition #36 to substitute "hydrocarbons" for "fluorocarbons" PUBLIC HEARINGS Lot 20A Candlestick Road - Determination Bob Janusz represented himself as the applicant The lot contains a low wet area that holds some flood water Calculations show this area to hold 0 04 acre/feet This is much less than the 0 25 acre/feet and thus is not a wetland as defined by the Act C Schoene motioned to issue a Negative Determination and P Tariot seconded Motioned passed unanimously • NACC 1/8/92 • Page 2 Lot 10 (#75) Johnson Circle - Determination The builder Bob Stanley would like to add a garage to an existing house R Doucette has determined that the house is within the 130 ' non-disturbance zone of a wetland in the watershed TY-e pro3ect thus requires a Special Permit from the Planning Board and perhaps a variance from the ZBA The applicant should decrease the filling in the in the front yard and consider down-sizing or relocating the addition A Notice of Intent may be needed Upon motion by P Tariot and second by R Milliard the Commission voted to continue to 1/22/92 Lot 1 Old Village Lane - Determination (Continued) Ben Osgood Jr and Ben Osgood Sr represented themselves Mr Osgood Jr stated the area is isolated Comments from C Schoene and A Manzi regarding the presence of outlets and inlets A Manzi asked if he would move the house closer to the street Mr Osgood responded it would be less desirable R Doucette stated that the area in question is a wetland since it contains greater than 50- wetlands vegetation and borders on an intermittent stream The stream is defined by a channel and the channel need not have wetland vegetation to be a stream • Motion by C Schoene and second by R Milliard to issue a Positive Determination P Tariot abstained Campbell Forest - Notice (Continued) Dave Jordan represented the applicant The roadway and crossing s have been staked as requested A new 100 scale plan, showing all wetlands and roadways has been submitted as requested A wildlife habitat evaluation is not required if the NACC determines that the roadways are limited pro]ects The applicant does not propose the standard double layer erosion control barrier only Dne No response yet to the Appendix A A P R D development was considered and re3ected by the applicant Open space will consist of 14 8 acres or 20-6 of the site when built out At the request of the Conservation Administrator the applicant will pursue the possibility of a road to Salem St thus eliminating one roadway crossing P Tariot questioned the wetland connection on lot 10 D Jordan stated it is szown on detail sheet C Schoene suggested looking at previous information gathered by independent consultants He also stated concerns re drainage A Manzi questioned the impacts on wildlife habitat He also suggested the common drive crossing could be made unnecessary by • a drive off Campbell Road D Jordan stated there would be too much impact to wetlands for that driveway off Campbell Rd NACC 1/8/92 • Page 3 R Doucette stated that the common drive crossing could be denied It may not mee: the criteria for a limited crossing Comments from abutters Richard Roen expressed his concerns re the driveway crossing Arthur Fundeklian stated a stream is not shown on the plan Ms Lilian expressed concern for roadway and impacts on wells Roen - New road to Salem St Mike Goodwin - Concerns re pollution attenuation Upon motion by P Tariot and second by A Manzi the Commission voted to continue to 2/5/92 Lot 16A Hickory Hill Road - Notice Tom Zahoruiko appeared and seeks a permit to build a single- family home The house is approximately 50-60 ' from the wetland P Tariot motioned to close and issue a decision within 21 days second by A Manzi Motion passed unanimously Lot 1 Forest Street - Notice Paul Marchionda represent the applicant The pro]ect is a • single-family tome in the buffer zone with some alteration of the floodplain This alteration will be a removal of trees and the placement of a lawn and a small portion of the driveway Pat Chiumiento an abutter expressed her concern of flooding and water quality Much discussion about 75- CBA The lot appears to need a variance and since this has not been applied for the Notice is not Complete P Tariot motioned to continue to 1/22/92 second by R Milliard Motion passed four (4) in favor one (1) opposed, George Reich Lot 2AA (#67) Tucker Farm Road - Notice Mr Devito appeared He would like to fill in the buffer zone for his back yard R Doucette gave an overview of the lot's permitting history P Tariot stated the work is within 10' of the wetland it's too close A Manzi would like a 25' no disturbance zone Upon motion by P Tariot and second by R Milliard the Commission voted unanimously to close and issue a decision within 21 days Lots 1 & 2 Lacy Street The requests of the Commission made at the close of the hearing on 12/18 have not been met, therefore a decision cannot be issued The applicant has failed to properly install erosion • control on site NACC 1/8/92 Page 4 North Andover Wetlands Requlations R. Doucette gave an overview of the ongoing re-write and input received on the new regulations. Upon motion by R.Milliard and second by A.Manzi the Commission voted unanimously to adjourn at 11: 00 p.m. George Reich, Chairman NA6C
