HomeMy WebLinkAbout1992-01-22 Conservation Commission Minutes M NACC MINUTES JANUARY 22 1992 PRESENT George Reich Chairman Richard Doucette Admin Aliscn Brewster, V-Chair Karen Nelson, Director Carl Schoene Richard Milliard Al Manzi MINUTES G Reich motioned to approve 1/8/92 minutes second by C Schoene Vote was unanimous OLD BUSINESS Lot 28 Tanglewood Lane (242-265) - Compliance A Partial Compliance requested by Mr McCann and Mr Evangelista R Doucette gave an overview of the issue There has been filling of wetlands outside the headwalls An additional 1574 s f of wetlands seem to have been altered Therefore this lot is not in compliance R Doucette will contact Grasso Construction to • replicate filled wetlands Motion by A Brewster and seconded by C Schoene to deny the request, passed Three in favor and one opposed (R Milliard) Christian Way Extension (242-452) - Extension Atty Gary Sackrider represented the owner requesting an extension of an Order of Conditions Motion to grant the extension for one year, by R Milliard and seconded by A Brewster Motion passed unanimously Lots 3_, 5 & 7 Holly Ridge (242-348) - Modifications Pat Murphy requesting these a modification in order to build a deck on each house Also the house on Lot 3 is different the driveway enters the house on the right as opposed to the left A Brewster motioned to modify Lots 3 5 & 7 R Milliard seconded Motion passed 4-1 A Brewster opposed Lot 2 South Cross Road (242-494) - Modification & Compliance Pat Murphy requesting Modification to allow construction of a deck and a Partial Compliance R Milliard motioned to issue Modification to allow deck and a Partial Compliance A Manzi seconded motion passed unanimously Lot 1 South Cross Road (242-494) - Partial Compliance Pat Murphy requesting a Partial Compliance on the above property R Milliard motioned to grant a Partial Compliance A Manzi seconded motion passed unanimously NACC 1/22/92 Page 2 Great Pond Estates (Nacc-#3) - Decision Bruce Waite and R Doucette discussed inaccuracies in the Order of Conditions R Doucette recommended that the Commission re-issue the decision to correct the inaccuracies Motion by A Brewster and second by R Milliard to re-issue the decision Lot 10 (#75) Johnson Circle - Determination (Continued) Mr Zimmerman and Bob Stanley showed revised plans The wetlands may be larger than are shown on the plan The work is between 2 ' and 25' from the BVW depending on the exact delineation Motion to close and issue decision at a site visit on 1/25/92 Stiles Street Tree Planting - Determination Gene Willis has planted black walnut trees Motion by R Milliard and second by C Schoene to issue a negative determination due to the presence of an ongoing agricultural operation Motion passed unanimously Lot A (#183) Cotuit Street - Determination D Mannarino wants to build a deck in the buffer zone Abutter Mr Harrington stated he is in favor of the pro3ect A Brewster motioned to issue a Negative Determination with erosion control to be determined in the field by the administrator Second by A Manzi motioned passed unanimously Lot 3 (#240) Marbleridge Street - Notice (Continued) Mr Cavallaro appeared and R Doucette gave a list of options for the Commission to consider The options included flood monitoring placing a baffle on the culvert under Salem St or issuing a denial Mr Fugere discussed his flooding problem More discussions of potential flooding took place Motion by R Milliard and second by A Brewster to close the public hearing and issue a decision within 21 days Motion passed 4-0-1 G Reich abstained Lot 1 Forest Street (242-566) - Notice (Continued) Dave Kindred the owner appeared Discussion of contiguous buildable area Motion to close and issue a decision within 21 days Lot lA (#825) Winter Street - Notice Richard Aversa the owner appeared He would like to loam and seed the slope to the right side of the driveway There was discussion of the acceptability of the plan R Milliard motioned to close A Manzi seconded Motioned passed 4-1, A Brewster opposed Lot 9 Coventry Estates (242-324) - Partial Compliance Atty Xenakis requested a Partial Compliance R Doucette provided an overview The lot is outside the buffer zone NACC 1/22/92 Page 3 A.Brewster motioned to grant the Partial Compliance, R.Milliard seconded. The motion passed unanimously. Butcher Boy Pump Station (242-473) - Partial Compliance No show, no action. Campbell Forest Discussion of limited project crossings and also discussion of an independent consultant. A. Brewster motioned to award the contract to review the hydrologic analysis to Daylor Consulting Group for $1, 500. 00 or less. $1000. 00 will be paid from the Consulting Services line item and the remainder will come from the Wetland Filing Fees Acct. R.Milliard seconded, the motion passed unanimously. Utano Violation R.Doucette gave an up-date on the Utano violation. Warrant Article Policy Discussion of a new policy from the Town Manager. Wetlands Regulations Discussion of the proposed wetlands regulations also took place. DECISIONS _ Lot 2AA Tucker Farm Road Motion by A. Brewster to approve, second by A.Manzi. Unanimous vote. Lot 1 Forest Street Motion by R.Milliard to approve, second by A.Manzi. Unanimous vote. Lots 1&2 Lacy Street Motion by A. Brewster, second by R.Milliard to approve. Unanimous vote.
