HomeMy WebLinkAbout1992-02-05 Conservation Commission Minutes NACC FEBRUARY 5 1992 PRESENT Georce Reich Chairman Paul Tariot Robert Mansour Carl Schoene Richard Milliard Al Manzi Richard Doucette Karen Nelson MINUTES Motion by P Tariot and second by R Mansour to adopt minutes of 1/22/92 Motion passed OLD BUSINESS None NEW BUSINESS Butcher Boy Pump Station (242-473) - Partial Bond Release Mr Yameen appeared and requested a partial bond release Motion by R Mansour and second by P Tariot to grant a partial bond release and to retain $10 000 Lots 1,2 , 3 Whirpoorwhill Park (242-542) - Extension Cheryl Dickerscn appeared to request an extension since the Order of Conditions has expired under the Bylaw Motion by P Tariot and second by R Mansour to grant the extension contingent upon receipt of proof of recording of Order of Conditions Motion passed #30 Anne Road (242-553) - Modification Scott Giles requesting a modification The house has been moved The new house is over 30' from the bordering vegetated wetland The Order of Conditions has not been recorded Motion by P Tariot and second by R Milliard to accept 1/19/92 plan as a modification A plan must be submitted just showing just the new building and removing the old wetland line Lot 10 Hidden Court (242-560) - Modification Scott Giles represented the builder and would like to change the shape of the louse and location of the driveway Motion by R Milliard and second by A Manzi to adopt the modification Motion passed 6-1-0 P Tariot against NACC 2/5/92 • Page 2 PUBLIC HEARINGS North Andover Wetlands Regulations P Tariot discussed fees Motion by P Tariot and second by C Schoene to continue to 2/19/92 Motion passed Campbell Forest - Notice (Continued) Dave Jordan discussed roadway waiver request submitted to the Planning Board and will revise plans showing the roadway moved approximately 7 ' away from the wetlands near Campbell Rd RPD once again expressed concerns of stormwater impacts Dr Robert Ingram of Daylor Consulting Group responded to questions from the Commission Dr Ingram agreed that pollution attenuation was not acheived without some stormwater detention/retention There was some lengthy discussion as to the appropriate curve numbers to use in the hydrologic analysis One inaccuracy was discovered in the analysis a curve number (CN) of 77 was used for Meyer pond and it should have been 98 Also the 77 CN chosen for all wetlands could have been higher depending • on how wet the wetland is The applicant chose 77 CN for all wetlands regardless of site conditions Dr Ingram also stated that the replacement of the culvert under Campbell Rd will alter the hydrology of the Bordering Vegetated Wetlands and perhaps "drain" the upper limits of this BVW which is fed by the frequent floods R Doucette stated that the common driveway crossing and perhaps the single driveway crossing, do not meet the criteria for limited crossings The Commission has not approved discretionary wetland crossings in the past and would not likely approve them here Two abutters spoke and expressed concerns regarding flooding wetland alterations, soil conditions and wetland replication success Paul Tariot moved and Richard Milliard seconded a motion to continue to March 4 1992 Dr Ingram will visit the site prior to the 4th Lot 1 Ironwood Estates (#585 Dale St ) - Notice Scott Giles represented applicant Plan shows a single family home The lot also includes the detention basin for the subdivision Motion by P Tariot and second by A Manzi to close Motion passed • NACC 2/5/92 Page 3 Lot 50 Blue Rid Road - Notice Vince Turano represented the applicant. Plans show a single family home in the buffer zone. Motion by R.Milliard and second by P.Tariot to close. Motion passed. Lot 12 Hidden Court - Notice Vince Turano represented the applicant. Plans show a single family home in the buffer zone. Motion by P.Tariot and second by R.Milliard to close. Motion passed. Lot 10 Johnson Circle - Notice Robert Stanley represented the owner. Plans show an addition to an existing structure and a slight reconfiguration of the driveway. This project is within the buffer zone of a tributary to Lake Cochichewick. There was discussion as to the acceptability of a plan stamped by a Mechanicl Engineer. Motion by C.Schoene and second by R.Milliard to close. DECISIONS Lot IA Winter Street Motion by R.Milliard and second by R.Mansour to adopt the decision as amended. Vote: 3-1-1, P.Tariot abstained and C.Schoene opposed. Lot 10 Johnson Circle Motion by R.Mansour and second by R.Milliard to issue the decision. Motion passed 6-1, P.Tariot opposed.
