HomeMy WebLinkAbout1992-04-29 Conservation Commission Minutes NACC MINUTES APRIL 29 1992 PRESENT George Reich Al Manzi Carl Schoene Paul Tariot Richard Milliard Robert Mansour MINUTES Upon motion by G Reich and seconded by P Tariot the Commission voted to approve the minutes of April 15, 1992 Forest Street - Decision No decision tonight since SSDS and common drive permits have not been submitted Clock has not started Campbell Forest (#242-564) - Decision Deliberation Lot 23A Forest Street (#242-555) - Modification Leonard Getty appeared requesting a modification for a retaining wall to be installed Motion by P Tariot and seconded by A Manzi to grant the modification Motion passed unanimously Lot 7A Candlestick Road (#242-574) - Compliance (continued) Tom Neve presented revised plan The pool and tennis court has been removed from the plan The wetlands were reflagged by R Doucette and the new wetland line is 30 ' closer to the house then the old wetland line Motion by P Tariot and seconded by R Milliard to close and issue a decision with in 21 days Motion passed unanimously R Mansour would like to get input from the Board of Health Lot 18A Candlestick Road (#242-575) - Notice (continued) A waiver from NACC 25 ' no disturbance zone has been requested due to new wetland lines flagged by R Doucette and agreed to by the applicant's consultant Motion by P Tariot and seconded by R Milliard to close and issue a decision with in 21 days Passed unanimously Lot 44 Candlestick Road (#242-577) - Notice (continued) Waiver also submitted The work is very close to the wetland A retaining was suggested for the back yard Wetland line was ref lagged and the wetland is closer to the house in one area Motion by P Tariot and seconded by A Manzi to close the public hearing and issue a decision within 21 days . NACC 4/29/92 Page 2 Lot 3A Covent Lane 242-583 - Notice continued Curt Young of Wetlands Preservation Inc represented the applicant and presented plans for a house in the buffer zone This lot has recently been reflagged The old wetland line was much further back from the road (JJB plan dated May 19 1989) Motion by R Milliard and seconded by A Manzi to close and issue a decision within 21 days Vote 5-0-1 P Tariot abstained North Andover Estates - Notice Tom Neve represented the applicant and described the 43 lot subdivision Wetland alterations and erosion control presented Building on steep slopes discussed The Commission questioned drainage erosion controls wetlands replacement and drainage calculations R Doucette expressed concerns about the viability of the wetland replication areas They should be located further downslope One area of wetland filling (Area #1) could be avoided by 1 1 rip-rap slopes Abutter Mr Lincoln has concerns about flooding Mr Cronin also spoke about a number of issues The owner John Nolan responded to some issues Motion by P Tariot and seconded by R Milliard to continue the • public hearing to May 13 Vote 5-1 R Milliard opposed Dizzy Bridge Motion by R Mansour and seconded by P Tariot to ratify the Emergency Certification Passed unanimously Motion by P Tariot and seconded by R Mansour to issue an Enforcement Order Passed unanimously Conservation Fund Expenditure Motion by P Tariot and seconded by R Milliard to pay $30 50 for trail map Passed unanimously CONTINUED DISCUSSION Campbell Forest More deliberation Motion by G Reich and seconded by C Schoene to issue the decision within 21 days Vote 2-2-1 G Reich and C Schoene for P Tariot and R Milliard against and R Mansour abstained Motion by G Reich and seconded by P Tariot to reconsider Vote 5-0 Motion by G Reich and seconded by C Schoene to issue an Order of Conditions as amended Vote 2-3-0 G Reich and C Schoene for R Milliard P Tariot and R Mansour against Motion by P Tariot to insert the following to the draft decision "the Commission is not persuaded by the applicants storm water management plan as it affects an already over-burdened drainage area The NACC requires the applicant to submit a revised storm NACC 4/29/92 Page 3 water management to alleviate flooding concerns that will show no increase in post-development rate or volume of runoff.
