HomeMy WebLinkAbout1992-07-01 Conservation Commission Minutes 1 NACC MINUTES JULY 1 1992 PRESENT George Reich Paul Tariot Al Manzi Richard Milliard Robert Mansour Kevin Foley Karen Nelson Director Richard Doucette Admin WATERSHED VIOLATIONS #96 Castlemere The homeowner has not responded to the previously issued violation notice or enforcement order but may have removed the fill Motion by P Tariot and seconded by G Reich to file an application for criminal complaint after site visit by R Doucette Vote 2-1-3 Opposed G Reich Abstained B Mansour A Manzi K Foley #40 Coachmans sane A wetland violation consisting of landscaping debris being deposited in s wetland (in the watershed) was discovered after a complaint from a neighbor The Administrator will issue an • Enforcement Order if the letter is not answered 134 Coachmans Lane R Doucette presented information regarding an old Enforcement Order (1983) that was not complied with After a discussion with Town Counsel there appears to be no statute of limitations on such a violation Motion by P Tariot and seconded by R Milliard to issue a new Enforcement Order Vote 5-0-1 K Foley abstained #407 Bear Hill Road The bank has sold the former Utano lot to the Hayes R Doucette gave an overview of the new owners plans to stabilize existing problems caused by the prior owner (Mr Utano) The criminal proceedings against Mr Utano are continuing Motion by P Tariot and seconded to issue a new Enforcement Order to the Hayes to allow the yard to be landscaped and sedimentation removed from the wetland Discussion of settling with Mr Utano Motion by P Tariot and seconded by R Mansour to authorize R Doucette to settle for $3 500 (plus or minus) 10- to restore the pond on the Rand property NACC 7/1/92 Page 2 Town Forest George Perna and Bill McEvoy presented a plan to construct a baseball field at the Town Forest and discussed the need for more fields in general The layout of the field was discussed and the need to delineate a parking area The proposed parking area may be too close to wetlands R Doucette will work with B McEvoy and G Perna on siting the parking area There was discussion of the use of conservation land and the NACC's role in managing conservation land G Perna stated that there had beer some discussion as to who had 3urisdiction over Town Forest G Reich has spoken to Selectmen Crouch regarding this matter and he has stated that the Conservation Commission still manages conservation land including Town Forest G Reich would like to clarify this with all parties involved B Mansour had questions regarding adequate communication between the DPW and the Conservation Commission In the future all communication should go through B McEvoy and G Perna The need for a management plan to properly manage the natural and recreational resources of the Town Forest was also discussed R Doucette is now putting together the Open Space Advisory Committee to rewrite the Town's Open Space Plan and can work with • this Committee to write the Town Forest Management Plan as well The plan can be developed simultaneously with the development of the plan Upon a motion by P Tariot and a second by A Manzi the Commission voted unanimously to support the siting of a field at the Town Fores: pending R Doucette's input in the final plan Lots 1 & 2 Lacy Street (#242-562) - Compliance Scott Follansbee represented himself requesting a compliance Motion by P Tariot and seconded by R Milliard to issue a Certificate of Compliance Shannon Lane ( 9242-279) - Extension Dave Zaloga appeared requesting an extension Motion by P Tariot and seconded by A Manzi to issue an extension for one year upon receipt of a $2000 bond Motion by P Taxiot and seconded by R Mansour to release old bond which is a cer:ified check Lot 3 Summer Street - Determination Al Shaboo presented plans for a single family home Motion by P Tariot and seconded by A Manzi to issue a Negative Determination with erosion controls Vote 5-0-1 K Foley abstained Borden Company - Determination Discussion of addition and increased parking • Motion by P Tariot and seconded by A Manzi to issue a Negative Determination NACC 7/l/92 Page 3 #1750 Great Pond Road - Determination Mike Rullo appeared and presented plans for a single family home and driveway. There is great concern about construction of the driveway on steep slopes and erosion potential. Abutter John Thompson had concerns of a drainage problem and John Desmond with steepness of the driveway. Motion by P.Tariot and seconded by R.Milliard to issue a Positive Determination. Vote 5-0-1, K. Foley abstained. A NOI is to be filed. Wagon Wheel Estates - Notice Steve Stapinski presented plans for a residential subdivision. Small amount of wetland filling for roadway. Discussion of 251/501 zones and stormwater management. Old wetland flags have been re-established by survey. Discussion of wetland replication area. Abutter Jean Avel asked about wetlands on her property. Paul Moss also had concerns. Gail Wolford would like to have a lower wall . Motion by P.Taxiot and seconded by R.Milliard to continue the public hearing to August 5, 1992 . Applicant should meet with staff to revise the plan to show less wetland filling and more distance from the drainage outlet to the wetland. Also, the pavement width reduction can also be requested by the applicant. Lyons Way Decision The court has ruled in favor of TDJ. The Commission voted to appeal the court's decision and to petition the Selectmen to contact the firm of Pickett & Miyares for the appeal . B & M Railroad - Emergency Repair R.Doucette gave an overview of a collapsed culvert and a serious erosion problen on the Amtrak line near Borden Co. Motion by R.Milliard and seconded by P.Tariot to ratify the Emergency Certification. Certification should also state that a Notice of Intent should be filed by October 1 for the permanent repair. Crusader Paper Motion by P.Tariot and seconded by K. Foley to issue the decision after DEP issues a file number. Motion by R.Milliard and seconded by R.Mansour to adjourn at 11: 00 P.M.
