Motion by P Tariot and seconded by R Milliard to adopt the
minutes of Jull 29 1992
Interns
R Doucette introduced Intern Bob Leyland to the Commission
#940 Great Pond Road - Violation in the watershed
Atty Morley represented Mr E1 Hefni Mr El Hefni wants access
through wetlands a sitting area next to the lake and a garden an
his property Motion by P Tariot and seconded by R Milliard to
issue an Enforcement Order to perform the following under the
supervision of a wetland consultant
-restore all wetlands under the supervision of a wetlands
consultant
® -replant shoreline buffer zone and wetlands
-restore stream channel Fill in new channel
Commencement of work must occur within 10 days
Motion by P Tariot and seconded by R Milliard to ratify the
previous Enforcement Order
Lot 3 Berry Street - Violation
R Doucette and P Tariot gave an overview Discussion of past
violations R Doucette will hire a wetlands consultant to flag
wetlands
Motion by P Tariot and seconded by A Brewster to ratify the
Enforcement Order
Water Treatment Plant - Compliance
Bob Nicetta represented this pro]ect Discussion of lake bottom
siltation Discussion of no-cut zone between the lake
Motion by R Milliard and seconded by P Tariot to issue a
compliance with reference to a vegetated buffer zone along the
lake shore
Lot 6 Bruin Hill - Determination
Mr Erickson presented plans for a single family home
Motion by A Brewster and seconded by R Milliard to issue a
negative determination with erosion controls
Lot 52 (#140) Marion Drive - Determination
Mr Tilley presented plans for an addition to replace a three
season porch Motion by P Tariot and seconded by K Foley to

issue a negative determination upon the receipt of a plan showing
the wetland line and the area to be filled in the buffer zone
Wagon Wheel Estates - Notice (continued)
Steve Stapinski of Merrimack Engineering presented plans showing
a revised wetlands line and a redesign of the roadway near the
wetland Presently there is no filling of the bordering
vegetated wetland for this roadway R Doucette stated that the
new wetlands line is higher in the area recently reflagged The
entire delineation should be considered suspect and should be
inspected fore building permits are issued
Motion by P Tariot and seconded by A Brewster to close the public
hearing and issue a decision within 21 days

Michael Rosati represented the owner and presented plans for a
single family home Motion by R Milliard and seconded by
A Brewster to close the public hearing and issue a decision
within 21 days The vote was 4-0-1 P Tariot abstained

Ellen Dushane presented plans to fill a depression in her
backyard R Doucette discussed the site and the possibility of
endangered species (salamanders) Motion by P Tariot and
seconded by R Milliard to issue a negative determination
Dale/Winter Street Farming - Notice
Ellen Sweeney presented plans for agricultural use of land The
Commission would like to do a site visit R Doucette discussed
the Agricultural Land Limited Pro]ect provision

Two representatives from Hancock Survey appeared before the
Commission Plot plans were submitted to confirm the wetlands
line Motion by A Brewster and seconded by R Milliard to close
the public hearings and issue a decision within 21 days of
receipt of plans Vote was 3-1-1 G Reich against and P Tariot
abstained

Discussion of drainage, erosion and potential damage to Lake
Cochichewick's water quality More plan revisions needed to
provide more detail

Mr Stahley appeared requesting a compliance Motion by K Foley
and seconded by A Brewster to issue a certificate of compliance

Motion by P Tariot and seconded by K Foley to open and discuss
all North Andover Estates issues concurrently
North Andover Estates Determination and Notice
Tom Neve presented plans for single family homes at N A Estates
Motion by P Tariot and seconded by R Milliard to issue a negative
determination with erosion controls as shown and 25/50 zones on
all lots everywhere Vote 4-1, G Reich opposed
All lots can meet 25/50 zones
Motion by P Tariot and seconded by A Brewster to close the public
hearing on lots 5, 6,7 8 and 9 and issue a decision within 21 days
from receipt of a revised plan
Modification request in Tom Neve's 8/4/92 letter
Motion by P Tariot and seconded by Kevin Foley to issue a
modification to Condition #29C
Clarification presented by Ernie Gralia and R Doucette
Motion by P Tariot and seconded by K Foley to issue a
modification to allow the movement of three wetland replacement
areas upon receipt of a revised plan
Motion by P Tariot and seconded by R Milliard to move Condition
#27 within the Order of Conditions
Motion by K Foley and seconded by R Milliard to change #29 (e)
Change "August" to "end of September" and change "construction"
to "brought to the condition of modified #29 (c) "
Motion by P Tariot and seconded by K Foley to accept proposed
bond breakdown

Tom Neve presented plans for a single family home Discussion of
SSDS in the buffer zone and the delineation
Motion b Milliard y R and seconded by A Brewster to continued to
August 19 Motion did not carry vote 2-3-0 A Brewster,

Motion by G Reich and seconded by K Foley to close the public
hearings and issue a decision within 21 days Vote 4-1 P Tariot
