MINUTES
Motion by P Tariot and seconded by K Foley to adopt the minutes
of August 5, 1992
OLD BUSINESS
Policy on use of Conservation Land
Discussion of conservation land and of holding a meeting with the
new DPW Director Town Manager and the Board of Selectmen
Lot 1 Forest Street (#242-566) - Compliance
David Kindred appeared to request a compliance for the above
property Motion by P Tariot and seconded by B Mansour to issue
a Certificate of Compliance
Newcastle Estates (#242-385) - Partial Bond Release
Curt Young representative of FCDC, discussed the seized
Newcastle bond and the bond requirements for the new Order of
Conditions Discussion of the disposition of seized bonds in
general
Motion by G Reich and second by P Tariot to take no action and to
send this matter to Town Counsel for a legal opinion
Lot 44 Stagecoach Road (#242-544) - Partial Bond Release
Mr DiMartino appeared to request a partial bond release
Motion by P ^ariot and seconded by K Foley to grant a partial
bond release The bond is $5 000 and will be reduced to $2 000
Lot 3 Berry Street - Violation
R Doucette gave an update Motion by P Tariot and seconded by
A Brewster to instruct the land owner to flag the wetland by
September 3 1992 and to appear before the Commission on
September 3 1992 Vote 5-0-1, R Milliard abstained
Lots 4 & 5 Turnpike (#242-541) - Compliance
Mark DeLisio appeared to request a Partial Compliance
R Doucette gave an overview
Motion by A Brewster and seconded by R Milliard to empower the
site visit team to issue a compliance and lift the Enforcement
Order for Lot 5 Turnpike
Lot 10 Chestnut Street - Decision
Motion by A Brewster and seconded by K Foley to issue a decision
0 pending receipt of a file number P Tariot abstained

Lot 5 Cranberr-y Lane - Decision
Motion by G Re_ch and seconded by R Milliard to close the public
hearing and issue the decision within 21 days Vote 5-0-1
P Tariot abstained
Lot 2 Lyons Way - Decision
Motion by A Brewster and seconded by P Tariot to continue to
9/3/92 An extension is needed

Motion by P Tariot and seconded by K Foley to continue to 9/3/92

Dale/Winter Farming - Notice
Motion by P Tariot and seconded by R Milliard to close the public
hearing and issue a decision within 21 days
Lot 6A Berry Street - Notice
Tom Neve submitted a revised plan dated 8/11/92
Motion by P Tariot and seconded by R Milliard to close the public
hearing and issue a decision within 21 days
PUBLIC HEARINGS
Lot 23 Pine Ridge Road - Notice
Tom Neve represented the land owner who proposes to build a
single family home in the buffer zone B Mansour stated there are
no erosion con-rols shown for sewer line P Tariot stated the
detention pond is shown on this lot There was discussion as to
the possibility of achieving a compliance for the Pines
Subdivision (#242-236) R Doucette discussed the 25/50 zones
Motion by P Tariot and seconded R Milliard to close the public
hearing and issue a decision within 21 days
Lot 1 Liberty Street - Notice
Mike Rosati presented plans for a retaining wall in the buffer
zone The wall is required as part of the lot's septic system
permit Discussion of the accuracy of the FEMA maps Abutter
Mr Rothstein had questions regarding the wall
Motion by P Tariot and seconded by R Mansour to close the public
hearings and issue a decision within 21 days
Use of Conservation Land for a Soccer Field
George Perna presented plans for a soccer field Any additional
work such as tie parking would not be done until the Management
Plan is done R Doucette stated that the Management Plan will be
completed by mad-winter P Tariot expressed concerns over the
work done by tY a DPW which was not approved by the NACC There
appears to be a lack of communication
Motion by P Tariot and seconded by R Milliard to endorse the
soccer field proposal

DECISIONS
Wagon Wheel Estates
Motion by A.Brewster and second by P.Tariot to adopt the decision
as amended.
Lot 5.6.7.8 and 9 North Andover Estates
Motion by A.Brewster and seconded by R.Milliard to adopt the
decision as amended.
Lot I Forest Street Extension
Motion by R.Mansour and seconded by A. Brewster to adopt the
decision as amended.
#1750 Great Pond Road
Motion by K.Foley and seconded by G.Reich to adopt the decision
as amended.
Printer - Discussion
Motion by G.Reich and seconded by K.Foley to authorize the
expense of up to $900 from the Wetlands Filing Fees account to
purchase a laser printer and necessary hardware.
