HomeMy WebLinkAbout1992-10-07 Conservation Commission Minutes NACC MINUTES OCTOBER 7 1992 PRESENT George Reich Richard Milliard Paul Tariot Kevin Foley Alison Brewster Robert Mansour Al Manzi MINUTES Motion by P Tariot and seconded by R Milliard to adopt the minutes of 9/16/92 OLD BUSINESS Lot 1 (#585) Dale Street (#242-579 & others) - Compliance Scott Giles apoeared to request compliance from #242-324 324AA 451 and 579 Motion by P Tariot and seconded by R Milliard to issue the Compliance upon receipt of a letter from a Registered Professional Engineer Vote 4-0-1, A Brewster abstained North Andover Estates (#242-58) - Disc of violation John Nolan and Jack Mallett gave an overview of the violation and restoration effort Six wetland areas have been impacted by the • road construction and have recently been restored The applicant admits to the violation and is making every effort to repair the drainage Disturbed Area 3 (lots 8/9) is the source of a spring 25 ' no-disturbance must also be restored throughout the site John Nolan discussed the need to fill more wetlands along Holly Ridge Road extension due to inaccurate topo Mr Harliss stated topo can be o=f by as much as 2 ' Revised plan must be filed Commission plans another site visit Dr Mallet was questioned as to what a growing season was on his plans He agreed to use the DEP/NACC definition which is one per year Lot 4 Turnpike (#242-541) - Compliance Scott Giles submitted the as-built plan Motion by P Tariot and seconded by A Brewster to issue a compliance NEW BUSINESS #137 Salem Street - Violation in the Watershed Mr Hamblet appeared to respond to an Enforcement Order The violation is the construction of a retaining wall with back filling More work is needed to complete the landscaping He was informed a RDA is required for this work • NACC 10/7/92 Page 2 #350 Winthrop Avenue - Modification D Scalise and Al Trakimas appeared to request a modification to allow for a S S D S as opposed to a sewer system Discussion of the impervious barrier between the SSDS and the SSDS Motion by P Tariot and seconded by R Milliard to grant a modification subject to approval of the impervious barrier by the NACC Administrator Lot 5B Laconia Circle - Partial Compliance Atty Caffrey requested a compliance R Doucette recommended the issuance of a Certificate of Compliance to each and every OOC Motion by R Mansour and seconded by P Tariot to grant Partial Compliances on 242-257 296 333 Lot 7 Salem St (#242-55 & 78) - Partial Compliance Mr Von Kummer represented this project to request two Compliances Motion by P Tariot and seconded by R Mansour to grant the two Compliances No Andover Country Club - Report on effluent R Doucette gave an overview of the effluent discovered Discussion of appropriate action Motion by R Milliard and seconded by G Reich to require a full • analysis of content and source of the effluent PUBLIC HEARINGS Lot 9D Old Cart Way - Notice (continued) Motion by P Tariot and seconded by K Foley to close the public hearing and issue a decision within 21 days Lot lA Tucker Farm Road - Determination The applicant appeared to request permission to place a spa on the deck which requires a foundation Motion by P Tariot and seconded by A Manzi to issue a Negative Determination with erosion controls and any excess fill should be removed from the site Lot 13 Hickory Hill - Determination Tom Zahoruiko presented plans for a single family home The proposed house is within 50 ' of the bordering vegetated wetland Motion by P Tariot and seconded by R Milliard to issue a Negative Determination with erosion controls, providing a plan showing a 50 ' no-construction zone is submitted Lot 63 Blue Ridge Road - Determination Mr Leonard presented plans for a single family home Motion by R Milliard and seconded by A Brewster to issue a • Negative Determination with erosion controls Vote 6-0-1 K Foley abstained NACC 10/7/92 Page 3 Lots 24,25,26,31A.32A Vest Way - Notice Al Shaboo presented plans for the single family homes Lot 24 R Doucette stated filling of land to meet septic system setbacks is not allowed under the No Andover Wetland Regs P Tariot stated this lot was once under common ownership R Doucette stated ownership information is needed since the subdivision was approved Abutters, Mr Daley stated that lot 24 is not on Vest Way it is in fact on Bridges Lane He also stated this wetland filling may affect runoff on his property Abutter Mr Drawbridge questioned hydrologic impacts Abutter Mr Bernat questioned the impact on the trees P Tariot stated the hydrological analysis is incomplete and the post development data is not included Motion by P Tariot and seconded by R Milliard to continue to 10/21 Lot 25 Filling is no closer that 70' from the wetlands Hydrologic calculations also incomplete Motion by P Tariot and seconded by K Foley to continue to 10/21 Lot 26 Motion by R Milliard and seconded by G Reich to close and issue a decision within 21 days . Lot 31A This pro]ect requires filling wetlands for septic system This is generally not allowed Ownership information and runoff calculations are needed Motion by P Tariot and seconded by R Milliard to continue to 10/21 Lot 32A Work is no closer than 35' No-construction zone is 65 ' Motion by P Tariot and seconded by R Milliard to close and issue a decision within 21 days NEW BUSINESS #18 Willow Street - Discussion of violation Motion by R Milliard and seconded by P Tariot to issue an Enforcement Order �� Lot 2 Patton Lane (#242-207) - Partial Compliance Motion by R Mansour and seconded by R Milliard to issue a Partial Compliance Vote 5-1-0 P Tariot against Lots 1 & 2 Holly Ridge (#242-348) - Partial Compliance Motion by A Brewster and seconded by R Milliard to issue a Partial Compliance Vote 5-1-0, P Tarlot against NACC 10/7/92 Page 4 DECISIONS Lot 7 Lyons Way Motion by K.Foley and seconded by A.Brewster to adopt the decision as written Lot 27 Donna Drive Motion by K.Foley and seconded by R.Milliard to adopt as written. Lot 9 Joanne Drive Motion by P.Tariot and seconded by K.Foley to adopt as written. Lot 2 Joanne Drive Motion by P.Tariot and seconded by A. Brewster to adopt as written.
