HomeMy WebLinkAbout1992-11-04 Conservation Commission Minutes r N North Andover Conservation Commission November 4 1992 PRESENT Richard Milliard Kevin Foley Paul Tariot Alison Brewster Richard Doucette OLD BUSINESS North Andover Country Club - Update David Morton represented the Country Club Motion by P Tariot and seconded by A Brewster to appoint Ben and Sylvie Rice as the Commission's representatives on site with the Administrator #980 Great Pond Road - Restoration Mr El Hefni could not attend Motion by P Tariot and seconded by A Brewster to petition the Town to seek an injunction against him to comply with the Enforcement Order Vote 4-0 North Andover Mills (#242-563) - Discussion/Modification Wright Dickinson discussed the construction sequence and the placement of sheet piling for the bridge • Forest St Extension (#242-595) - Discussion Engineer from -iancock Survey agreed to discuss a sedimentation basin as opposed to a detention basin Motion by K Foley and seconded by A Brewster to accept the revised plan to address Condition #22 Vote 3-1 P Tariot opposed #407 Bear Hill - Lifting of Enforcement Order Tim Hayes requested the lifting of the Enforcement Order Motion by P Tariot and seconded by A Brewster to lift the Order and to issue a Partial Compliance for File #242-158 Lot 2 Hawkins Lane (#242-388) - Partial Compliance Tom Neve represented the applicant Motion by P Tariot and seconded by A Brewster to issue a Partial Compliance Lot 8 Willow Street South (#242-193) - Partial Compliance Tom neve appeared to request a Certificate of Compliance The Executive Center on Lot 8 is part of the N A Business Park file The applicant would a Certificate of Compliance and a bond release Additional excavation is required to complete the replication of last floodplain The NACC motioned to issue the Partial Certificate of Compliance after approval of the finished grading by R Doucette is NACC 11/4/92 Page 2 PUBLIC HEARINGS Lot 15 Carriage Chase (#242-627) - Notice (continued) Tom Neve presented the same house and grading plans as were presented at the last public hearing R Doucette gave an overview of surrounding violations, which if this wetland filling were allowed would produce negative cumulative impacts Also this is a discretionary wetland filling is generally not allowed and the Commission has not granted such filling This site is within the Lake Cochichewick watershed No variances from local regs submitted P Tariot agrees T Neve would like to revise the plan Motion by P Tariot and seconded by A Brewster to continue to 11/18/92 Lots 1&2 Great Pond Road (#242-626) - Notice (continued) Tom Neve represented the applicant and presented same plans as were seen at the last public hearing R Doucette stated the house is only 90' from the lake Ad3acent lot is all wetland so the conservation restriction on that lot is of little value P Tariot would like to see the grading in the rear of the house R Doucette would like to see extent of lawn on site he would also like to see the soil logs Motion by P Tariot and seconded • by A Brewster to issue a decision within 21 days of receiving a new plan showing grading and extent of lawn and grading at rear of house and scil logs showing permeability of soils on site Lots 28A. 30A & 31A Sugarcane Lane - Notice Lot 28A R Doucette stated the wetland line needs to be flagged on all lots Motion by P Tariot and seconded by A Brewster to close the publ-c hearings and issue a decision within 21 days of R Doucette decision on the wetland line Vote 4-0 Lot 30A R Doucette stated the house is only 45 ' from the wetland line Needs a waiver Motion by P Tariot and seconded by A Brewster to close the public hearings and issue a decision within 21 days of the R Doucette decision on the wetland line and receipt of the waiver Lot 31A The house is only 32 ' from the wetland Grading is 18 ' from the wetland line Waiver not submitted P Tariot stated lot lines constrain construction pushing house too close to the wetland The plan needs to be revised Motion by A Brewster and seconded by K Foley to continue to November 18 Vote 4-0 NEW BUSINESS Lot 10 Tucker Farm Road (#242- ) - Notice • Mr Roberts presented subdivision plans for a single family home This was previously approved the Order of Conditions expired NACC 11/4/92 Page 3 R.Doucette stated the house is only 161 from the wetland. Grading is only 61 from the wetland. Plan must be revised. Move house, grading and driveway. Motion by K.Foley and seconded by A.Brewster to continue to November 18 . Lot 8 Hidden Court (#242-560) - Compliance Tom Neve appeared to request a Partial Compliance for this lot from the original . Motion by P.Tariot and seconded by A.Brewster to issue a Partial Compliance upon completion of excavation and stabilization under the direction of R.Doucette. Lot 3A Ba field Drive (#242-472) - Co licence Tom Neve appeared to request a Compliance. Motion by P.Tariot and seconded by A.Brewster to issue a Compliance. Lot 23 Pine Ridge Road (#242-236) - Partial CqWliance Tom Neve requested a Partial Compliance from the Order of Conditions for the subdivision. Motion by P.Tariot and seconded by K.Foley to grant the Partial Compliance. Vote 3-1, P.Tariot against. Lot 2.3 Pine Ridge Road (#242-601) - Modification Tom Neve requested a modification to accept the revised plan. Motion by P.Tariot and seconded by A.Brewster to adopt. Lots 24,25,31A Vest Way (#242-605,606,608) - Notice (cont. ) Motion by P.Tariot and seconded by A.Brewster to continue to November 18. DECISIONS Meadowoods Discussion of bond: $20, 000. Motion by P.Tariot and seconded by A.Brewster to adopt the decision as written with $20, 000 bond. Lot 5 Turnpike Street Motion by A.Brewster and seconded by P.Tariot to adopt the decision as written.
