Dear Mr, Long:
The North Andover Planning Board held a public hearing on Decc,mber 15, 1992 upon
the application of Wildrose Realty Trust, Rolm Nolan, Trustee, 853 Turnpike Street, North
Andover requesting a Special Permit under Section 8.5 of the North Andover Zoning Bylaw.
The legal notice was published in the Lawrence EagleTribune on November 30,and Dc;cernber
7, 1992 and all parties of interest were duly and properly notified. The following Board
members were present: George Perna, Chairman, Joseph Mahoney, Richard Rowen, John
Draper,John Simons. Also present were Karen Nelson,Director of Planning and Community
Development and Kathleen Bradley, Town Planner.
The petitioner was requesting a Special Permit for the construction of 19 single family
detached dwelling units.
Mr. Simons react the legal notice to open the public hearing.
Mr, John Nolen, Wildrosc, Developrucnt Corp., was present to discuss the proposed
project. Residential sprinklers will be installed. There is 1,000 foot frontage. on Mill Road.
Form A lots could lac developed.
Mr. Phil Christiansen, engineer from Christiansen &Sergi, spoke to the Board on t.hc,
proposed development. The followuYg are, high-lites:

1. 22 ft, wide road, a continuation of North Andover Estates
2. sidewalks on one side of the street
3. no curbing
4. keeping roadway below property lines
5. culvert under road for amphibian

9. no increase in peak flow from their calculations
10. no retention/detention designed
Ms, Claire Moody, 815 Johnson Street, expressed concerns with run off and silt onto
her property.
Mr. Simons,asked if the road could be moved to reduce problems on lots 7 through 11.
Mr. Christiansen said that the topo shows that present location is better,
Ms. Moody stated that the area becomes full of water izi the spring.
Mr. Perna asked that silt fences be used during construction, along the back of the
houses.
Mr. James DiAngelo, 152 Mill Road, had the following concerns with the drainage.
1, net impact of building not noted on plans
2. looked at Lots 9, 10 & 11 specifically
3. significant vnpact from regrading, suggested that independent review drainage
calculations.
On the buffer zone on Lot 11:
1. regrading occurs in buffer zone
.Mr. D"ngelo stated that it was the developers obligation not to impact the abutters.
Arthur Resca, Johnson Street/Mill Read, expressed his concerns about the drainage.
North Andover Estates should handle the additional drainage of North Andover Heights.
Mr. Perna suggested a site walk.

On a motion by Mr. Rowen, seconded by Mr. Draper, the Board voted unanimously
to continue the public hearing to January 5th and schedule a site walk. The center he of the
roadway will be marked out as well as the location of the proposed Douse on Lot I I will be
narked.
Outside review may be required as well as an EIS.
On January 5, 1993 the following members were present; George Perna, Chairman,
Joseph Mahoney, Richard. Rowen, Richard Nardella, and John Draper, John Simons was
absent. Kathleen Bradley, Town Planner was also present.
Bradley was asked to write a letter to the applicant outlining what the Board
wanted him to do and to address their concerns and issues.
There was a discussion as to the number of lots allowed. The Board viewed the base
density plan. Mr. Nolan gave a presentation on the number of conventional lots allowed in a
regular subdivision. There will be nothing built on Mill Road.
Approximately eight members of the public were in attendance who live in the area.
A resident of 161 Mi.11 Road asked how the PRD process works. Mr. Perna explained
the process.
A letter was received from Mr. Jaynes DiAngelo and read into the record. That letter
is available in the file.
The concerns that all neighbors have were about drainage and leach fields. Mr.
Christiansen, Christiansen &Sergi, described drainage changes. Changes were made on Lot.
I l to address specific concerns of the public,
The was a discussion of outside review by an engineer. Mr•. Nolan was in agreement.
Mr. Perna suggested the LEA Group. The neighbors questioned the impact on subsurface
drainage. They wanted to know how the plans relate to what is constructed, Mr.Perna stated
that what is on the plans is constructed.
Mr. Nolan stated that there: will be a no-cut line placed on the plans as well as a 50ft.
buffer zone. Copies of a Deed Restriction with the 50 ft, buffer zone to be given to the
Planning Board prior to the signing of the plans. There will be an open space easement along
the property line of Lot 1.
Cori-unents were submitted from the neighbors and can be found in the file.

There will be a conservation restriction on the land instead of being deeded to the Town.
There will be a stop sign at the end of the subdivision where it enters Rosemont, This
is to be added to the decision.
Paul Hedstrorn, Oaks Drive,asked that the Board move the project along and prat this
on line and close the public hearing.
Mr. Nolan stated that construction would begin as soon as weather permits, at the end
of Phase I of North Andover Estates.
.----Mr, Nardella asked other Board members if phase development was wh, t th�:y wanted.
The consensus was yes.
Sample housing types to be provided to the Planning Board, They will be colonial
ponies, consistent with the homes being built in North Andover Estates by Toll Brothers,
Mr. Draper wanted similar considerations for this as on Phillips Conunon, regarding
housing types, landscaping, etc.
Mr. Perna asked about the entrance sign, He wants to see the plans.
On a motion by Mr. Draper, seconded by Mr. Nardella the Board voted unanimously
to continue the public hearing to the next meeting, January 19th, and directed Ms. Bradley to
draft a letter listing concerns and draft a decision for the next meeting.
On January 19, 1993 the following members were present: George Perna, Chairman,
Joseph Mahoney; and Richard Rowcn, Richard Nardella, John Simons and John Draper,

On February 2,1993 the following members were present: George Perna, Chairman,
Richard Nardella, John Simons, Joseph Mahoney, John Draper and Richard Rowen. Also
present were Kathleen Bradley, Town Planner and Karen H.P. Nelson, Director of Planning
& Community Development.
Mr. Rowen presented the Board with a draft decision,

The applicant asked if the actual decision had to be put on the plans. The applicant was
told the cover sheet and lot plans are recorded. The decision can be recorded separately. Ms.
Nelson, stated that originally decisions were placed on the plans for coordination purposes.
Mr. Perna stated that only items that are perpetual are on the cover sheet.
Mr. Simons stated that there was a need to ensure access to the project and an
agreement with owner of utilities in North Andover Estates. This agreement should be
submitted in the form of a letter, between both parties,
Mr,Draper mentioned an erosion control scheme created by engineer to control abutter
impact.
Mr. Simons left at 10:30 pan, Mk. Mahoney left at 11:00 p.Yn.
Sidewalks will be required as shown on plans. The roadway width proposed as 22' is
acceptable as it connects to a 22' roadway,
On a motion by Mr. Rowen, seconded by Mr. Nardella the Board voted unanimously
to accept the draft conditional approval for the definitive subdivision as modified by the
discussion.
There was a discussion of the PRE) approval.
Mr.Nolan showed the Board what restrictive covenant will be placed on the lots,tighter
restrictions than architectural covenant,
Mr. Nolan and Mr. Draper to discuss the architectural aspects.
On a motion by Mr. Nardella, seconded by Mr. Rowen, the Board voted unanimously
to continue discussion on the decision for the PRD.
On liebruary S, 1993 the following members were present: George Perna, Chairman,
Joseph Mahoney,Richard Nardella,and Richard Rowen. John Draper and John Sun-ions were
absent,
Mr. Perna gucstioned if there was a need for a performance guarantee. Mr. Nardella
stated that the Board was only looking for an amount necessary to restore the site, should
anything happen to stop development..
Mr. Nolan stated that $25,000 was being held by the Conservation Conunission for
erosion control in the wetland areas.

Mr, Rowen questioned what would happen if the developer walked away from the site,
leaving a pile of dirt. What would the Town do? How much would it cost?
Mr. Hmurciak, D.P.W., stated that the Town would generally not do anything to
remove the pile of dirt.
Mr. Nardella stated that$5,000 sounded good as a figure for this site. The Board wants
to set a precedent for performance guarantees. Money can be rolled over into performance
bond.
Mr. Perna stated that there would be a discussion on the construction of a model home
-M-a later date,
On a motion by Mr.Nardella, seconded by Mr.Rowen, the Board voted to approve the
Special Permit for the PRD at North Andover Heights as drafted and amended. The
Chairman, George Perna voted to make the fourth vote as required.

Conditional Approval
The Planning Board herein approves the Special Permit requested
by Wildrose Realty Trust, dated November 11, 1992 . The Planning
Board makes the following findings as required by the Rules and
Regulations Governing the Subdivision of Land Sections 10. 3 , and
10. 31.
A. The specific site is an appropriate location for a Planned
Residential Development.
B. The use as developed will not adversely affect the
neighborhood.
C. There will be no nuisance or serious hazard to vehicles or
pedestrians.
D. Adequate and appropriate facilities will be provided for the
proper operation of the proposed use.
E. The application before us is in harmony with the general
purpose and intent of the Bylaw.
The Planning Board also makes findings under Section 8. 5 of the
Zoning Bylaw that this PRD is in harmony with the general purpose
and intent of the Bylaw and that the PRD contains residential
development and open -space in a variety to be sufficiently
advantageous to the Town and promotes the public health, safety,
and welfare of the citizens of the Town of North Andover. In
particular, the Planning Board finds that this project will:
A. Promote the more efficient use of land in harmony with its
natural features by preserving additional open space,
reducing the amount of clearing and excavation normally
associated with the construction of residential dwellings on
a site such as this;
B. Encourage the preservation of open space. The applicant has
provided 9 . 4 acres (37%) of the property as Open Space;
C. Permit greater flexibility and more attractive and efficient
design of residential development;
D. Meet the Town's housing needs by promoting a diversity of
housing types.
The Planning Board also finds that a base density of 19 sots is
appropriate. This number of lots has been determined from a
Preliminary Subdivision Plan provided to the Planning Board which
satisfies the Town's requirements for submission of such a plan.

Finally, the Planning Board finds that the Definitive Subdivision
complies with Town Bylaw requirements so long as the following
conditions are complied with:
1 Prior to any construction, the applicant shall post (per
agreement with the North Andover Planning Board) a
Performance Guarantee in the amount of $5, 000 (five thousand
dollars) to be held by the Town of North Andover in the form
of a passbook account as designated by the Town Treasurer.
This amount shall cover any contingencies that might effect
the public welfare such as site-opening, clearing, erosion
control and performance of any other condition contained
herein, prior to the posting of the Performance Security as
described in Condition 3 (a) below. This Performance
Guarantee may at the discretion of the Planning Board be
rolled over to cover other bonding considerations, be
released in full, or partially retained in accordance with
the recommendation of the Planning Staff and as directed by
the vote of the North Andover Planning Board.
2 . Prior to endorsement of the plans by the planning board and
recording with the Registry of Deeds the applicant shall
adhere to the following:
All associated open space shall be gifted to the Town
of North Andover through the Conservation Commission.
Documents to this effect must be reviewed by the Town
Planner prior to the endorsement of the plans.
b. Restrictive Covenants shall be recorded to insure that
r�9 the architectural style of the proposed structures are
✓ appropriate in design. Documents to this effect must be
�L reviewed by the Town Planner prior to endorsement of
the plans.
3 . Prior to any lots being released from the statutory
covenants:
a. Performance Security in an amount to be determined by
the Planning Board upon the recommendation of the
Department of Public Works shall be posted to ensure

completion of the work in accordance with Plans
approved as part of this special permit. Items covered
include, but are not limited to:
i. as-built drawings
ii. sewers and utilities
roadways construction and maintenance
iv. lot and site erosion control
V. site screening and street trees
vi. drainage facilities
vii. site restoration
viii. final site cleanup
b. Copies of the Open Space deed to the Town and the
Architectural Covenant on the deeds as referenced
above, must be submitted to the Board for review.
4 . Prior to a Building Permit being issued (FORM U signed) for
an individual lot, the conditions outlined in the North
Andover Heights Definitive Subdivision conditional Approval
must be followed.
5. Prior to a Certificate of occupancy being issued for an
individual lot, the conditions outlined in the North Andover
Heights Definitive Subdivision Conditional Approval must be
followed.
6. Prior to the final release of security, the conditions
outlined in the North Andover Heights Definitive Subdivision
Conditional Approval must be followed.
7. The applicant shall adhere to the following requirements of
the Fire Department:
a. All structures shall be required to contain residential
fire sprinkler systems the design of which will be
approved by the Fire Department.
8. All construction shall commence within two (2) years from
the date of this approval and shall be completed within five
(5) years from the date of this approval.
9. The provisions of this conditional approval shall apply to
and be binding upon the applicant, its employees and all
successors in interest or control.
10. The following information shall be considered as part of the
decision:

4. Prior to a Building Permit being issued (FORM U signed) for
an individual lot, the conditions outlined in the North
Andover Heights Definitive Subdivision Conditional Approval

5. Prior to a Certificate of occupancy being issued for an
individual lot, the conditions outlined in the North Andover
Heights Definitive Subdivision Conditional Approval must be
followed.
6, Prior to tho final release of :security, the conditions
outlined in the North Andover Heights Definitive subdivision
Conditional Approval must be followed. `y
7. The applicant shall adhere to the following requirements of
the Fire Department:
a. --All structures shall be required to'contain residential
fire sprinkler systems the design of which will be
approved by the Fire Department.
B. All construction shall commence within two (2) years from
the date of this approval and shall be completed within five
(5) years from the date of this approval.
9. The provisions of this conditional approval shall apply to
and be binding upon the applicant, its employees and all
successors in interest or control.
