Conservation Conditions of Approval,NACC#337
Pursuant to section 4.4.2 of the North Andover Wetlands Protection Regulations, on behalf of the homeowner
Ralph Sharp,Greg Fraser of Top Deck Construction, filed for a Small Project Permit application under Category
"A", for work proposed at 36 Autran Avenue,North Andover. The work involves: demolition of existing rear
wood landing and stairs and construction of a 12'x 16'deck and new 9'x 4'stairs for a total square footage of 228.
The new deck will be 51 feet from the bank of the,intermittent stream located off property(on Heritage Green
Condo property). Three new footings at 3'4'deep to be dug by hand.
During the November 13,2024 the North Andover Conservation Commission (NACC)identified two 11011-
compliant features on the property that constituted wetland violations including an existing shed within the 25'No
Disturb Zone and partially off property, and a section of vinyl stockade fence within the 25'No Disturb Zone and
partially off property. The NACC tabled review of the application and directed that the violations be remedied by
removing the shed to a location greater than 50' from the batik of the brook and returning the fence to the Property
line. On January 21,2025,Conservation Department staff Field verified that the vioilations were addressed,with the
shed being completely eliminated from the site and fence returned to the rear property fine and reported same at the
January 22, 2025 NACC meeting.
At the January 22, 2025 public meeting, the NACC found this project to qualify as a Small Project Permit and voted
unanimously to approve this project as proposed under Cate,goyy 'A"for construction of an open slotted deck less
than 300 s.f. in size inclusive of stairs, subject to compliance with the conditions listed below.The project is
approved only as it relates to the Conservation Commission and any and all other approvals should be obtained by
the applicant/homeowner.
All work shall conform to the following:
RECORD DOCUMENTS: Small Project Filing Including:
• Application Checklist with supporting narrative and attachments,
stamped received November 4,2024;
• Certified Plot Plan,prepared by John Abagis &Associates,dated
October 10,2024, signed and stamped by John Abagis,PLS (note that
wood shed is no longer present and the fence is returned to property
line).
The following conditions are hereby mandated:
CONDITIONS:
1. A post construction inspection shall be held by Conservation staff to verify compliance with this permit.
2. This permit is valid for one (1) year from the date of issuance.
The applicant,homeowner and their contractors are advised that NO other work on the property is
allowed under this vertnit. 'Flic NACC has itirisdiction overall of the wetlands and associated 100-Foot buffer
zones and 200 Riverfront Area to the Shawsheen River on site and any work that involves ground disturbance or
