The undersigned hereby applies for the approval of said DEFINITIVE plan
by the Board, and in furtherance thereof hereby agrees to abide by the Board's
Rules and Regulations. The undersigned hereby further covenants and agrees
with the Town of North Andover, upon approval of said DEFINITIVE plan by the
Board:
I. To install utilities in accordance with the rules and regulations of the
Planning Board, the Public forks Department, the Highway Surveyor, the
Board of Health, and all general as well as zoning by laws of said Town,
as are applicable to the installation of utilities within the limits of
ways and streets;
2. To complete and constct the streets or ways and other improvements shown
thereon in accordance wrath Sections Iv and V of the Rules and Regulations
of the Planning Board and the approved DEFINITIVE plan, profiles and cross
sections of the same. Said plan' profiles, cross sections and construction
specifications are specifically, by reference, incorporated herein and made
a part of this application. This application and the covenants and agree—
ments herein shall be binding upon all heirs, executors, administrators,
successors, grantees of the whole or part of said lands and assigns of the
undersigned; and
3. To complete the aforesaid installations and construction within two (2)
years from the date hereof,

The North Andover Planning Board has voted to APPROVE said plan' subject to the
following conditions:
1. That the record owners of the subject land forthwith execute and record
a "covenant running with the land"r or otherwise provide security for the con-
struction of ways and the installation of municipal services within said sub®
division' all as provided by O.L. c. 41f S. 81®1J.
2. That all such construction and installations shall in all respects
conform to the governing rules and regulations of this Board.
3. That.* as required by the North Andover Board of Health in its report to
this Boardv no building or other structure shall be built or placed upon Lots

List of Additional Conditions;
4. That all grater mains shall be installed in accordance with the Board of Public
Works specifications.
5. That all fire protection improvements shall be constructed in accordance with
the standards of the Board of Fire Engineers.
The proposed road shall be constructed as shown on the plan but said construction
shall not be done until 6 months prior to the completion date and only upon approval
of the Planning Board. Regarding the extension of Timber Lane to Bridle Path, the
proper barrier shall be set up to prevent any construction vehicles or other vehicles
entering or leaving the site during construction.
7. A 10 foot "no cut" strip shall be added along the rear lot lines of Lots 21-26
as shown on the definitive plan dated August 23, 1976.
8. Two catch basins at the intersection of Great Pond Rd. and the proposed road
shall be shown on the definitive plan.
9. Existing cul de sac on Timber Lane to be removed and graded to meet existing
grades plus any other corrections deemed necessary per the Highway Surveyor's letter
dated 9/27/76. The aforementioned condition shall not be done until 6 months prior
to the completion date and only upon approval of the Planning Board.
10. Berm shall be required where necessary.
11. 18 in. overlap of gravel is required from all edges of pavement; road width shall
be 26 feet with 3/4 in. to the foot crown on finish bituminous surface; road to be
widened a distance of 40 ft. at the approach to cul de sac.
12. Recommendation #9 of Highway Surveyor's letter dated Sept. 27, 1976 shall be
adhered to by the developer.
13. A hydrant shall be shown on lot line between Lots, 18 & 19.
14. A 30 ft. utility easement along lot line of Lots 19 & 20 to land of Foresta shall
be shown on the plan.
15. A fire alarm box shall be installed at the intersection of Bridle Path and Timber
Lane,
16. Adequate public liability & property damage insurance as well as a street opening
bond in an amount set to the Highway Surveyor's satisfaetorpmust be provided for the
work on Great Pond Rd. and Timber Lane.
17. That no lot may be built upon until a subsurface seviage disposal system permit

Dear Mr. Lyons:
The following petition was heard at a meeting of the Planning Board on Monday evening,
September 27, 1976 at 7:30 P.M. in the Town Office Meeting. The following members
were present and voting: Fritz Ostherr, Chairman; William Chepulis, Vice-Chairman;
Paul R. Lamprey, John J. Monteiro, Clerk; and William N. Salemme.
Mr, John Tuttle, Vice President of Landsa.il, Inc., petition9d for a subdivision of
land containing approximately 50 acres situated between Great Pond Rd. and Dale St. ,
to be subdivided into 34 lots and to be known as Great Pond Woodland.
Mr. Tuttle presented plans to the Board and stated that this plan meets all existing
regulations and was aware of the potential problem to the drinking water supply.
They had done extensive research in relation to the drainage and cited only 3 areas
that are low and will work with the Conservation Commission to protect these areas.
The following abutters and residents voiced opposition:

The concerns were the connecting of Timber Lane with Bridle Path, traffic, drainage,
threat to water supply, pond area in vicinity of Lots 2 & 3.
At a meeting held on Tuesday, Oct. 19, 1976 the subdivision control subcommittee made
and seconded a motion to approve the definitive subdivision plant of Great Pond Wood-
land subject to the conditions below. The vote on the motion was unanimous.
1. That the record owners of the subject land forthwith execute and record a "cove-
nant running with the land", or otherwise provide security for the construction of

provided by G.L. c. 411 s. 81-ti.
