The Planning Board herein denies a three (3) lot Preliminary Subdivision located on High Street in the I-S, GB, and R-4
underlying zoning districts, as well as the Downtown Overlay Zoning District, Part 2 Subdistrict A: Historic Mill Area. The
application was submitted on January 31, 2019 by applicant RCG West Mill NA,LLC, the owner of the property,with plans
dated January 22, 2019, revised to February 21, 2019, prepared by Civil Design Group, LLC. Planning Staff submitted the
application and plan to the following departments for review and comment: Building Department, Conservation Department,
Health Department,Fire Department,Police Department,Police Department and Public School Department.
In conformance with the Subdivision Control Law(M.G.L. c.41, §§81K-81GG)and the PIanning Board Rules and
Regulations Governing the Subdivision of Land in the Town of North Andover(Chapter 255 of the Code of the Town of
North Andover), on March 5,2019, after considering written and verbal comments and the Board's own review and
deliberations,the Board voted unanimously to deny this preliminary subdivision submission based on the FINDINGS OF
FACT:

FINDINGS OF FACT:
The Planning Board makes the following findings as required by§255-4.5.B Review Standards for Preliminary Plans as
set forth in the Rules and Regulations Governing the Subdivision of Land,North Andover,Massachusetts:
A. The Preliminary Plan does not meet the subdivision street requirements as stated in the Planning Board Rules and
Regulations Governing the Subdivision of Land in the Town of North Andover§255-6.8.A Table IA which requires
a minimum Right-Of-Way width of 60 feet, a minimum vertical curve length of 100 feet, and a minimum vertical
curve length of 40 feet.

B. Based on the submitted plan,the Planning Board was unable to satisfactorily review technical issues required by
§255-6.7 without a traffic impact analysis as required in §255-5.4(D)(6).
Upon a motion made by J. Simons and a second by P.Boynton,the Planning Board herein DENIES this application for a
Preliminary Subdivision Plan. The vote was 0-5.Any decisions made by the Planning Board regarding this Preliminary
Subdivision application are not binding are not to be considered as an approval or denial of any future Definitive Subdivision
filing. Any Definitive Plan filed at a future date may contain more detailed information than that provided with this
Preliminary Plan. The following plans are included as part of this decision:
