The Planning Board herein denies a proposed three(3)lotPreIiminary Subdivision located atEastMM73,•High and Water Streets,
located within the I-S and Residential 4 underlying zoning districts,as well as the.Downtown Overlay Zoning District,
Subdistrict A:Historic Mill Area. The proposed subdivision is-also located within the Machine Shop Village Overlay District
The application was submitted on December 5,2019 by applicant RCG North Andover Mills,LLC,.the owner of the property,
with plans dated November 12,2019 prepared by Civil Design Croup,LLC. PIanning Staff submitted the application and plan
to the following departments.for review and comment: Building Department,Conservation Department,Health Department:
Fire Department,Police Department Conservation,and Public.School Department To accordance with§255-4.5.A of the
PlanningBoard Rules and Regulations Governing the Subdivision of Land in the Town ofNorth-Andover(Chapter 255 of the
Code of the Town of North Andover),the Planning Board has determined that the applicant`s submission constitutes a proper
submittal.
In conformance with the Subdivision Control Law(M.G.L_c.41,§§81 K-8I GCr)and the Planning Board Rules and
Regulations Governing the Subdivision of Land in the Town of North Andover(Chapter 2,55 of the Code of the Town of
North Andover),on January 7,2020,after considering written and verbal comments and the Board's own review and
deliberations,the Board voted unanimously to deny this preliminary subdivision submission based on the FMINGS OF
FACT:
The Planning Board makes the following findings as required by§255-4.5.B Review Standards for Preliminary Plans as
set forth in the Rules and Regulations Governing the Subdivision of Land,North Andover,Massachusetts:

The Preliminary Plan does not meet the subdivision street requirements as stated in the Planning Board Rules and
Regulations Governing the Subdivision of Land in the Town ofNorth Andover§255-6.8,A Table 1A which requires
a minimum Right-Of-Way-width of 60 feet,§255-6.8G which requires a Cul-de-sac turnaround in accordance with
Subsection A,Table IA,and Lot 2 does not meet minimum street frontage requirements of 150'.
Upon a motion made by J.Simons and a second by A.Preston,The Planning Board herein DENIES this application for a
Preliminary Subdivision Plan.The vote was 0-5,unanimously denied approval.Any decisions made by the Planning
Board regarding this Preliminary Subdivision application are not binding are not to be considered as an approval or denial
of any future Definitive Subdivision Plan filing.Any Definitive Plan filed at a future datz,may contain more detailed
information than that provided with this Preliminary Subdivision Plan.The following plans are included as part of this
decision:
