The undersigned hereby further covenants and agrees with the Town of North Andover, upon approval of said DEFINITIVE plan by the Board: 1. That the record owners of the subject land forthwith execute and record a "covenant running with the land", or otherwise provide security for the .con- structi.on of ways and the installation of municipal services within said sub division® all as provided by G.L. c. 41# S. 81—U. 2. That all such construction and installations shall in all respects conform to the governing rules and regulations of this Board. 3. An eight _W _inch water main per :I .a . specifications noted above shall be installed from sta. 0+0 to sta. 9+85 . b. - Eight (8) 'inch Mueller gate shall be installed at sta . 0+0. C . Lady breakflange hydrants installed at sta . 0+50, 4+95, 9+85. 11:1 . Forest Street a . The water main shall be twelve ( 12) inch per specifications I .a . to be installed from the intersection of 'Laconia Circle to the north property line of Lot 9A. b. Two ( 2) twelve ( 12 ) inch Mueller or equal gate valves (open ;Left ) to be installed at the intersection of Laconia Circle and at the north property line of Lot 9A. C . Eddy breakflange hydrant to be installed at the north property Line of Lot 9A. IV. All hydrant branches shall_ be provided with six (6) .inch Mueller or equal_ gate valves (open left) . V. All gate valves shalt comply with AWWA specifications L500 52T and w:i. Ll be supplied with a 100 lb. sliding type gate box marked "WATER'' . Vl . All water mains shall pass leakage and pressure tests performed in accordance with section 1.3 of AWWA standard CGOO and shall be chlorinated in accordance: with AWWA C601 "Standard Procedure :for Disinfecting Water Mains" . 6. The proposed construction shall hereby become a part of this conditional_ approval and comply with the submitted construction schedule dated February .12, 1985. 7. Any drainage from cellars or lot development shall be tried into the designed drainage system to be shown on the definitive plan and approved by the Planning Board and Highway Surveyor. 8. No town services shall_ be provided to the subdivision until the binder coat of pavement and temporary turnaround is provided . 9. Street drainage not shown on the definitive plan will not be added during construction unless required by the Highway Surveyor and will be detailed on the required as--built plans submitted . 10. The appl.i can L-/owner/developer shall be aware of the fact that approval of this subdivision under the Planning Board ' s Rules and Regulations will not relieve said parties of the responsibility to other pr()IJ,erty owneis upon whose land may be affected by indirect or direct development storm water discharge . 11. The existing temporary cul.--de--sac on Laconia Circle shall be removed and the developer shall ensure that lot- # 12 Crossbow Lane will have sufficient frontage . rhe temporary easement shall. be .reverted to abutting property owners . 12. All roadway cross sections shall, be revised in accordance to the Planning Board Rules and Regulations . 13. The approval of said definitive plan shall. riot imply the approval of any subsequent Special Permit requests under Section 2. 75 in the North Andover Zoning Bylaw regarding ' Common Driveways ' . 14. All Frontage Exception Lots shall_ so be noted on the definitive plans . 15. In accordance with the Fire Department ' s recommendations : a. ALl lot numbers shall be posted on houses during construction. b. All house numbers shal L be posted on houses prior to occupancy. C. No open burning shall be allowed except as permitted by the North Andover Fire Department . d. Prior to taking occupancy the subdivision streets shalt provide adequate access for each residence by the Fire Department . 16. All drainage easements shall. be 20 feet in width and run continuous with the land . 17 . No earth removal shall be al.Lowed other than that which is defined as incidental to development and construction as per Section 5. 6, Par . l and 2 of the North Andover Zoning Bylaw, until application is made and a permit is issued for Earth Removal by the Board of Appeals . 18. The deveLoper/owner shalL receive written assent from the New England Power Company for proposed crossing and submit said documentation to the Planning Board prior to construction . 19. In accordance with the Highway Surveyor ' s latter. dated 3/18/85 : a. An inspection form shall_ be used and all- work shall, be inspected prior to backfilling . b. Berm could be required and shall be determined in the field. Binder width would be 29 feet to accomodate the berm. C . Catch basin units shall_ be B in precast units . Frames and grates shall_ be 4 flange checkerboard type . d . A7. 1 brick used is to be clay type and laid in good cement mortar . e . No town :.services wilt be provided until binder coat is laid and surface is free of Problems for vehicular traffic . f .
