I will also be sending you some information I found in the files relating to the permitting history of the site. It appears the facility was constructed at a time when nursing homes were allowed outright by zoning. Today, nursing home facilities are only allowed in the R-4 Zoning District with a . Special Permit from the Planning Board. I have included a photocopy of the uses allowed in the R-4 Zoning district. I am not sure as to whether the property has lost its grandfathering zoning status as it has been vacant for some time. This is a question for the Building Commissioner, Robert Nicetta. He will be out of the office for the next two weeks and I suggest you formally submit a letter inquiring about the zoning status. I have sent a copy of your memo over to his office. Your memo suggested you may acquire adjoining land and possibly redevelop the site. The R-4 zoning district only requires 12,500 s.f. lots. Any redevelopment on the site would most likely require Site Plan Review by the Planning Board, Consolidating the properties into one lot would only require the signature of the Town Planner if all dimensional requirements complied. This process is called Approval Not Required and the plan requirements are found in Section 3 of our Subdivision Rules and Regulations. Parking requirements would be dependent on the type of use. I suggest you review the Zoning Bylaw on line at townofnorthandover,com. Any requested relief associated with area, setbacks, frontage would require a filing with the Zoning Board of Appeals. Regarding your question of the minimum right of way for an internal street, a 50 foot right of way would be necessary. Regarding rezoning of the site, this can only be done through a town meeting vote. I am not sure if the town would support higher density as the R-4 is one of the higher density zones. I am not sure I understand your question regarding the development fees. You may want to elaborate so that I can get you the correct answer. I have resigned as Town Planner and will be in the office until September 17. 1 just want to make sure you get as much information as you can before I leave. I will be sending you a package of some information I have found in the files. After the 17th please contact Heidi Griffin, Community Development Director or Robert Nicetta, Building Commissioner to further help you with questions. We are currently reviewing the circumstances of a vacant nursing home facility in North Andover. Any help on the following issues would be greatly appreciated. The property currently owned by Healthsouth consists of the nursing home building containing approximately 43,400 square feet and 46,331 square feet of land. Only 22 parking spaces are available on the site. Without access to additional parking it was necessary to discontinue operations and vacate the premises. Given this configuration: • Under what provision(s) of the current R4 zoning was the nursing home allowed to operate? Healthsouth may acquire the adjoining parking lot and duplex residential property formerly part of the property in which case there would be adequate off-street parking to resume nursing home operations. We may advise Healthsouth to consider acquiring the adjoining sites and redeveloping the total site by razing the nursing home and redeveloping the site. Under this configuration the site would contain approximately 110,200 square feet including the land associated with the existing residence. Considering this alternative: • What are the minimum lot size / frontage under R4 zoning? • What would be the prospects of slight variances from these requirements to enhance efficiency? • How onerous would the re-platting process be to re-plat the total site for redevelopment? • What would be the minimum right-of--way for an internal street within the site? • Would the city of North ,Andover consider rezoning the site to a higher residential density? • ,Are development fees applicable to access public utilities in the event of redevelopment? The Planning Board's decision requires the lights to be turned off at 11: 30 pm, however they have been on all night. I called Don Buckley at The Greenery and asked him to turn the lights off at 11: 30. When he spoke with his on-site manager, she told him that the night shift ends at 1.1:30, thus employees are leaving and arriving at 11: 30. She has requested that the lights be allowed to stay on until midnight. We will discuss this at the November 16 meeting. I do not have any problem in allowing them to keep the lights on until midnight however they must be shut off at that time. Some of the other issues concern drainage problems and the need for additional landscaping. Access shall include availability of large general area, heating and lights turned on. 6. It is anticipated that emergency usage will be for an initial 24 hour period, or until permanent arrangements can be made. ].
