Preliminary Plan Disapproval
The Planning Board herein disapproves a seventy three (73) lot
Preliminary Subdivision Plan known on the Boston University
Conference Center site off of Osgood Street. The application was
submitted by Evergreen Management Corp. , 733 Turnpike Street,
Suite 311, North Andover, MA 01845, dated October 24 , 1994 . The
area affected contains approximately one hundred sixty five (165)
acres. The majority of the property is located in a Residential-
1 (R-1) Zone with a small section located within the Residential
- 2 (R-2) Zone. The R-1 portion of the property is located
within the Lake Cochichewick Watershed Protection District.
Findings of Fact
The Planning Board makes the following findings:
1. The applicant failed to review the information submitted
with the Town Planner prior to the FORM B receiving a time
stamp from the Town Clerk as required by Section 3 (B) (2) (b)
of the Rules and Regulations Governing the Subdivision of
Land, North Andover, Massachusetts, Revised February, 1989.
2 . The plan was not properly submitted as the applicant failed
to provide the following information as required by Section
3 (B) ( 3 ) of the Rules and Regulations Governing the
Subdivision of Land, North Andover, Massachusetts, Revised
February, 1989;
a. Sufficient information about the subdivision has not
been submitted in order to allow the Planning Board to
form a clear basis for discussion and for the
preparation of the definitive plan.
b. A plan at 1" = 40 ' scale which includes the following
information was not provided:
i. Name and address of the owner of record
ii . Flood Hazard Areas as determined by the Federal
Emergency Management Administration
iii . Title under which the proposed subdivision is to
be recorded with the Town Clerk
iv. Proposed street names, curves, and preliminary
street profiles
V. The total area and contiguous buildable area of
each lot shown in square feet
vi. Topographic contours at five (5) foot intervals
3 . The applicant failed to comply with the design standards as
set forth in Section 7 of the Rules and Regulations
Governing the Subdivision of Land , North Andover,

Massachusetts, Revised February, 1989:
a. The proposed street is not continous and in alignment
with existing streets
b. Provisions have not been made for proper projection of
streets into adjacent property
C. Information as to the grade of the road was not
provided.
d. Shoulder width information was not provided.
e. The lots shown on the plan do not comply with the area,
frontage, and other requirements of the Zoning Bylaw.
Information as to total area and contiguous buildable
area was not submitted. The frontage on lots 19 to 23 ,
26 to 30, 33 , 35, 38 , 39, 49, 58 to 60, 66 to 70, and
72 is less than the minimum required. No information
as to the frontage and area of Lot 51 was submitted.
f. Drainage information was not submitted.
g. Due regard has not been shown for all natural features
which if preserved would add attractiveness ,
distinctiveness and value to the subdivision and the
Town.
4 . A request for determination has not been filed with the
North Andover Conservation Commission therefore the wetland
lines cannot be confirmed.
5. Location of proposed homes and driveways have not been shown
on the plan.
6. The applicant should review the site under the Planned
Residential Development Bylaw.
7 . The applicant must review the proposed street names with the
E-911 Coordinator.
conclusion
Based on the above findings, the Planning Board herein
disapproves this Preliminary Subdivision Plan.
