Dear Jean:
As you are aware we are counsel to Marc Rudick and the property owners (MR
Investments LLC and PR Investments LLC) in connection with the above-
referenced project. A condition of the approval/decision for the project required
that an existing structure that was located on the boundary line between lot 36
and lot 37 (shown on the subdivision plan as "Existing Structure to be Razed") be
either moved offs€te to another location or be razed. This condition was included
in paragraph 35 of the Subdivision Decision.
As you are aware, the applicant has caused the said building to be razed and
removed from the locus, provided however, that portions of the structural
foundation of the building were not removed and have been proposed to remain
In place as a retaining wall.
Please accept this correspondence as formal request by the applicanVowners for
approval of this revision as an Insubstantial change to the plan.

Dear Jean:
As you are aware we are counsel to Marc Rudick and the property owners (MR
Investments LLC and PR Investments LLC) In connection with the above-
referenced project. A condition of the approval/decision for the project required

provided however, that portions of the structural foundation of the building were
not removed and have been proposed to remain in place as a retaining wall,
We requested, on behalf of the appilcant/owners, that this modification be
approved as an insubstantial change to the plan and it was approved by the
Planning Board subject to the conditions that (1)we show the retaining wall on
the final as built plan to be provided for the drainage system on Lots 37, 38 and
39, and (2) we obtain written authorization from the purchaser of Lot 36 that the
applicant and its contractors and agents, as well as the Town, shall have rights to
access the property to complete any inspections as well as any work as may be
required under the Planning Board's decisions.
Please accept this correspondence as formal acknowledgment, acceptance and
confirmation of these conditions, on behalf of the owner/applicant. We will
provide you with a copy of the written authorization letter when obtained at
closing.

Attached please find a letter requesting finding of insubstantial change.
As it relates to the bond, Marc Rudick can/will post. Do you need to know, specifically, which entity/account it will be
drawn against (le, MR Investments LLC, PR Investments LLC, or his personal/individual account?) He's willing to do
whatever is best/quickest to post so that he can close on sale of lot 36-so let us know what you need from me/him
and when bonding docs are ready. I assume you'll want a check payable to Town of North Andover, signed Form G,
and signed W-9.
