Dear Ms . Bradley:
I am writing to you regarding the following documents :
1 . Subdivision Control Agreement Securing The Construc-
tion of Ways and Municipal Services dated May 29, 1979
( "Subdivision Control Agreement" ) ; and
2 . Restrictive Covenants dated May 28, 1979 ( "Covenant" ) .
I am also enclosing for your reference the Release dated June
12 , 1979 ( "Release" ) .
I am currently representing the Buyer of the above
referenced property who is one of the partners in this law firm.
The title examination of same revealed the existence of the
aforementioned documents and the resulting title issues which
must be resolved with all expediency as this property is
scheduled to close Monday, July 26 , 1993 .
The issues are twofold and as follows :
1 . With respect to the Subdivision Control Agreement, it
appears simply that this documents has never been
released/discharged of record even though the work it
was intended to secure has been completed: the road
is fully paved and. the municipal utilities installed
and functioning. This document still encumbers the
title to this property and therefore is unacceptable

to the lender from a good and marketable title
standpoint.
2 . With respect to the Covenant document, restrictions 1
and 2 were released pursuant to the Release. However,
there is some ambiguity regarding the relationship
between the Covenant document and the Release document
because although restriction 3 is crossed out in the
Covenant document, the Release states that restriction
3 is to remain in effect. It appears that restriction
3 concerned the installation of septic systems,
however, it is my understanding that all the
residences in the subdivision are hooked up to town
sewer. Therefore, I am confused as to why the Release
excepted restriction 3 from the release language, and
additionally, why all of these documents are dated
within two or three weeks of each other yet the
Release does not make any reference the Subdivision
Control Agreement.
I would appreciate the opportunity to discuss these issues
with you Thursday so that, at a minimum, I can obtain a verbal
confirmation from you that the town acknowledges that all the
requirements of these documents have been satisfied with respect
to the subdivision and that I will be able to obtain the
releases of both the Subdivision Control Agreement and the
Covenant in proper form, from the Planning Board at the next
meeting scheduled for August 3 , 1993 .
I would add that my client is in a difficult position; he
has sold his current residence and has no other place to live if
these issues cannot be resolved to a level of comfort which will
allow the closing to proceed. ' He and I greatly appreciate any
assistance you can provide at this juncture.

Dear Ms . Bradley:
Enclosed is the completed Form J Lot Release document which
you gave to Maureen Byrne in connection with her purchase of the
above referenced property. As we discussed, you will be
presenting this release to the Planning Board during your next
meeting, currently scheduled for August 3 , 1993 .
Also enclosed for signature by the Planning Board is a
similar release for the Subdivision Control Agreement relating
to the construction of ways and municipal utilities . Although
we had spoken about obtaining a certification from the town
clerk confirming the acceptance of Quail Run Lane by the Town of
North Andover, I believe that a release will serve the purpose
of clearing the title on this property. Please let me know if
you think the Planning Board will have a problem signing this
document as well . 1f so, I will send up an affidavit for the
town clerk confirming the acceptance of the road.
