SCOTr Director (978)688-9531 Fax (978)688-9542 i MEMORANDUM TO: Timothy Willett,DPW Engineer FROM: Heidi Griffin,Town Planner RE: Drainage Swale on Wild Rose Drive DATE: August 19, 1999 Please be advised that while conducting a site visit on Wild Rose Drive,Brian Lagrasse, Conservation Associate, observed a drainage mate at the end of Wild Rose Drive that was overflowing with silt due to the fact that it has been cleaned out for some time. It appeared to him as if the drainage Swale needs to be cleaned in order for it to fitnction properly,along with the rip-rap and the silt that has overflowed into the wetlands beyond the rip-rap needs to be cleaned also. I I thought I should write you a letter advising you of this because the road has not been accepted yet. In the event that the applicant requests a punchlist for street acceptance in the near future,this item could be placed on the list as outstanding. Thanking you in advance for your cooperation. During our site walk, you pointed out several trees that have rotted and pose a threat to the safety of your house and property. The trees are located within the 50' Buffer Zone, as required under the Definitive Subdivision approval for your neighborhood. The Subdivision approvals restrict cutting and clearing with the 50' Buffer Zone. However, upon review of your property, it is apparent several of the trees are diseased, and one in particular, the large white oak, does appear to pose a safety hazard. I hereby authorize you to remove two of the trees we looked at, one being the small yellow birch, the other the large white oak tree that is completely rotted at the base. In addition, I authorize trimming of the branches of the large red oak to the left of the white oak and the small white oak to the right of the large rotted white oak. The trees to be out should be grinded down to the level of the existing topography. Removal of the root base will cause significant disturbance in the buffer zone and may result in damage to the healthy adjacent tree roots. I recommend two new trees be planted in place, or adjacent to the trees that are being cut. Tree species in the surrounding area consist of red and white oak,yellow birch,red maple and shagbark hickory. Upon tree removal, please notify the Planning Department as to the scheduled date of tree removal. I have enclosed a copy of a section of a foundation as-built plan for your review. The applicant is proposing to (1) modify existing drainage utilities to improve the erosion problems on site; and (2) remove some trees and replace with new ones to alleviate the water issues on site. I reviewed with him the following condition in the PB Decision: "15. Tree cutting shall be kept to a minimum throughout the project in order to minimize erosion and preserve the natural features of the site. The developer shall inform the Tree Warden when tree cutting is to occur. The Tree Warden may pre-approve any major tree cutting.". I believe if whomever the designated Tree Warden is at DPW approves the tree cutting she is all set on that regard. I then reviewed with him the definition of open space as it relates to the PRO Buffer Zone in which the drainage she wishes to improve is located: "Usable open space shall be defined as the part or parts of land within the PRO which are reserved for permanent open space_ This space shall exclude parking areas, but include required setbacks and walkways. The usable open space shall be open and unobstructed to the sky; however,trees, planting, arbor, flagpoles,sculptures,fountains, swimming pools, atriums, outdoor recreational facilities and similar objects shall not be considered obstructions". Clearly this section does not address improvements to the drainage system on lots. However, I feel I might be able to administratively approve this upon conference with the chair of the PB if DPW confirms the drainage improvements would indeed be an improvement and are warranted. Located towards the rear of lot 12 of North Andover Estates there is a 10' Open Space Area. There is a 15' Open Space access easement along with a 50' buffer zone located on lot 19 of North Andover Heights. Should you feel that extensive clearing of this area has taken place within this area, the Tree Warden should be contacted.
