The particular use of the land or structure: Existing gas station and convenience store. B. Circumstances relating to soil conditions,shape or topography of such land or structures especially affecting the property for which the Special Permit is sought which do not affect generally the zoning district in which the property is located: The site is unique in that it is a gas station and needs to properly display the current gas prices. The existing pylon sign currently j has manual prices we propose to install LED prices. The site is located in a General Business zone and is surrounded by other similar businesses. C. Facts which make up the substantial hardship,financial or otherwise,which results from the literal enforcement of the applicable zoning restrictions with respect to the land or building in which the Special Permit is sought: The installation of the LED prices would allow Global Companies, LLC, the owner of the Mobil gas station to change the prices from within the building, Manual price panels, which are permitted within North Andover,MA, require personnel to physically change the prices. The store employees have to change the prices even in rainy, icy or windy conditions; this can be a dangerous feat. Where manual changeable copy signs' letters often become cracked,yellowed, or lost in a matter of months, electronic LED signs' copy will look new for many years to come. D. Facts relied upon to support a finding that relief sought will be desirable and without substantial detriment to the public good: There will be no detriment to the public good; in fact the installation of the on the LED prices will benefit the public to inform there of the current gas prices. The LED price signs will help to improve both day and night visibility and will eliminate several safety concerns associated with manually changing the prices. E. Facts relied upon to support finding that relief sought may be given without nullifying or substantially derogated from the intent or purpose of the ordinance: Granting the variance would not nullify or derogate from the zoning ordinance because the signs in question are not the signs in which the ordinance intended to prohibit. Having the signs manually changed can cause safety hazards to the store employees. Regarding the electronic LED digits these signs are simply price signs that would change periodically as the price of gasoline changes. In fact, they would change just as often as traditional manually changing price digits, only they would have the 3 ability to change remotely. F. NIA I 1 i i 3 3 1
