The Applicant, 1250 Osgood Street LLC, is requesting a dimensional
variance from the front yard setback requirement to allow for construction of an
existing noncompliant sign. A hearing for the variance was noticed and opened
at the ZBA's September 17, 2024 meeting. The Board heard testimony from the
Applicant in support of the application at the September hearing and the matter
was then continued to the October 8, 2024 meeting, in order that the Applicant
may consider revisions to its plans and seek to address certain issues raised by
the Board during the initial hearing.
The Applicant has submitted new signage plans and purpose of this
memo is to outline the changes proposed in response to the various matters
which were discussed at the September 17th hearing, and which have been
addressed with plan revisions, as follows:
1. Type of Sign. The original application and plans contemplated a
"Monument Sign' which is the Applicant's preferred design and
customary at most franchise locations. In response to concerns raised by
members of the ZBA with respect to visibility for exiting traffic, the
Applicant has submitted a revised sign plan which now proposes a
"Pylon Sign' in lieu of the monument design. While the applicant
believes the original design allowed for adequate sight lines, it
appreciates that the pylon sign design may improve visibility for
secondary vehicles in queue when exiting the site.

2. Size of Sign. The newly proposed sign is substantially reduced in size.
Although the overall height of the sign remains at ten feet (10'), the sign
cabinet, panels and composite trim have all been adjusted, such that the
overall width was reduced from eight feet and eight inches (8'8") to six
feet (6.0') wide, and the cabinet face/facade has been reduced from
approximately fifty square feet (50 SF) as originally submitted to
approximately twenty-five square feet (25 SF) as redesigned.
3. Sign Location. The original application and signage plans proposed to
retain the new sign in the same location of the prior existing sign. Based
upon the shape and design of the front landscape buffer, drive aisles and
building, it was determined that the sign could be setback slightly further
from the road by moving it slightly to the south, where it would still
provide sufficient visibility to traffic approaching the site from both
directions (and particularly from the north) without vehicles passing the
access/entrance drives and without also triggering any requirement for
additional variances if it were located within side setbacks. As a result of
the proposed relocation of the sign, the front setback would be increased
to six feet (6.0') from the existing and proposed setback of less than a foot
(ie, 0.21 ), as was shown on the original site plan. As such, the Applicant
would now only require variance relief of 34.0' whereas the initial
proposal sought variance relief of 39.79 .
The Applicant has sought to balance issues raised at the prior hearing
against challenging site constraints as were discussed. The Applicant respectfully
requests that a setback variance be granted for 34 feet to allow for construction of
the proposed sign as shown on the revised plans submitted herewith.
