Dear Members of the Zoning Board of Appeals:
My wife and I are the owners of 20 Marbleridge Rd in North Andover. We are writing in reference to the appeal filed by Lynn and John McLoughlin
regarding the property at 335 Salem St.that would allow for the construction of a single family home on the vacant lot. We were not able to attend the April
11th meeting but did watch it online afterwards, and there were some points brought up at that meeting that we would like to provide further clarity on.
Our backyard connects to the western side of the McLoughlin's property and does contain a wetland resource area that includes a drainage ditch as well as
the ponding area located on the corner of Marbleridge Rd and Salem Street. Water flows through this resource area with even moderate amounts of
precipitation, except in the late summer when the pond dries up. As abutters, we have major concerns about the potential impact that building a single family
home will have on water flow and flooding not only to our property, but to the surrounding properties as well.
Current water flow:The drainage ditch located on our property does begin upstream (from the South) of our property line. We do not know how far
upstream the drainage ditch extends or where the water flow originates further upstream of us, but we do know that water flows from the adjacent property
located at 260 Marbleridge Rd from an extended ditch that also contains a pipe (that helps with the flow of water). Water reaches our property both from the
ditch and the pipe (from 260 Marbleridge) onto the drainage ditch on our property at two different locations.
Additionally,there is a second pipe on our property further down that connects to this drainage ditch that directs the water flow into the ponding area—this
ponding area contains a town culvert pipe that runs under Salem St., but we do not know where the water ultimately ends up. We have attached our own
mark-up of a land plot map provided to us by the Conservation Dept. which is from 1995 when the ditch and pipes were originally installed[Note: We
apologize for the quality of the land plot given the way it was digitized—but we have labeled/highlighted the wetland resource areas and the locations of the
pipes to the best of our abilities.]
It is our understanding that the drainage ditch was installed to prevent flooding issues on the property—something that would definitely occur if the drainage
mitigation was not present. We are aware that this is also a problem further upstream of us as flooding does occur on the property located at 270
Marbleridge Rd.—and whenever there is flooding or water issues that occur upstream, we are directly impacted with increased water flow that overwhelms
the pipe that runs along Salem St. leading to water accumulation on the northern side of our property.
While we sympathize with the McLoughlin's situation, we are very reluctant to support the construction of a building that would most likely affect water flow
and/or flooding around this area. Since our property is downstream on the proposed project, any water issues affecting other properties around this resource
area will eventually affect us.
If members of the board would like more information,they are most welcome to reach out to us to discuss. We are also open to hosting any interested
members for an on-site visit for more clarification. Additionally, we plan to be present at the May 9th meeting to answer any further questions the committee
may have for us.
