of this order unless it is for a maintenance dredging project- subject to Section

13 . In order to provide for the protection of surface and ground water
quality, the following condition Is imposed: the leaching field
must be at least 100 feet from the stream channel . This distance
will be measured from a point on the side slope of the channel at
an elevation of six (6) inches above the invert of the channel . This
requirement must be verified in the field by a representative of
the North Andover Conservation Commission during constructioni and
before the leaching field is backfilled.
14 . In order to provide for the protection of surface and ground water i
quality, the following condition is imposed: the elevation of the E
ground water table within the area of each proposed leaching field
must be verified during March or April and before any construction
begins. This verification must be witnessed by a representative
of .the North Andover Conservation Commission . If it is found that
the elevation of the ground water table is above the elevation shown
on the plan, then construction will not proceed until a new design
for the subsurface disposal system is submitted to and approved by
the North Andover Conservation Commission. i
1?IA. In order to prevent flood damage to the subsurface disposal system,
the finished grade above and within 10 feet of t'he subsurface disposal
system must be at an elevation of at least two (2) feet above the
"crown of the road" .
15 . No' work will take place within 25 feet of the proposed channel until
June 1, 1979 . This date may be changed by the North Andover
Conservation Commission if site conditions warrant .
16 . Upon completion of site grading all areas within 50 feet of the
proposed channel will be foamed and seeded with perennial grasses .
This must be completed before October 1, 1979 , and be approved
by the North Andover Conservation Commission before a Certificate
of Compliance is issued.
17 . Before any construction on Lot Al(AA) three ( 3) erosion check dams
will be constructed perpendicular to the direction of flow in the
original stream and proposed channel . One of these erosion check
dams will be placed in a U-shaped pattern around the inlet to the
culvert under Salem Street . The remaining two ( 2) check dams will
be placed at horizontal distances of 125 feet and 250 feet upstream
from the aforementioned culvert , and have a minimum length of 20
feet each. All the erosion check dams will be constructed in the E
manner outlined in the Notice of Intent and be subject to inspection
and approval by a representative of the North Andover Conservation �
Commission. Before a Certificate of Compliance is issued all accumulated
sediment and material must be removed .

18 . In order to retain a portion of the ground water recharge capacity
which would be lost due to the proposed alterations of the wetlands,
1 and to provide for some measure of erosion and resulting sedimenta-
tion control., also lost as a result of the alteration of the original
! wetlands; a permanent retention area will- be established by 'the con-
struction of a ten(10) foot mide berm 18 inches high across the
proposed channel . The berm shall have a impervious core which will
extend at least two (2) feet below the invert of the channel and said
berm will be suitably stabilized to prevent erosion of the berm.
Location and design details of the berm. to _be approved ,by .the.
Conservation Commission before construction.
19 , In addition to the requirements of Condition No . 10, the applicant
must submit a letter, from the professional who prepared the plans,
certifying compliance with this Order of Conditions . Also an
I as-bui.lt' .topographic plan must be submitted when a Certificate of
Compliance is requested .
20 . All proposed construction must conform to plans referenced in
Condition No . 11 and aforementioned conditions . Any changes in
the plans must be submitted for approval to the North Andover
Conservation Commission before implementation.

12 . All disturbed areas , within 100 feet of wetlands , but exclusive of �k

the paved area , will be graded as close to original elevations and
grades as is possible . No slope will exceed a grade of one ( 1 ) j
vertical to three ( 3) horizontal ,
13 . After rough grading and before any 1 opm is placed ( In accordance with
Conditions No , 14 ) orz the disturbed areas , the site must be inspected
by a member of the North Andover Conservation Commission . The
applicant shall contact the Chairman of the North Andover Conservation
Committee and if a site visit is not made in three ( 3) days , approval
can be assumed to be granted . The Chairman shall designate one
member , which may include himself , to act giving the aforementioned
approval .
14 . Loam to a depth of at least four ( 1 ) inches will be placed on all
pervious areas . All reloawed areas will be planted with grass in
order to re--establish vegetative cover . In addition , at least , fmAy
( 40 ) oversireens greater than eighteen ( 18) , inchcsin height Mill be
planted on disturbed areas , but no closer than ten ( 10) feet from any
paved aria .
