Notice to APPLICANT/TOWN CLERK and Certification of Action of Planning Board
on Definitive Subdivision Plan entitleds INGALLS GROSSING 11

The North Andover Planning Board has voted to APPROVE said plan, subject to the
following conditions:
1. That the record owners of the subject land forthwith execute and record
a "covenant running with the land", or otherwise provide security for the con—
struction of ways and. the installation of municipal services within said sub-
di.visiont all as provided by G.L. c. 410 S. SI-U.
2. That all such construction and installations shall in all respects
conform to the governing rules and regulations of this Board.
3. That, as-required by the North Andover Board of Health in its report to
this Board, no building or other structure shall be built or placed upon Lots
No. as shown on said Plan without the prior
consent of said Board of Health.
4. Other conditions: That as required by the North Andover Board of Health
in its report to this Board, individual septic system permits must be obtained
from the Board of Health prior to the issuance of a building permit under -the
rules and regulations of Title "V" of the State Sanitary Code;
5. That no work shall be done in the subdivision until security in the form of
a bond or covenant has been duly recorded and the plane are signed and recorded;
6. That any changes made to the definitive plan by other town agencies oi' officials
shall be submitted to the Planning Board by the applioant;
7• That the recommendations of the Highway Surveyor's letter dated Sept. 1.01 1979
shall be adhered to as follows; a) that the applicant shall provide a 15 foot road
widening easement on lots "N', & "1" where they abut Ingalls Rd.;
b� Cape Cod berm to be installed where required, to be determined in the field;
e where berm is required, an additional two ft, shall be provided in the width of
the street to aocommodate the berm base;

In the event that no appeal shall have been taken from said approval within
twenty days from this date, the North Andover Planning Board will forthwith
thereafter endorse its formal approval upon said plan.

d) driveway entrances shall comply with Article III, Sec. 11 of the North Andover Town

e) manholes on lots 31 19, 36, and 37 ,shall be constructed as catch basins and aligned
as such;
f) all drainage withithe entire subdivision shall be incorporated into 20 foot drainage
easementsi said easements shall be deeded to the Town of North Andover;
g) any approved. drainage from lots shall be tied into the street drainage system, no
open drain- pipes shall be allowed to drain into road layout area,;
h a ininiujum of 30 inches of cover shall be required over all drain pipes;
i the existing turnaround on Laconia Way shall be lowered as determined in the field;
j any work performed on the streets abutting said subdivision shall require a street
opening permit and a street opening bond;
8. That the hydrants shall be located as shown on said plan except the hydrant located
at approximately station 17+50 shall be re--located to approximately station 1080 in
accordance with the Board of Fire Engineers letter dated August 11 , 1979;
9. That all water improvements excluding the placement of hydrants shall be in accord--
anoe with3he recommendations of the Board of Public Works letter dated Sept. 24, 1979;
10. That a notice of Intent shall be submitted by the applicant to the Conservation
Commission pursuant to M.G.L. Ch. 131 ;
11. That a Certificate of Compliance pursuant to M.G.L. Ch. 131 from the Conservation
Commission shall be required of the applicant prior to the final release of any bond
or covenant;
12. That, prior to paving any of the roads in said subdivision, certification of the
inverts of all inflow and outflow. hea6walls shall be required of the applicant, to be
submitted to the Planning Board; .
13. Construction shall commence within two years from this date and completion shall be
within three years of said commencement.

Dear Sir:
The following petition was heard at a meeting of the Planning Board on Monday evening,
September 10, 1979 in the Town Office Meeting Room at 7:30 P4M* The following members
were present and voting: William Chepulis, Chairmen; John J. Monteiro, Vioe—Chairman;
Joyce A. DiTore; and Michael P. Roberts.
Frank C. Gelinas appeared for the applicant, Andrew Circle Realty Trust, stating that
this proposal contains 2,000 ft. of roadway characterized by a 1-3f slope; serviced by
municipal water; topographical features consist of several high elevations, a brook
network that traverses the property from the north to south and pond lot of 6.2 acres
in area. The 21 lots proposed contain one lot .which was formally a lot on Laconia
Circle. Subdivision located off Ingalls St. and to be known as Ingalls Crossing IS.
Letters from the following tom depts. were read and are on file: Highway, Conservation
Commission, Board of Health, and Fire Chief.
On September 24, 1979 the Board voted unanimously to approve the definitive subdivision,
upon motion of Mr. Monteiro and second by Mr. Roberts, subject to the following condi—
tions:
1) That the record owners of the subject land forthwith execute and record a "covenant
