Page 2-A NORTH ANDOVER CONSERVATION COMMISSION Wetlands Protection Act-Order of Conditions To: Andrew Circle Realty Trust File 242-78 15. No excavation of any material or altering from the area of the proposed pond shall be allowed during and twenty-four (24) hours following a rainfall, if the elevation of the water in the pond is at or above the invert of the outflow structure. 16. The Order of Conditions (242-55) previously issued by the NACC for the proposed pond shall remain in full fource except as amended by this order. 17. The drainage system discharging into the proposed pond must be redesigned so that an elevation of 104.5 may be maintained in the proposed pond. No work may be undertaken except that specifically allowed under Order of Conditions (242-55� , until a new plan -for the drainage system is submitted to and approved by the NACC. Said amended plan to include all necessary calculations and documen- tation showing that the new drainage system will not cause any unnecessary flooding. ' 181 At the same time the plan required under. Condition No. 17 is submitted, a survey plan showing the delineation of the wetlands, as marked in the field, by the NACC' s consultant, will. also be submitted to for approval by the NACC. 19. This Order of Conditions allows only the construction of the roadway and appurtenances including the amended road drainage, but does not include or allow any other topographic changes(' which involve alteration within( 100 feet of wetlands delineated under Condition No. 18 or areas subject to the Wetlands Protection Act. 20. A letter of certification, certifying the elevation of all components of the approved drainage system as constructed in the field (as-built) , must be submitted to for approval by the NACC. , before a binder coat is applied to the roadway. Said certification to be supplied by a registered professional engineer or land surveyor. 21. `�All erosion prevention and sedimentation protection measures found necessary during construction by the NACC will be imple- mented at the direction of the NACC or Highway Surveyor. 22. Any changes in the submitted plans, Notice of Intent, or resulting from the aforementioned conditions must be submitted to the NACC for approval prior to implementation. If the NACC finds, by majority vote, said changes to be significant and/or deviate from the original plans, Notice of Intent or this Order of Conditions to such an extent that the interests of Page 2-B NORTH ANDOVER CONSERVATION COMMISSION File 242-78 Wetlands Protection Act - Order of Conditions To: Andrew Circle Realty Trust 22. (cont. ) the Wetlands Protection Act can not be protected by this Order of Conditions and would best be served by the issuance of additional conditions, then the NACC will call for snot er public hearing within 21 days, at the expense of the applicant, in order to take testimony from .all interested parties. Within 21 days of the close of said public hearing, the NACC will issue an amended or new Order of Conditions. Any errors found in the plans or information submitted by the . applicant shall be considered as changes and the procedures outlined for changes shall be followed. 23. In addition to the requirements of Condition No. 10, the applicant must submit a letter, from the professional who prepared the plans, certifying compliance with this Order of Conditions . Said letter will certify, but not be limited to, the following: a. "As-Built" elevations of all drainage ways constructed within 100 feet of any area subject to the Wetlands Protection Act: b. "As-Built" elevations and grades of all filled or altered wetland areas. c. "As-Built" elevations and grades of all areas altered to provide compensatory flood storage. d. Distances to all structures and alterations within 100 feet of any areas subject to the Wetlands Protection Act. An "As-Built" topographic plan of all areas within the ,jurisdiction of the Wetlands Protection Act must be submitted when a Certificate of Compliance is requested. 24. Compensatory storage must be provided for any loss of flood storage capacity for the 100 year event. Please provide any changes to the NACC for approval . S4 C[f'%'! No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department have been completed. 8.
