The undersigned hereby applies for the approval of said DEFINITIVEplan

Rules and Regulations. The undersigned hereby further covenants and agrees
with the Town of North Andover, upon approval of said DEFINITIVE plan by the
Board:
1. To install utilities in accordance with the rules and regulations of the
Planning Board, the Public Works Department, the Highway Ss o eyor# the
said Tawas,
Board of Health, and all general as well as zoning by—

as are applicable to the installation of utilities within the limits of
Kays and streets;
2. To complete and construct the streets or ways and other improvements shown
thereon in accordance with Sections 1v and V of the Rules and Regulations
of the Planning Board and the approved DEFINITIVE plan, profiles and cross
sections of the same. Said plan, profiles, cross sections and construction
specifications are specifically, by reference, incorporated herein and; made
a part of this application. This application and the covenants and agree—
ments herein shall be binding upon all heirs, executors, administrators,
successors, grantees of the whole or part of said land, and assigns of the
undersigned; and
3. To complete the aforesaid installations and construction within two (2)

SUBJECT t INGALLS CROSSING III -- APPROVED DEFINITIVE SUBDIVISION
DATE JANUARY 21 , 1982
At its January 18 , 1982 regular meeting , the North Andover
Planning Board , upon its own motion , voted to amend Condition
#9 of its approval of the Ingalls Crossing III Definitive Sub-
division Plan by deleting the words 250 feet apart and inserting
the words 500 feet apart .
Please attach this memorandum to your files .
A formal letter of decision is enclosed with Condition #9
correct in its text .

Dear Mr. Long :
The following petition was heard at a meeting of the Planning
Board on Monday evening , November 23 , 1981 at 7 : 30 p . m. in the
Town Office Meetinq Room , The following members were present
and voting : Paul A . Hedstrom , Chairman ; John J . Burke ; Erich
W . Nitzsche ; and Walter R . McDonough .

A motion was made by Mr . , McUonough and seconded by Mr . Nitzsche
to approve " Ingalls Crossing III " with the following conditions
with a completion date of November 1 , 1983 . The vote was unani -
mous in favor of the motion and the meeting adjourned at 9 : 30 p . m .
Conditions - " Ingalls Crossing III "
1 . That the record owners of the subject land forthwith execute /
and record a "covenant running with the land " , or otherwise
provide security for the construction of ways and the install -
ation of municipal services within said subdivision , all as
provided by G . L . c . 41 , S . 81-U .
2 . That all such construction and installation shall in all re-
spects conform to the governing Rules and Regulations of this
Board .
3. That , as required by the North Andover Board of - Health in its
report to this Board , that individual septic system permits
must be obtained prior to the issuance of a building permit
from the Board of Health under the Rules and Regulations of
Title "V" of the state sanitary code ; and that the developer
shall , prior to the s6l.e of individual lots to individual
owners , submit to the Board of Health percolation tests showing
the suitability of said lots for the installation of sub -
surface disposal systems for single family dwellings ; however ,
such restriction shall not prevent the mortgage of sai.d lots
or the sale to developers or home builders against whom this

condition shall also remain applicable and enforceable until
complied with .
4 . That no work shall be done in the subdivision until security
in the form of a bond or covenant has been duly recorded and
the plans are signed and recorded .
5 . That any changes made to the definitive plan by other town
agencies or officials shall be submitted to the Planning
Board by the applicant for approval .
6 . All street trees shall conform to the Tree Warden ' s speci -
fications .
7 . No earth removal shall be allowed other than that which is
defined as incidental to Development and Construction as per
Section 5 . 6 , Paragraphs 1 and 2 of the North Andover Zoning
By-Laws , unless and until application is made and a permit
is issued for Earth Removal by the North Andover Board of
Appeals pursuant to Section 5 ( 5 . 1 through 5 . 9 inclusive )
of the North Andover Zoning By-Laws .
8. A Notice of Intent shall be filed with the North Andover Con -
servation Commission pursuant to said Commission ' s Determina-
tion of Applicability of the W . P . A . G . L .. Ch . 131 , Section 40 ,
dated November 18 , 1981 .
9 . In accordance with the Fire Chjef ' s letter dated November 23 ,
1981 , fire hydrants shall be placed no greater than 500 feet
apart .
10. In accordance With the Tree Warden ' s letter dated November 6 ,
1981 , a bond in the amount of $10 ,000 . 00 shall be retained to
enforce the street tree regulations .
11 . All water improvements shall be inaccordance with the Board of
Public Works ' s letter dated November 20 , 1981 . Additional
hydrants shall be installed at Stations 0 + 30 and 4 + 85 .
12 . In accordance with the Highway Surveyor ' s letter dated Novem-
ber 23 , 1981 :
a ) Hottop thickness shall consist of 2 " of binder and 1Z "
of topcoat finish ;

b ) The arch pipe shown on plan shall be a class 4 concrete
pipe and shall have a minimum of 30" of cover ;
c) Cape Cod berms to be installed where necessary - to be
determined in the field . Where berms are required , road
shall be widened 4 ' to accomodate gravel and hottop
widths ;
d) Any drainage problems encountered in the field shall be
incorporated into drainage system and shall be shown on
the "As Built " plans ;
e ) Catch basins shall be 8" precast concrete units with
cone tops . Four flange 6 " check board type frames and
grates shall be used . ;
f) All drain pipe shall be reinforced concrete ;
g ) Sub-drains shall be required when and where necessary to
be determined in the field and shown on the "As Built "
plans ;
h ) Drainage and other easements shall be fully dimensioned
on plan ; easements shall be submitted in recordable form
and shall be submitted prior to Planning Board ' s endorse -
ment of plan ;
i ) A siltation and erosion control plan and __a maintenance
plan shall be submitted prior to construction ;
j ) Driveway entry permits shall be obtained from the Highway
Surveyor ;
k ) Developer shall use Inspection Sheet of the North Andover
Planning Board ;
1 ) No drainage hottop or utility work shall occur between
the first of December and the first of March unless of an
emergency nature and permitted by the Highway Department .
13. The intersection of Forest Street and Kelefa Road shall be
submitted in detail and shall include edges of pavement ,
existing right--of-way limits and existing drainage .
14 . Size of all drain pipes shall be shown on plan .
15 . Location of New England Power Company utility poles shall be
shown on plan .
16 . Prior to any construction , the developer shall submit to
the Planning Board that clearance from the roadway has been
assented to by New England Power Company .
17 . If proposed subdivision is to be constructed in phases , separate
completion dates shall be imposed for each phase as they are
initiated .

18. Binder coat shall be applied no later than November 1 , 1982 .
19 . All improvements in said subdivision shall be completed no
later than November 1 , 1983 .
20 . The completion of Laconia Circle shown on Definitive Plan of
Land Ingalls I shall be the responsibility of the developer of
the Ingalls Crossing III Subdivision . A bankbook in the amount
of $9 , 500 . 00 shall be posted along with an agreement between
Andrew Circle Realty Trust and the Town of North Andover to
complete said Laconia Circle .
21 . The lot frontages on Ingalls Crossing III for proposed lots
22 and 23 shall be adjusted to ensure 150 ' frontage for
lots 10 and 1.1 , ' Laconia Circle , which otherwise will not have
proper frontage whbn cul -de-sac is eliminated
22 . Laconia Circle shall be cleared of all debris no later than
April 1 , 1982 , or in any case , prior to any other construction .
23. The New England Power Company easement shall be shown on a
200 foot- scale index plan .m
Notes ;
1 . The applicant should be aware that a letter was received from
the North Andover Conservation Commission dated November 10 , 1981 .
2 . The applicant should be made aware that the drainage from his
property should not create an adverse impact on anyone else ' s
property .

Date: February 28, 1983
On November 23, 1981 in the Town Office Meeting Room, the North
Andover Planning Board voted unanimously to approve the subdivision
known as "Ingalls Crossing III" with the following conditions with

Located in North Andover, MA" , by Frank C. Gelinas and Associates,
Inc. , dated October 22, 1981 and revised Marchl2, , 1983 . The
following conditions are contingent thereto:

By--Laws, unless and until application is made and a permit
issued for Earth Removal by the North Andover Board of
Appeals pursuant to Section 5 (5.1 through 5. 9 inclusive) of
the North Andover zoning By�Laws.
8. A Notice of Intent shall be filed with the North Andover '
Conservation Commission pursuant to said Commission' s
Determination of Applicability of the W.F.A. , G.L. Ch. 131,
section 40, dated November 1981 .
9. in accordance with the Fire Chief ' s letter dated November 23,
1981, fire hydrants shall be placed no greater than 500 feet
apart.
10. In accordance with the Tree Warden' s letter dated November � 6,
1981, a bond in the amount of $10, 000. 00 shall be retained to
enforce the street tree regulations.
. ll. All water improvements shall be in accordance with the Board of
Public Works letter dated November 20, '1981 .
12. In accordance with the Highway Surveyor ' s letter dated
November 23, 1981:
a) Any drainage problems encountered in the field shall be
incorporated into drainage system and shall be shown on
the "As-Built" plans;
b) Sub--drains shall be required when and where necessary to
be determined in the field and shown on the "As-Built"
plans;
-._ ., c) Drainage and other easements shall be fully dimensioned
on plan; easements shall be submitted in recordable form
and shall be submitted prior to Planning Board' s endorse-
ment of plans .
d) A siltation and erosion control plan and a maintenance
plan shall be submitted prior to construction.
e) Driveway entry permits shall be obtained from the Highway
Surveyor .

f) Developer shall use Inspection Sheet of the North Andover
Planning Board--
g) No drainage hot top or utility work shall occur between
the first of December and the first of March unless of
an emergency nature and permitted by the Highway Department.
13. Prior to any construction, the developer shall submit to the
Planning Board that clearance from the roadway has been
assented to by New England Power Company.
14. If proposed subdivision is to be constructed in phases,
separate completion dates shall be imposed for each phase
as they are initiated.

DEFINITIVE SUBDIVISION
INGALLS- CROSSING III

On November 23 , 1981 in the Town. Office Meeting Room, the North
Andover Planning Board voted unaminously to approve the subdivision
known as "Ingalls Crossing III" , as shown on a plan entitled,
"Definitive Subdivision Plan of Land of Ingalls Crossing III,
Located in North Andover, MA",, by Frank C. Gelinas and Associates,
Inc. , dated October 22, 1981 and revised March 3, 1983. The
following conditions are contingent thereto:
Conditions - Ingalls Crossing III
1 . That the record owners of the subject land forthwith execute
and record a "covenant running with the land" , or otherwise
provide security for the construction of ways and the instal-
lation of municipal services within said subdivision, all as
provided by G.L. c. 41, S. 81--U.
2. That all such construction and installation shall in all
respects conform to the governing Rules and Regulations of
this Board.
3. That, as required by the North Andover Board of Health in its
report to this Board, that individual septic system permits
must be obtained prior to the issuance of a building permit
from the Board of Health under the Rules and Regulations of
Title "V" of the state sanitary code; and that the developer
shall, prior to the sale of individual lots to individual
owners, submit to the Board of Health percolation tests
showing the suitability of said lots for the installation of
subsurface disposal systems for single family dwellings;
however, such restriction shall not prevent the mortgage of
said lots or the sale to developers or home builders against
whom this condition shall also remain applicable and enforceable
until complied with.
4 . That no work shall be done in the subdivision until security
in the form of a bond or covenant has been duly recorded and
the plans are signed and recorded.
5 . That any changes made to the definitive plan by other town
agencies or officials shall be submitted to the Planning Board
by the applicant for,,!approval.

6. All street trees shall conform to the Tree Warden ' s specific-

7. No earth removal shall be allowed other than that which is
defined as incidental to development and construction as per
Section 5. 6, Paragraphs 1 and 2 of the North Andover Zoning

between Andrew Circle Realty Trust and the Town of North
Andover to complete Laconia Circle.
