BACKGROUND

On October 6,2009,the Planning Board approved a Definitive Subdivision flan so as to construct a
three-lot subdivision, including the existing housing on the existing lot,two driveways, the installation of
stormwater management infrastructure, the installation of underground utilities,connections to existing
water and sewer service and substantial grading in the R-2 Zoning District. !!

FACTS
The Applicant requested the removal of Condition #7 from the "Prior to the Issuance of a Certificate of
Occupancy" section of the approved permit. Prior to the construction of the dwellings, the Applicant
consulted with the Town of North Andover File Prevention Lieutenant and learned that Fire Prevention 780
CMR does not require the installation of residential fire sprinklers in a single-fancily dwelling. Fire
Prevention provided confirmation that the dwellings conform to 780 CMR(see email correspondence from
Lt. Michael Beirne dated August 19,2019).
After a discussion with Monica Gregoire, Staff Planner,the Applicant requested a Minor Modification to
the Notice of Decision Definitive Subdivision Plan in order to remove Condition#7 requiring the homes
built on Lots 2 and 3 to be equipped with home sprinkler systems from the October 6, 2019 permit.
DECISION
After discussion at the August 20, 2019 Planning Board meeting, and upon a motion by 7.Sinnons and 2nd by
K.Bargnesi,the Planning Board voted unanimously 4—0 in favor to approve the Minot•Modification request
for LRC,Builders,LLC with the following conditions: {

CONDITIONS
1. The Development must be in compliance with respect to fire protection systems required for
occupancy by the residential building code 780 CMR.
2. This Decision shall be recorded with the Northern Essex Registry of Deeds and evidence of
recording shall be provided to the Planning Department.
