The Planning Board hereby denies the Special. VermU under
Section 10 . 3 and 10 . 31 of the forth Andover toning Bylaw for LO
purposes of allowing the accessing of lots by driveways as shown on
Definitive Subdivision of Land ®Woodchuck Grove" which Plan is recorded
in the forth Essex Registry of Deeds as Flan Number The
Board finds that it is premature at the current time to grant these
applications . The Planning Board cannot, adequately assess whether
driveway access over adjoining Lots is reQuired in order to preserve the
existing contours of the land since no construction of the roaduay;s ,
utilities, etc . has yet commenced . If acLual field conditions ( al ur
road construction occurs ) suggest; that such driveway access is
appropriate the Planning Board would be willing to review the
applications at that time . The Board farads that Woodchuck Grove as a
project, is not an appropriate location for such a condition co be
applied at the current time ; the permission as granted may adversely
affect the neighborhood; it may create a nuisance or serio"s hazard to
vehicles or pedestrians ; and , the allowance of the condition is not;
necessarily in harmdny with the general purposes and intent, of the Horth
Andover Zoning Bylaw.
