He was notified of the Conservation meeting through certified mail and signed for the green card in May of 2002. The legal notice did not state a specific size for the substation. After review of my files and review of the Planning Board decision, it is my opinion that the Planning Board decision may have been misleading. The decision does state construction of a 528 s.f. equipment enclosure. This 528 s.f, only pertains to the proposed small utility building, not the entire substation network. The Notice of Intent application propdses a 35,670 s.f electric substation which includes the utility building and substation infrastruch.rre. Also included under the filing is the clearing for the tap lines and driveway construction. This is a pretty extensive project with a significant amount of clearing. The project does propose grading and leveling of hills. During the ZBA process, the Board required the driveway up to the substation be enclosed by a fence. The driveway and the entire substation infrastructure { will be enclosed with permanent fencing. I am unaware if this gentlemen attended the Conservation meetings to inquire about the project. I suggest he come into the office to review our files. To date, I am unaware of any major problems or deviations from our approved plans. I have been on site several times and this Department continues to review the weekly monitoring reports. Keep in mind, prior to this project being filed with Conservation, an extensive third party review was conducted by Seekamp Environmental to review the project for compliance with state and local regulation. Upon my employment with the Town, I worked with the applicants and suggested they file the design which was presented to and approved by all the Town Boards.
