The application was submitted by George Hughes of leffco Inc.P.Q.Box 802,Andover, MA 01810 dated September 23, 1999. Finding of Fact The Planning Board makes the following findings as required by Section SB Review Standards for Preliminary Plans as set forth inn the Rules and Regulations Govenung the Subdivision of Laud, North Andover,Massachusetts,Revised February 1989: A. The Preluzunary Plan adheres to all of the design standards indicated in Section 7 of the Subdivision Rules and Regulations except as noted below. Use Planning Board was ratable to satisfactorily review these issues as the applicant opted not to have the plait reviewers Av all outside engineer. Therefore, the Planning Board is unahle to determine if the plan complies with this section without the proper engineering review. B. The Preliminary Plan complies with the review comments submitted by the Town Planner in order to comply with state law, town bylaws, and protect the public health, safety, and welfare of the Town except as noted below. Lots 7 and 8, as depicted of the plan, would be non- conforming as the structures depicted on these lots(specifically the gazeho and shed) would not conform with Ilse rear setbacks required by zoning. The Plant noes not conform with the zoning bylaw. As the applicant has failed to follow the procedures and provide the information required by the Rules and Regulations as demontrated by the Findings of Fact the Planning Board herein DENIES this application for a preliminary subdivision plan. 1.
