Conservation Commission Meeting Minutes
January 12, 2005
Members Present: Scott Masse, Chairman, and Albert Manzi, Jr , Vice Chairman,
Deborah Feltovic, and John J Mabon, Sean F McDonough

Meeting came to Order at: 7:05pm Quorum Present.
General Business
242-1219,Modification & COC, 1112 Turnpike Street Ferragamo)(New England

The applicants Mr & Mrs Ferragamo and Ben Osgood of New England Engineering
Services, Inc were present Ms Merrill stated on Monday, January 10, 2005,
Conservation Staff met with Leah Basbanes at 1112 Turnpike Street to re-establish
wetland flags A-2 and A-3 The measurements were taken in the field from new wetland
flags to several locations The new A-2 left side of grill 51 9', New A-2 to fence post
51 2',New A-2 to pool filter 53' The revised as-built plans were submitted to show
field and measurements changes The site is in conformance with the NACC regulated
setbacks A motion to issue the modification was made by Mr Manzi, seconded by Ms
Feltovic Unanimous A motion to issue the COC and bond release was made by Mr
Manzi, seconded by Ms Feltovic Unanimous
Enforcement Order Ratification
Raleigh Tavern Lane DPW Project water main break.
Ms McKay stated a silt fence was installed the area was hand cleaned up the Town of
North Andover was fined $ 100 00 there was a huge impact to the area Mr Manzi stated
I want to keep record of all Enforcement Orders issued to DPW last year and this year In
the next 3 months the Conservation Commission will be in a battle A motion to ratify the
Enforcement Order was made by Mr Mabon, seconded by Mr Manzi Unanimous
Agricultural Leases
Mazurenko Farm
Ms Merrill stated she created some drafts from the old forms for Agricultural Use
License Mr Manzi reviewed the drafts wanted some changes # 14 add the North
Andover Wetland Protection By-Law(Chapter 178) Under License fees change from$
20 00 per hour to $ 50 00 per hour Mr Manzi stated the Conservation Commission
would require soil testing prior to May 1, to make sure the soil has the proper lime and
fertilizer in the soils Must submit a report of the results to the Conservation Commission
once a year Other than those changes you did a good job
Foster Farm
Ms Merrill stated this is a draft for Agricultural License for Foster Farm Mr Manzi
stated just make some minor changes on the Drafts and mail them out to whom ever is
interested in doing the work
The Conservation Commission did the Decisions before the Public Hearings.

A motion to accept the Order of Conditions as drafted and to set the Bond amount at $
1,500 was made by Mr Manzi, seconded by Ms Feltovic Unanimous

Ms McKay stated some of the conditions in the Order of conditions As-Built foundation
plans, extra hay bales on site 50, a wall extension on Lot 2, stormwater management
reports for two years, post construction no-run of into neighboring properties per
Abutters request, a wetland scientist approved by The Conservation Commission, an
environmental monitor on site in a storm event,the trash guard to be installed, the condo
association would be responsible for the stormwater structures for eternity, if rainfall
every 2 weeks have the silk sacks cleaned, buffer plantings per Abutters request, catch
basins cleaned when 6 inches of sediment in them, bond amount $ 20, 000 A motion to
accept as drafted the Order of Conditions and set the Bond amount at $ 20,000 was made
by Mr Mabon, seconded by Mr Manzi Unanimous

The applicant Michelle Harrison and Ben Osgood of New Engineering Services, Inc
were present Ms McKay stated no comments from DEP, all set to close A motion to
close and issue a decision in 21 days was made by Mr Manzi, seconded by Ms Feltovic
Unanimous

Ben Osgood of New England Engineering Services, Inc and Abutter Dennis Kard were
present Mr McDonough read the legal notice Ms McKay stated the filing is for the
construction of a 24' x 20' addition to an existing single-family dwelling with associated
grading in the buffer zone to a bordering vegetated wetland The wetland resource area is
just off property to the north of the lot on the Lawrence Airport Property All, work
including grading, is proposed outside of the 50-foot No Build zone The limit of work
(erosion controls) is proposed 55-foot from the resource area The plan depicts a soil
stockpile area to the rear of the dwelling behind the proposed addition and is in a suitable
location The access for construction has not been depicted on the plan or noted in the
NOI It is strongly recommended that access for construction be conditioned for this
project The area immediately adjacent to and along the driveway is steeply sloped and
access by this route could result in impacts to the resource area The access from the side
of the lot where the work is proposed is feasible The Boilerplate condition in Order No
dumpster allowed in within the 50-foot of resource area The staff recommends additional
language in this condition if approved so the dumpster is not stored within the limits of
the existing driveway The records in the building file, specifically a Plot Plan dated
August 1, 1983, appear to indicated that the existing in-ground pool prior to the Bylaw
regulations No building or conservation permits were found for the pool, to indicate
whether the pool was subject to the state Act A building permit was issued for the Deck
in May of 1991 No form U sign off was found with the building permit application No
conservation filing was found for the deck A 12 '/2' x 10' shed on concrete blocks exists
off property on the Airport Property and is immediately adjacent to the resource area No
building permit was found for the shed The wetland boundary was reviewed The staff
believes that the wetland may actually extend through portions of the shed and does not
agree with the location of the wetland Flag A4 It was difficult to accurately determine at
the time of my inspection, since there were several inches of snow cover and since I
could not auger any soils beneath the shed The vegetation was not the best indicator in
this location The topography and soils surrounding the shed better indicated that the shed
might be in fact within the resource area It appears that the shed is being used to store
chemicals, ect The staff is concerned that the pool waters are being discharged into the
resource are No further comments Mr Osgood stated the shed would have to be

removed and the yard waste and grass clippings would have to be removed Mr Mabon
stated the discharge water from the pool could be damaging the wetland area Mr Manzi
stated they would not have to re-pipe the dram just flex hose with an extension to direct
drain away from the wetland area A motion to close and issue a decision in 21 days was
made by Mr Manzi, seconded by Ms Feltovic Unanimous
A motion to adjourn the meeting at 9:30pm was made by Mr. Manzi, seconded by
Mr. Mahon. Unanimous.
