HomeMy WebLinkAbout1997-07-16 Conservation Commission Minutes Conservation Commission Minutes DPW Conference Room July 16, 1997 i Members Present: Joseph W Lynch, Jr., Chairman, Albert Manzi, Jr, Vice Chairman, Joseph Mottola, Scott Masse, Beth Wescott and John Mabon were present Robert Mansour and Deborah Feltovic were absent Staff Present: Michael D Howard, Conservation Administrator and Richelle Martin, Conservation Assistant Karen A Fitzgibbons, Secretary was absent The meeting was called to order at 7 05 p in Minutes: July 2, 1997 No Action Taken General Business: #242-831 -COC Lot 1 Forest Street Extension (John Kentel) There has been no work that has taken place at this lot,the neighbor bought the land and will allow the land to stay in it's natural state The lawn is now stabilized after re-grading has taken place On a motion by Mr Manzi, seconded by Mr Masse, the Commission voted unanimously to set the bond amount at $3,000 PRESENTATION -Land Under Water(R Martin) Ms. Martin gave a presentation to the Commission about land under water DONATION- Time &Materials 2 Mazurenko Farm (B Barrett) Bill Barrett of Colonial Village, was present to speak to the Commission about his donation to Mazurenko Farm Mr Barrett is offering to donate his time and his materials to install bird and bat boxes at Mazurenko Farm In return,Mr Barrett would like to ask the North Andover Conservation Commission to allow PR in the newspaper to promote his business On a motion by Mr Manzi, seconded by Mr Mottola,the Commission voted unanimously to allow Bill Barrett to put PR in the newspaper Public Hearings (8:00 p.m.) Request(s)for Determination of Applicability RDA -Lot S Saile Way Great Pond Estates (Dennis Quintal, P E) The property is a 2 5 acre lot with the wetlands flagged on the property. SFH proposed 100' BVW There is no disturbance to the wetlands The unclassified isolated wetland would not be affected by construction of a home The roadway into the development has been paved already Mr Manzi asked if the isolated wetland was hydraulically connected to across the street Mr. Quintal replied there was no connection hydraulically Mr Howard agreed with Mr. Quintal. The roadway and utilities have open order and are under construction The water sampling has just started and the samples were forwarded to the lab and the results will be submitted as soon as they are ready The pre- construction inspection erosion control to be installed prior to construction On a motion by Mr Manzi, seconded by Mr Mattolla, the Commission voted unanimously to issue a negative determination of applicability for Lot 5 Salle Way RDA -#675 Forest Street(John Lennhoff/Steven D'Urso) They are proposing to construct an addition to an existing home 80' from BVW The delineation was approved on July 15, 1997 by the Conservation Department The work proposed is not likely to impact the wetland There was a pre-construction inspection done by Ms Martin and the erosion control will be installed prior to construction Mr Howard stated that he has no issues and that there were no abutters present The applicant will submit proof of mailing to Mr Howard prior to construction On a motion by Mr Manzi, seconded by Mr Mattola, the Commission voted unanimously to issue a negative determination of applicability for 675 Forest Street RDA - Lots 38, 44 & 46 Summer Street(Copley Dev Corp/Wetlands Preservation, Inc.) This filing is to confirm the wetland line only The applicant has submitted proof of mailings and are 0K J . f Curt Young,of Wetland Preservations Inc was present to represent the Mandry property The primary buildable pieces of land along Summer Street The point of land behind Cricket Lane also buidable, there is a BVW on that portion of the property The plans that were submitted on July 16, 1997 were according to Mr Howard's field delineation Wet meadow,pond, forested wetland meadow has been cut Soil analysis was used for delineation. Most wetlands are easily defined by topography There is a high water table. Mr Lynch educated the public on RDA's and why the proposal is before them tonight on the wetland line only Santo Bonafolka of 68 Cricket Lane, wanted to know where lots 38, 44, 45 & 46 are located in the field Steve Stapmski clarified the issues Mr Laudam& Mr Stapinski clarified lot and acreage issues Karen Kline raised an issue of where the pond was on the plan The pond is indeed on the Mandry property The following flags are on abutters land and are not approved. B 1, B2, B5, C47 - C50& C99. On a motion by Mr Manzi, seconded by-Mr Mattolla,the Board voted unanimously to issue a positive determination of applicability for Lots 38, 44, 45 & 46 Summer Street. Notice of Intents) NACC #6 Lot 2 Salle Way Dennis Quintal ,P E Dennis Quintal was present to represent Lot 2 Salle Way A Notice of Intent was filed seeking authorization to construct a single family dwelling within the Buffer Zone of a local wetland resource area The wetland resource areas were confirmed under the roadway filing and are accurately depicted on the submitted plans The necessary appurtenances are more than 100' from the BVW Under the driveway,the culvert will connect hydrologic areas The applicant is proposing 25' no disturbance zone waiver where the driveway enters the property Mr Mabon asked a question about the unclassified drainage area on the plan This wetland is subject to local jurisdiction only The hydrological connections between drainage areas are not really of concern to the Commission Mr Howard asked why a retaining wall could not be constructed and Mr Quintal stated that a wall could be constructed Mr Howard suggested meeting with Mr Quintal to see if a pipe is warranted on this property Then Mr Howard will come back with a recommendation to the Commission Mr Howard stated that a gravel driveway or a grass swale may be appropriate for driveway runoff Discussion continued until August 6, 1997 DEP 4242-871 Lot 1 Dale Street MPG Realty Corp (Wetlands Preservation, Inc) Kerry McCollister, 206 Dale Street, spoke before the legal notice was read He stated that this project should not be on the agenda per Bob Halpin because Jeff Smith if the guardian not the owner of the property Mr Howard stated that no such issue was brought to his attention. Mr Lynch stated that under 310 CMR 10 54 4 (a) stated that any person can propose to fill, dredge, remove, etc not only the owner of the property Mr Lynch banged the gavel, asked Mr. McCollister to not speak of this issue again or he would be removed from the meeting Mr. McCollister raised the same point again' Mr Manzi, a State Trooper in the real world, was authorized by Mr Lynch to escort Mr McCollister out of the building The time was 9 15 pm. Curt Young, Wetlands Preservation, began his presentation The applicant is proposing a seven lot subdivision within the Buffer Zone of a BVW The site lies within the limits of the watershed,therefore, it has 150'/75' setbacks per the Planning Department The no disturbance zone will be disturbed per the best practical measures and yards for landowners. Curt Young submitted drainage calculations A study was conducted on water quality issues Silt from spring rains will drain into deep sub catch basins The applicant needs to make modifications on the topography and grading Mr. Howard asked Ken Grandstaff if he wanted to get three prices for drainage review, and Mr Grandstaff replied it is okay to hire John Chessia The stream is not subject to the Rivers bill Subject to be reviewed under DEP's storm water management. Dan Takesian, 198 Dale Street, questioned the possible overflow of water onto his property if the wetlands are filled in Mr Lynch told him that all of this drainage will be reviewed by John Chessia Dave Rand, 280 Dale Street, spoke of his pond and flooding issues that have been ongoing for years Mr Rand would like the engineers to enter the surrounding properties so he can show them what is happening with water entering the proposed subdivision On a motion by Mr Manzi, seconded by Mr Mottola, the Commission voted unanimously to require the applicant to establish a$5,000 escrow account to cover the cost of drainage reviews On a motion by Mr Mottola, seconded by Mr Manzi,the Commission voted uammously to continue the public hearing until 8/6/97 A site walk will be scheduled at that meeting DEP #242- Lot 1 Sutton St(Lawrence Airport Comm) Merrimack En mg eenng Services Steve Stapmski, Merrimack Engineering, was present representing the applicant The runway is in need of repairs due to age, weathering, plowing, etc The taxiways are over designed—twice as large as necessary They will need a 25' no disturbance zone waiver, because the lights need to be relocated The lights are now within 20' of the wetlands The taxi lights are to be removed by hand Conduit will remain in place, lights will be removed and relocated Mr Howard asked Mr Stapinski several questions regarding the filing On a motion by Mr Manzi, seconded by Mr Mottola,the Commission voted unammously to continue the public hearing until 8/6/97 Decisions: DEP #242 -870 Boston Ski Area k 1275 Turnpike Street(P Seekamp) Mr Howard had a draft Order of Conditions prepared for the Commission to review On a motion by Mr Manzi, seconded by Mr Mottola, the Commission voted unanimously to approve the Order of Conditions for Boston Ski Area as drafted DEP #242 - 869 Lot#13 Brookview Estates Subdivision(D Kindred) Mr Howard had a draft Order of Conditions prepared for the Commission to review On a motion by Mr Masse, seconded by Mr Manzi,the Commission voted unanimously to approve the Order of Conditions as drafted for Lot 13 Brookview Estates Subdivision DEP #242 - 868 Lot 1 Brookview Estates Subdivision(D Kindred) Mr Howard had a draft Order of Conditions prepared for the Commission to review On a motion by Mr Mottola, seconded by Mr Manzi,the Commission voted unanimously to approve the draft Order of Conditions for Lot 1 Brookview Estates Subdivision.
