Members Present: Albert Manzi, Jr , Vice Chairman, Robert Mansour, Scott Masse,
John Mabon and Beth Wescott Deborah Feltovic was absent and Joseph Lynch, Jr ,
Chairman, arrived at 7 03 pm
Staff Present: Michael D Howard, Conservation Administrator, Richelle L Martin,
Conservation Associate and Karen A Fitzgibbons, Secretary
The meeting was called to order at 7 00 pm and Mr Manzi was the acting chairman as
Mr Lynch was going to be a little late

On a motion by Mr Masse, seconded by Mr Mansour, the above listed minutes were
unanimously approved
General Business:
242-158 PCOC Lot 25A#65 Blue Ridge Rd (Sheila Manzana)
Ms Martin stated this is a 76 lot subdivision built in 1982 with no wetlands within 100
feet Mr Howard stated this is merely just administrative to clear the title On a motion
by Mr Masse, seconded by Mr Mansour, the Commission voted unanimously to issue a
Partial Certificate of Compliance on the property
242-816 Modification to OOC Campbell Forest Sub (McKenzie Eng Croup)
(It is 7 03 pm and Mr. Lynch just arrived to take over as chairman)
Erik Heyland,Ken Grandstaff and Elmer Pease were all present The plans from the last
meeting were withdrawn and Mr Howard distributed two sets of the revised plans for the
Commission's review Mr Heyland stated that since the last meeting the plans have been
reproduced and the sewer added by hand The layout of the sewer on the these plans are
pretty much the same Lots 5 and 10 are outside of the 25' no buffer zone This filing,is
a modification with no waiver requests The limit of the sewer at the cul-de-sac is still
outside the 25' no disturbance zone Mr Lynch stated this plan now shows the sewer
overlay Mr Manzi wanted clarification that this is just inside the subdivision and Mr
Heyland stated that's correct the sewer will end at the right-of-way at the end of the cul-
de-sac Mr Grandstaff stated they would like to begin construction as soon as possible
Mr Lynch stated Conservation's modification record copy will be the V Cantone

stamped plan and the Commission will need a parallel plan with his name Mr Mansour
expressed concern about the wetland lines not being on the plan Mark West stated that
in the field they found things to be accurate and lined up correctly Mr Heyland stated an
independent survey group was hired,they took pictures and were found to be accurate
within inches Mr West stated that we went out to the site, roughed out the construction
replication areas,mulched banks, stockpiled soils and viewed the erosion control The
plant materials for the replication areas has been ordered and the contractor will be out
next week to complete Salem Street will be seeded next week and it is being done in
compliance with the Order of Conditions Mr Lynch stated to Mr Heyland to give Mr
Howard a locus of the area with the new street names In order to give Mr Howard time
to review the plan it was suggested the public hearing be continued until May 20, 1998
Mr Lynch wants the utilities shown near the resource areas on the jurisdictional lots Mr
Manzi made a motion, seconded by Ms Wescott,to continue the public hearing until
May 20, 1998 Mr Lynch called for discussion and Mr Masse stated he has a problem
with the plan(same as Mr Mansour) and the fact that there is a problem with stamping
the plan Mr Heyland stated in order for someone to sign off they would have to re-do 32
lots and that's a monstrous effort for a modification Mr Lynch stated the Commission
could make the applicant do that, however, it seems unnecessary Mr Manzi stated he
understands Mr Masse and Mr Mansour's concern, we don't want to be hit with a
disclaimer later The vote was called on Mr Manzi's motion to continue the public
hearing until May 20, 1998, and it was unanimous
Discussion of Warrant Articles
Mr Howard passed out to the Commission the amendments that will need to be made at
Town Meeting regarding the bylaw Mr Lynch will move the article on behalf of the
Commission and Mr Howard will have 5 or 6 bullets for him Mr Masse will move
Article 40 and the Renshaw property will have a power point presentation Foster Farm
will be presented by the Open Space Committee and School Committee

242-905 Lot 14B Rocky Brook Rd (Ogunquit Homes)Neve Associates
Ms Martin had a draft Order of Conditions for the Commission to review On a motion
by Mr Mansour, seconded by Ms Wescott, the Commission voted unanimously to
approve the Order of Conditions as drafted
Mr Lynch gave the Commission an update on Meadowood III, stating that there are
clashing factions out there and the homeowners and developers are equally responsible
for compliance The homeowners won't let the equipment on their property Mr
Howard stated the Commission has only approved the restoration plan that has been
completed Mr Howard to place this item on the next agenda

Lot 71, Winter Street (Santo &Anne Messina)Hancock Eng cont fr 4115198
Mr Howard has reviewed the new plans with the 8 flags added The work is 100' away
from the wetlands Mr Howard recommended a Positive Determination of Applicability
be issued Mr. Manzi made a motion, seconded by Ms Wescott,to issue a Positive
Determination of Applicability for wetland flags 23 thru 48 referencing the plan of record
dated revised 4/27/98 The motion was passed unanimously
55 Camden Street (Jean &John Enright) New England Engineering Services
Ben Osgood, Jr was present and gave proof of mailing to the Commission The property
is located on Wayne Street with the house across from the DPW garages The home is
accessed from Wayne Street with Camden Street a private drive undeveloped Mr
Osgood stated no cutting of trees will be done,just taking out the vegetation and putting
in a driveway so the homeowners don't have to deal with DPW traffic on Wayne Street
Mr Howard stated there are two tiny wetlands with no impact, therefore he recommends
a Negative Determination with a pre-construction meeting for erosion control Richard
Slipkowsky was present on behalf of his mother and expressed concern regarding the low
land creating a pond His mother doesn't want any more water in the area Mr Osgood
stated the grading will be elevated Mr Lynch stated to Mr Slipkowsky that you have
72' and what is being proposed won't have an impact on your mother's property Mr
Osgood stated he kept the driveway at the same level as it is now behind the auto body
shop Mr Lynch stated what is proposed is more beneficial to a resource area On a
motion by Mr Manzi, seconded by Mr Mabon, the Commission voted unanimously to
issue a Negative Determination of Applicability with haybales and a pre-construction
meeting with the Conservation Department
Bradford Street, Map 62 Parcel 23 (Robert Brown) Leah Basbanes
Ms Basbanes was present and gave proof of mailing to the Commission along with
revised plans based on a site walk with Mr Howard Robert Brown was present and
stated that his grandparents owned Mazurenko Farm and in 1997 they conveyed 5 6 acres
to him and his son No work is proposed at this time and Mr Howard and Ms Basbanes
changed flag#10 in the field Mr Howard recommends issuing a Positive Determination
of Applicability On a motion by Mr Manzi, seconded by Mr Mabon, the Commission
voted unanimously to issue a Positive Determination of Applicability approving the
wetland line as shown and referencing plan dated 5/l/98

John Soucy and Tom Laudam were present and stated they decided to use Vortec
chambers instead of sand filters for storm water detention based on Mr Lynch's
comments at the last meeting That makes an Operation and Maintenance plan

unnecessary now Mr Howard stated he is waiting for a letter from DPW regarding their
thoughts on maintenance and Vortec chambers One portion of the wetland will be
declared a vernal pool, Richelle Martin and Claire Moody are working on it The septic
must be 100' away from the vernal pool Mr Howard recommends continuing the public
hearing until May 20, 1998 On a motion by Mr Manzi, seconded by Ms Wescott, the
Commission voted unanimously to continue the public hearing until May 20, 1998
242-907 Campbell Rd Sewer Lane (MPG Realty Corp) Gove Envar Cont fr 4115198
This item was continued because the applicant had to justify the wetland crossing Elmer
Pease was present and stated he looked at a couple of options due to the stance the
Commission took at the last meeting Mr Pease has been in touch with DPW and they
don't like the option that would utilize another pumping station on site Another option
would be the sewer line would be dropped and sloped down from a manhole to another
point where everything will be kept in the right-of-way The only problem is two homes
are too low so we are suggesting two ejector pumps for the homes, DPW likes this idea
This option eliminates the need for cross country into the wetlands Mr Howard asked
Mr Pease this NOI will now apply only to Campbell Road, correct? Mr Pease replied in
the affirmative Mr Lynch stated that through a modification request heard earlier
tonight option C contains no wetland crossings and no waivers Mr Manzi wants it made
clear that the applicant is not crossing wetlands and no waivers are requested The
applicant must oversize the pump station at Salem Street Mr Howard stated the
Commission doesn't have the jurisdiction to insist on gravity and whether it is a force
main or a pump station there is room for future tie-ins The Commission wants to be sure
the applicant understands about the problem at Glenwood Street Mr Lynch stated the
proposed looping of the water is gone now, correct? Mr Pease replied in the affirmative
The pump station will be 16' to 17' deep, they will hit water and some blasting will take
place There will be no stockpiling on the road it will be done in dump trucks Ms
Wescott expressed concern about soil borings and Mr Heyland stated they have been
done, there are a lot of boulders but not bedrock There will be no stream crossings
except at Salem Street Mr Manzi stated the time of year that de-watering is done is
critical and it will be conditioned Mr Heyland stated they plan to de-water during the
dry season Mr Lynch asked if the applicant will be bagging all the catch basins and
Mark West replied we will use silt fence material or bags The concern is silt control not
erosion control Judy Goodwin was present and expressed concern about blasting Mr
Lynch stated the Fire Department will notify Mr Howard and he will be present Mr
Howard recommends continuing the public hearing until 5/20/98 On a motion by Mr
Mabon, seconded by Ms Wescott, the Commission voted unanimously to continue the
public hearing until 5/20/98 and the applicant to have revised plans to Mr Howard by
5/13/98.
242-?2? 1420& 1430 Great Pond Rd(Sadanorri) Sammons Env Services, Inc
Bill Simmons and Geoff Andrews were present Proof of mailing was not given and the
applicant was told it must be presented by the next public hearing Mr Simmons stated

the Marchese's,property owners, had a release of#2 heating oil from the soft copper line
beneath the house which pushed out oil and water to the abutting property Mr Howard
asked if the product has been removed from the wetlands and Mr Simmons replied yes,
and Mr Andrews will restore the wetland and buffer zone to pre oil spill The erosion
and sedimentation control are in place A temporary gravel road was installed and will be
restored to a grass area Mr Howard expressed concern that the grades are not clear in
respect to the restoration area and Mr Andrews replied that will be field adjusted The
buffer zone area that was disturbed was a lawn area and it will be restored Mr Howard
asked post mitigation, is it feasible to relocate the sump9 Mr Simmons stated that will be
looked at Mr Howard recommended continuing the public hearing pending a DEP file
number and proof of mailing On a motion by Mr Manzi, seconded by Ms Wescott, the
Commission voted unanimously to continue the public hearing,pending a DEP file
number and proof of mailing,until May 20, 1998
NACC #8 136 Old Farm Rd(Pamela Adams)Seekamp Environmental Consulting
It is now 9 30 pm and Mr Manzi had to leave for work Mike Seekamp was present and
proof of mailing was given to the Commission The wetland was previously delineated
and the pool will be 50' away from the BVW The chemicals used will be a clean, all
natural technical system that reduces chlorine use by 70% and they will be stored in the
house Staked hay bales will be used and no soil stockpiling will occur On a motion by
Ms Wescott, seconded by Mr Masse, the Commission voted unanimously to close the
public hearing and issue a decision within 21 days

Julie Parrmo, Hancock Engineering, was present and gave the Commission proof of
mailing The home was constructed 3 to 4 years ago with a gravel driveway The
homeowners are asking the Commission for permission to install pavers over the gravel
driveway One inch of sand will be applied then the pavers There is an intermittent
stream nearby There was some discussion of whether the pavers are pervious or
impervious and it was concluded they are impervious It was suggested to the applicant
they try pitching the driveway and going to a catch area On a motion by Ms Wescott,
seconded by Mr Mabon, the public hearing was continued until May 20, 1998

Mr Howard had a draft Order of Conditions prepared for the Commission's review On
a motion by Mr Mabon, seconded by Mr Mansour, the Commission voted unanimously
to approve as drafted the Order of Conditions for DEP #242-897

Mr Howard had a draft Order of Conditions prepared for the Commission's review On
a motion by Mr Mansour, seconded by Ms Wescott, the Commission voted unanimously
to approve as drafted the Order of Conditions for DEP #242-898
242-902 Lot 8 Pheasant Brook Road(Evergreen Est) Christiansen &Sergi
Mr Howard had a draft Order of Conditions prepared for the Commission's review On
a motion by Mr Mansour, seconded by Ms Wescott, the Commission voted unanimously
to approve as drafted the Order of Conditions for DEP #242-902 Mr Masse wanted it
noted in the minutes that he refused to sign the decision Scott,you may want to change
the "unanimous vote",we were in a hurry to adjourn and I had to make it up.

On a motion by Mr Mabon, seconded by Ms Feltovic,the Commission voted
unanimously to adjourn the meeting
