HomeMy WebLinkAbout2000-01-19 Conservation Commission Minutes January 19, 2000-North Andover Conservation Commission Meeting The meeting commenced at 7 03 PM Present from the Conservation Commission were Albert P Manzi, Chairman, Scott Masse, Vice Chairman, Beth Wescott, Deb Feltovic, John Mabon, Joe Lynch and Bob Mansour Also present were Richelle Martin, Conservation Administrator and Brian LaGrasse, Conservation Associate Minutes: The minutes from November 3, 1999 and December 1, 1999 were unanimously approved as drafted The minutes from January 5, 2000 were not ready for approval General Business: 242-937-Amendment to Order of Conditions-10 Duncan Drive (Bill Barrett) This Order of Conditions was issued on 11/25/98 authorizing construction of a single family dwelling within the Buffer Zone to a Bordering Vegetated Wetland (BVW) The subject request was to relocate the well The well was originally approved 31' from the wetland and needed to be relocated to meet the 100' setback from the leaching field as required under the Health regulations The new location proposed under this Amendment is located 34' from the wetland line The erosion control will be extended to suit this location Scott Masse made a motion to grant the Amendment with plans dated 1/11/2000, seconded by Deb Feltovic The vote was unanimous 242-749-COC Berry Pond/Harold Parker State Forest(Dept. of Env. Management) DEM requested a Certificate of Compliance in the spring which resulted in the discovery of unauthorized work at Harold Parker State Forest, specifically Berry Pond Since the Order of Conditions had expired, we issued an Enforcement Order to DEM as a mechanism to correct the subject violations and perform the work under Richelle L Martin's supervision The work we required them to perform involved cutting back several culverts and capping them, installing permanent protected wetland resource area signs and reflagging the wetland line The work was performed to the Administrator's satisfaction and confirmed by her in the fall of 1999 We are in receipt of stamped As- Builts and a letter certifying compliance in the file All areas are now permanently stabilized. Scott Masse made a motion to issue a Certificate of Compliance on DEP 4242-749 The motion was seconded by Deb Feltovic and the vote was unanimous 242-72 1-Enforcement Order—Pinewood Subdivision This Order of Conditions was due to expire on 1/21/2000 There are still some outstanding issues in the field that need to be addressed Evergreen Management still needs to install the placards, clean out the detention pond, reflag the wetland line and stabilize all exposed areas The North Andover Conservation Commission agreed to issue an Enforcement Order to Evergreen Management as a mechanism to perform the above referenced work under an expired Order by no later than June 1, 2000 On a motion by Scott Masse, seconded by Deb Feltovic,the Commission unanimously voted to ratify the subject Enforcement Order as drafted by Brian J LaGrasse, Conservation Associate 242-816-Request to lift Cease and Desist-Lot 26 Campbell Forest Subdivision (Mesiti Development) Dick Pelletier and Alan Russell were present representing Mesiti Development The NACC issued a Cease and Desist on the above referenced lot(Lot 26) due to a violation of the 25' No Disturbance Zone which consisted of grading and removal of vegetation Mesiti Development was present requesting the subject Cease and Desist to be removed to allow the commencement on lot 26 Scott Masse made a motion to lift the Cease and Desist on lot 26 mandating the applicant to pay the associated $100 fine prior to. The motion was seconded by John Mabon and the vote was unanimous 242-893-Request to lift Cease and Desist-114 Pump Station (Mesiti Development) Dick Pelletier and Alan Russell were present on behalf of Mesiti Development requesting the NACC to lift the Cease and Desist specific to 1275 Turnpike Street where the pump station will be located for the sewer line The Cease and Desist was issued on the project because work was performed without authorization from the Conservation Department. On a motion by Joe Lynch seconded by Beth Wescott,the NACC voted unanimously to lift the subject Cease and Desist for the 114 Pump Station 242-948-Ratification of Enforcement Order—North Andover Country Club An Enforcement Order was issued to the North Andover Country Club c/o Richard Hormdge and a Violation Notice with a$100/day fine from 10/11/99 through 1/14/2000 due to the discovery of several violations of the Order of Conditions The Country Club started and finished work associated with paving of the parking lot without authorization from the Conservation Department(no Pre-Construction Inspection) No bond was posted, we did not have recording information, etc The Enforcement Order mandated compliance with the Order of Conditions and mandated that the performance bond and recording information be submitted to the Conservation Department immediately The Enforcement Order needed to be ratified and was on a motion by Scott Masse seconded by Beth Wescott by unanimous vote There was a 5 minute recess at 7:55PM. Public Hearing(s) Request for Determination of Applicability No RDA's filed for this meeting Notice of Intents 242-991 Lot 9 Willow Street(MHF Design)(Dutton & Garfield) cont fr 12/1/99 Richelle L Martin received the review from Coler&-Colantomo on 1/19/00 and it indicated that the only issue left to resolve was the floodplain issue. Coler& Colantomo needs confirmation from the DPW or a reliable source that Willow Street did not flood during the October 1996 storm Beth Wescott made a motion, seconded by Deb Feltovic, to continue the public hearing to 2/2/2000 242-???-500 Great Pond Road (Country_ Club)(Irrigation Consulting, Inc.) The applicant's representative did not comply with the abutter notification requirements in the Bylaw They sent out the Wetlands Protection Act abutter notification form only Richelle Martin typed up a new legal notice with the appropriate information to suit the next meeting Ms Martin presented this document to the representative, Rob Jordan who was present on behalf of the Country Club, so they can mail that to the abutters for the next meeting The legal notice has all of the pertinent information relative to the time, date and place of the meeting The applicant needs to refile with DEP, so they can issue a new number DEP stated they want the applicant to refile since they have submitted new information/revisions with this application. On a motion by Scott Masse, seconded by John Mabon,the Commission voted unanimously to continue the public hearing to 2/2/2000 so the abutters can be properly notified Decisions: 242-997-105 Wintergreen Drive(Wyn Palmer)(New England Engineering) On a motion by Scott Masse, seconded by Deb Feltovic,the Commission voted unanimously to adopt the decision as drafted by Ms Martin 242-990-Lots 1-5 Campbell Road (Engineering Alliance) On a motion by Joe Lynch, seconded by Scott Masse,the Commission voted unanimously to adopt the decision as drafted by Ms Martin The meeting ended at 8:17pm- a new record.
